Unions above the law (KOR)

The Korean Confederation of Trade Unions (KCTU) vowed to launch anti-government strikes next month following the detention of its chair Kim Myeong-hwan. The militant umbrella union will hold a massive rally — as part of a general strike — in front of the Blue House on July 3 to show “who’s the real owner of society” and a nationwide rally on July 18 against the Moon Jae-in administration for its “oppressive labor policy.” The KCTU has already warned of a violent rally “to make them pay for hurting the KCTU” before Kim’s arrest.

The Seoul Southern District Court issued a detention order for Kim because it identified him as the orchestrator of the four series of unauthorized rallies in front of the National Assembly complex. Union members assaulted police officers, broke facilities and tried to break in to the National Assembly premise. Six executives of the KCTU have been investigated for their role in violent protests against labor related bills in March and April. Half of them face a trial under physical detention. The court could not pardon Kim under the same charge. If the KCTU has any complaint about the detention order, it should take appropriate legal measures to appeal.

Law enforcement has become stricter, even to the extent that two former presidents and a chief justice were put behind bars. The KCTU seems to believe that it is above the law as it chooses a walkout and strike instead of taking legal procedures. The union accused the Moon administration of abandoning its campaign promises to address poor work conditions in Korea and leaning towards chaebols to oppress the union.

But that is just an excuse. The minimum wage has gone up by nearly 30 percent over the last two years and the workweek hours have been universally cut to 52, which led to domino bankruptcies of self-employed businesses. The union has been a repeatedly reminding the government of its role in helping liberal figures get elected in the presidential election. The country will fall under union dictatorship if it succumbs to every one of its demands.

The ruling camp must take responsibility for the current crisis. The government has complied with almost all of the KCTU’s demands. It also condoned its violent rallies. The government must restore law and order. The KCTU will lose public confidence entirely if it pushes ahead with the strike plan without a logical cause.

김명환 위원장 구속되자 총파업 선언한 민주노총
김명환 민주노총 위원장의 구속에 반발해온 민주노총이 어제 대정부 전면 투쟁을 선언했다. 청와대 앞 집회에서 총파업 일정과 비상 체제 구축을 밝히는 등 실력 행사를 예고했다. "7월 3일 공공부문 비정규직 노동자들의 최초이자 최대 규모의 공동 총파업 투쟁을 통해 사회의 진짜 주인이 누구인가를 알릴 것이며 18일 '문재인 정부의 노동탄압 분쇄'를 내건 전국 투쟁(총파업 대회)으로 확장한다"는 게 핵심 내용이다. 김 위원장 구속 이전부터 "우리가 받은 것의 두 배 이상을 갚아 다시 민주노총을 건드리면 큰일나겠구나 느낄 수준으로 투쟁할 것"이라고 사전 예고한 대로 실행에 옮기겠다는 의미다.
민주노총의 이같은 행태는 납득이 어렵다. 김 위원장 구속을 정부의 노동탄압으로 연결하는 것 자체가 어불성설이다. 그가 구속된 건 총 4차례 국회 앞 불법 시위를 계획·주도한 혐의를 법원이 인정했기 때문이다. 이들 집회에선 조합원들의 경찰관 폭행, 장비 파손, 국회 무단 칩입 등의 불법 행위가 자행됐다. 특히 올해 3~4월 '노동법 개악 저지' 집회에 개입한 민주노총 간부 6명은 이미 재판에 넘겨졌고 이중 3명은 구속기소됐다. 법원 판단엔 이들과의 형평성 문제도 영향을 미쳤을 것으로 보인다. 민주노총이 법원이 발부한 구속영장에 대해 불만이 있다면 법적 절차에 따라 이의를 제기하면 될 일이다.
더욱이 이 정부 들어 전직 대통령 2명과 전직 대법원장이 구속될 만큼 법 집행은 엄중하다. 그럼에도 법 절차를 밟지 않고 막무가내로 파업 투쟁에만 집착한다면 법 위의 상왕으로 군림하려 한다는 비난에 직면할 것이 뻔하다. 또 민주노총이 "문재인 정부는 더 이상 촛불정권이 아니다. 재벌존중과 노동탄압을 선언했고 저임금 및 장시간 노동 문제에 대한 정책 의지를 상실했다"고 한 주장은 사실관계부터 틀린 견강부회다. 그렇다면 최저임금의 급격한 인상과 주 52시간 근무제 도입 등으로 자영업자들이 줄도산하는 현실은 뭔가. 이러니 현 정부 출범 이후 지속적으로 '촛불 청구서'를 내밀다가 성에 차지 않자 보복 파업에 나섰다는 지적을 받는 것이다. 민주노총은 현 정부 창출에 기여했다는 자부심이 지나쳐 스스로 괴물이 돼가고 있는 건 아닌지 되돌아봐야 한다. 우리나라가 '노조 독재' 국가인가.
민주노총이 이렇게 된 데는 정부·여당의 책임도 크다. 정부·여당은 비정규직 제로(0) 선언, 최저임금 인상 등 노동계의 요구를 거의 수용했다. 반면 공권력은 크고 작은 폭력 집회에 소극적으로 대처해왔다. 정부가 이번 사태를 법과 원칙을 바로 세우는 계기로 삼기를 바란다. 민주노총도 총파업에 대한 원칙이나 철학없이 힘의 논리로만 밀어붙인다면 국민은 물론 조합원으로부터도 외면을 받을 수 있음을 명심해야 한다. 지난 3월 총파업 때 전체 조합원의 1%도 안 되는 3000명 참여에 그친 것을 스스로 기억해야 할 것이다.
