Politics that backfire
Now that the Republican Party holds a majority in the U.S. Senate after the Nov. 4 midterm elections, the GOP has secured an unexpected future benefit: the nuclear option. In November 2013, the Senate Democratic leadership sought to reform filibuster procedures. At the same time, Republicans rejected the verification of high-level positions appointed by the president.The vote threshold for advancing bills was lowered from 60 to 51, the majority of the Senate. Back then, the Democratic Party had 55 seats while the Republicans had 45. With more than 51 votes just with the Democratic senators, the Republican Party could not filibuster against appointments. This is the nuclear option. The Democratic Party justified the nuclear option with the Republican Party’s interference. Among the 168 filibusters in history over the confirmation of high-ranking appointees by the president, about half were made in the Obama administration. But Republican Senator Mitch McConnell warned, “I say to my friends on the other side of the aisle, you’ll regret this. And you may regret it a lot sooner than you think.”
The warning came true in a year. After the midterm elections, the Republican Party gained the Senate majority with 53 seats, and the Democratic Party now has less than 50. McConnell will become the Senate majority leader in January.
If the Republican Party uses the momentum from the midterm elections, wins the presidential election in 2016 and maintains a majority in the Senate, the GOP will breeze through confirmation appointments thanks to the Democrats.
Having originally opposed it, how does the Republican Party feel now? Twenty-six members sent a letter to the Senate leadership asking to retain the nuclear option: “Make no mistake, reviving the filibuster for nominations would significantly reduce, if not eliminate, the probability that the most qualified and most committed constitutionalists would be nominated or confirmed in a future Republican administration.”
In an op-ed for The Wall Street Journal, Republican Senator Orrin Hatch argued, “Unilateral disarmament on nominations would only invite further damage to the institution.”
The Republicans are debating over the nuclear option, and there is little room for the Democrats to get involved. In a way, the Democrats used the filibuster reform as a trick. Under checks and balances, appointments by the president should go through Congress. The Democrats should make efforts to persuade their opponents and let the public judge whether the Republicans are unreasonably interfering with confirmations.

지난 4일 미국 중간선거에서 공화당은 상원을 장악하며 생각지도 않은 ‘미래의 이득’까지 챙겼다. 이른바 ‘핵 옵션(nuclear option)’이다. 지난해 11월 민주당의 상원 지도부는 대통령이 지명한 고위직 인준을 막기 위해 공화당이 필리버스터(의사진행 방해)를 계속하자 아예 규정을 바꿨다. 인준안 표결에 앞서 필리버스터를 차단할 수 있는 의결 정족수를 60명에서 51명(상원 재적 과반수)으로 낮췄다. 당시 상원의 의석 분포는 민주당 55명 대 공화당 45명이었다. 따라서 민주당 상원의원 만으로도 51명을 넘기니 고위직 인준에서 소수당인 공화당이 필리버스터로 실력 행사에 나설 수 없게 됐다. 이게 핵 옵션이다. 민주당은 핵 옵션을 강행하며 공화당의 발목잡기를 이유로 들었다. 대통령이 지명한 고위직 인준안을 놓고 벌어졌던 역대 필리버스터 168차례중 절반 가량이 오바마 정부가 출범한 이후 발생했다는 것이다. 하지만 그날 한 공화당 상원의원이 민주당을 향해 “당신들은 이걸 후회하게 될 거다. 생각보다 훨씬 빨리 후회하게 될 것”이라고 경고했다. 1년 만에 그의 말은 현실이 됐다. 중간선거를 거치며 공화당은 최소 53석을 확보해 다수당이 됐고 민주당은 50석 이하로 쪼그라 들었다. 후회를 예고했던 그 의원은 내년 1월부터 상원을 좌지우지할 다수당 원내대표인 미치 매코널이다. 중간선거 압승의 여세를 몰아 2016년 공화당 대통령이 나오고 상원에서도 공화당의 다수당 지위가 유지되면 공화당은 민주당이 만들어준 핵 옵션으로 고위직 인준이 훨씬 편해지게 됐다. 그럼 당초 핵 옵션에 반대했던 공화당의 요즘 속내는 어떨까. 화장실에 들어갈 때와 나올 때가 다르다는데 공화당이 그렇다. 공화당을 지지하는 보수 인사 26명은 최근 공화당 지도부에 서한을 보내 “필리버스터를 다시 부활시키면 향후 우리가 원하는 인사들이 지명ㆍ인준될 가능성을 줄인다. 실수하지 말라”고 요구했다. 핵 옵션을 그냥 놔두라는 주장이다. 오린 해치 공화당 상원의원도 월스트리트저널에 기고를 해 “공화당만 일방적으로 무장 해제를 할 수 없다”고 주장했다. 공화당이 말을 바꾸건 말건 민주당은 할 말이 없다. 공화당의 반대를 무릅쓰고 강행했는데 이제 와서 가타부타 참견할 수는 없는 노릇이다. 공화당에서 핵 옵션을 놓고 갑론을박을 벌인다 한들 민주당이 끼어들 명분은 없다. 어찌 보면 지난해 11월 민주당의 핵 옵션은 꼼수였다. 3권 분립에서 대통령의 인사는 의회를 통하는게 상식이다. 그렇다면 반대파를 설득하는데 주력하고 그래도 안되면 공화당의 발목잡기를 민심의 저울에 올려 놨어야지 반대를 하지 못하게 규정을 고친 것은 순서가 뒤바뀌었다. 꼼수는 부메랑을 낳게 마련이다. 워싱턴=채병건 특파원
