Investigate the ‘Cho Kuk’ fund (KOR)

Korea’s liberals are starting to have doubts about Justice Minister Cho Kuk for the many allegations around his family’s wealth building and the academic integrity of his two children. Spec Watch Korea, a civilian group keeping an eye on corruption, played a key role in triggering the prosecutors’ investigation into Choi Soon-sil and her suspicious relationship with former President Park Geun-hye. The group has filed bribery and other criminal charges against Cho with the Supreme Prosecutor’s Office. A similar accusation was made by Kim Kyung-yul, head of the Center for Economic and Financial Justice at the People’s Solidarity for Participatory Democracy (PSPD), a liberal civic group where Cho once served with a handful of aides under President Moon Jae-in.

Yoon Young-dae, head of Spec Watch Korea, said it did not make sense that Cho was unaware of his wife helping out with the business affairs of the company his family’s private equity fund invested in. Actually, his wife even collected consultant fees from the company. Cho should be under a prosecutorial probe instead of spearheading prosecution reforms, Yoon said. In a recent radio interview, Kim of the PSPD said that researchers of his center found many problems with the so-called Cho Kuk fund. He called members of the civic group “hypocrites” for defending Cho. Kim is under administrative leave from PSPD for his comments.

Kim claimed that a number of accountants and economists scrutinized over the fund invested in by Cho’s family and found signs of power abuse. Kim said there was ample legal evidence to back his argument. But the PSPD leadership struck down Kim’s suggestion to go public with the findings and has so far stayed mum on Cho’s affair.

PSPD has been Korea’s key nonprofit organization for 25 years. But it is being criticized for its targeting of conservative forces. It was a human resource pool for the Moon administration, as many headed to the Blue House and other government posts. It must disclose its finding to be true to its role as a civilian watchdog on the sitting power.

Still, President Moon Jae-in and the ruling party have been critical of prosecutors’ investigation of Cho’s family and accuse the prosecution of dilly-dallying in a reform drive. Prosecutors have the duty to investigate the suspect and criminal charges if they suspect wrongdoings under the criminal investigation act. No political power should deter an investigation into Cho. The government must let the prosecution do its job to find the truth behind the charges against Cho.

조국 펀드 둘러싼 권력형 범죄 의혹 철저 수사하라
이른바 ‘조국펀드’는 권력형 범죄일 가능성이 크다는 분석이 진보진영에서도 나오고 있다. 최순실씨 등을 고발해 국정농단사건을 촉발시켰던 진보진영 경제단체인 투기자본감시센터는 어제 조국 법무부장관이 수 십억원대의 뇌물을 받은 혐의가 있다며 대검찰청에 고발장을 접수했다. 참여연대 김경율 경제금융센터 소장에 이은 투기자본감시센터의 이같은 주장은 조 장관에 대한 검찰 수사의 필요성을 재차 반증하고 있다.
투기자본감시센터 윤영대 소장은 “조 장관 부인 정경심 교수가 자문료까지 받으며 기업의 사업 확장에 이익을 줬는데 조 장관이 몰랐다는 것은 말이 안된다”고 주장했다. 조 장관은 검찰 개혁을 주장할 게 아니라 검찰 수사를 받고 구속돼야 한다고 했다. 참여연대 김 소장도 지난 1일 MBC 라디오 방송에 출연해 “참여연대 경제금융센터 소속 연구원들이 조국 펀드를 분석한 결과,심각한 문제가 있다는 판단을 내렸다”고 밝혔다. 그는 조 장관을 옹호하는 시민사회단체 소속 회원들을 ‘위선자’ 라 부르며 “구역질이 난다”고 비판해 참여연대가 징계 절차를 밟고 있는 인사다.
그는 방송에서 자신과 같은 회계사와 경제학 교수,경제학 박사들이 수 일에 걸쳐 밤샘을 해 가며 분석해 보니 조국 펀드는 권력형 범죄로 비화할 가능성을 발견했다고 밝혔다. 김 소장은 “이같은 분석을 사실로 판단하기에 충분한 증거를 갖고 있다”고 덧붙였다. 김 소장은 특히 전문가들이 법인 등기부등본,전자공시 시스템,유료화된 신용정보를 바탕으로 분석해 조국 펀드의 문제점을 입증할 수 있는 자료를 참여연대가 갖게 됐다고 주장했다. 하지만 참여연대는 “조사 결과를 발표해야 한다”는 김 소장의 건의를 묵살한 채 조 장관 수사에 대해선 분명한 입장 표명을 하지 않아 왔다.
창립 25주년을 맞은 참여연대는 우리나라의 대표적 NGO다. 하지만 권력자들의 비리 의혹에 대한 문제 제기 과녁이 보수정권에 한정돼 NGO 본래의 기능을 상실하고 있다는 비판을 받고 있다. 문재인 정부들어 소속 회원들이 대거 국정에 참여하면서 사실상 권력의 2중대 역할에 머물고 있다는 지적도 나온다. 참여연대는 조국 펀드의 문제점이 담긴 분석 자료를 즉각 공개해 권력 감시라는 본연의 임무에 충실해야 마땅하다.
진보진영의 시민단체 전문가들도 이렇게 주장하고 있는 마당에 문재인 대통령과 여권이 조국 수사의 부당성만 강조하며 검찰개혁을 요구하는 것은 검찰을 장악하려는 의도로 비칠 수밖에 없다. 더욱이 “검사는 범죄의 혐의 있다고 사료하는 때에는 범인, 범죄사실과 증거를 수사하여야 한다”는 형사소송법 조항에 따라 조 장관에 대한 검찰 수사가 정치권력에 의해 방해를 받아선 절대 안될 일이다. 문 대통령의 지시로 윤석열 검찰총장은 특수부 폐지 등을 골자로 한 검찰개혁안을 발표했고,청와대도 긍정적 반응을 보였다. 이제 남은 것은 조국 펀드를 둘러싼 각종 의혹에 대해 국민이 납득할 만한 결과를 내놓을 수 있도록 검찰 수사의 독립성을 보장하는 일뿐이다.
