A nonsensical petition (KOR)

The lead-up to the Blue House’s decision to submit to the National Human Rights Commission a public petition to investigate possible human rights violations by the prosecution in the course of its investigation of the family of former Justice Minister Cho Kuk raises many suspicions. The Blue House announced that it had referred the petition to the commission after it received 226,434 signatures on the issue on the Blue House page since Oct. 15. (The Blue House has set a guideline to answer to petitions with more than 200,000 signatures.) Fortunately, the Blue House withdrew the petition, saying it was sent to the commission by mistake.

Nevertheless, the Blue House’s original motive to submit the public petition to the commission rings alarms on many fronts. First of all, the commission’s inspection of a case under a prosecutorial probe and court trial could influence the judiciary process. The society also suffered enough from the lengthy controversy over Cho and his family. The petitioners claimed the rights of Cho’s wife and children have been infringed through the disclosure of their private life and documents. Yet there are complaints over preferential treatment towards Chung Kyung-sim, Cho’s wife, for discreet questioning and a closed-door trial process. Few people would understand why the president’s chief of staff had to personally file the complaint with the commission despite its withdraw a day later.

The action came while the Blue House and the political heavyweight-turned Justice Minister are pitted against the prosecution over the latest reshuffle which replaced or demoted most of the top prosecutors under Prosecutor General Yoon Seok-youl who spearheaded probes on Cho and the Blue House. There were sneers about whether the Blue House would submit a similar public petition on former President Park Geun-hye or Chung Yoo-ra — daughter of Park’s secret friend Choi Soon-sil who brought down the Park administration — if the petition gathers more than 200,000 signatures.

The Blue House civilian petition page has repeatedly been questioned for its service and reliability in fairness. There have been questions about how many of the petition selections are to the Blue House’s liking. The Blue House only pays attention to issues that favor its policies to make them look as if they represent the public consensus. This kind of lopsided attitude should be avoided.

"조국 일가 인권침해" 인권위 송부, 즉각 철회해야
청와대가 어제 "조국 전 법무부 장관 가족의 수사 과정에서 발생한 인권침해를 조사해 달라는 국민청원을 국가인권위에 송부했다"고 밝혔다. 지난해 10월 15일 이후 한 달간 청원자(22만 6434명)가 20만 명을 넘은 데 대한 공식 답변이라는 설명이다. 그러나 정치적 오해를 부를 수 있는, 매우 부적절한 조치다. 철회하는 게 마땅하다.
먼저 조 전 장관 일가에 대한 검찰 수사와 법원의 재판이 진행 중인 시점에 인권위가 조사를 벌이는 것 자체가 공정한 수사와 재판에 영향을 줄 수 있다. 우려하지 않을 수 없다. 청와대는 '재판과 직·간접적으로 관련된 정보(공개될 경우 재판의 심리 또는 재판 결과에 영향을 미칠 구체적 위험성이 있는)' 등에 대해선 비공개, 즉 답변을 거부한다는 원칙을 세웠었다. 그런데 청원 석 달이 지나 갑자기 형평성을 무너뜨리고 인권위로 송부한 까닭이 무엇인지 납득이 되지 않는다.
지난해 하반기 이후 우리 사회는 조 전 장관 일가 수사로 극심하게 분열, 갈등해 왔다. 그 후유증은 지금도 가라앉지 않고 있다. 청원자들은 조 전 장관 부인인 정경심 교수에 대한 인격권 침해, 딸의 학적부 공개 등을 인권침해 사례라고 주장한다. 하지만 조 전 장관의 묵비권 행사, 피의자의 출퇴근 조사, 비공개 검찰 소환조사에 이어 정 교수는 재판마저 비공개로 받고 있어 국민의 공분을 사고 있다. 조 전 장관 일가가 보통 사람들은 상상도 할 수 없는 특별한 대접을 받고 있어 되레 특혜 수사, 봐주기 수사가 아니냐는 비난이 나오는 마당이다. 그런데도 대통령 비서실장 명의로 인권침해 여부를 조사해 달라며 불쑥 인권위에 송부했다고 하니 이를 선의로 받아들일 국민이 도대체 몇이나 되겠는가. 그러니 뭔가 정치적 노림수가 있는 것 아닌가 하는 의심이 나오는 것이다.
그렇지 않아도 정권실세에 대한 수사를 둘러싸고 '윤석열 검찰'과 법무부·청와대가 정면 충돌하며 낯 뜨거운 공방을 벌이는 와중이다. 상식을 벗어난 이번 조치는 여론을 앞세워 검찰을 압박하려는 것 아니냐는 의심을 사기에 충분하다. 인터넷엔 '박근혜·정유라도 국민청원 하면 국가인권위가 조사해 주나' '권력에 취해 눈이 멀어버렸다'는 비난 댓글이 넘친다.
청와대 청원은 앞서도 신뢰·공정성 시비에 휘말렸었다. 대의민주주의를 보완할 국민 소통 공간이라는 취지와 달리 중복 투표를 통한 청원 인원수 조작 논란, 사실과 다른 가짜뉴스와 부적절한 청원 내용이 많아 청원 무용론까지 나오는 터다. 그런데도 특정 내용을 선별적으로 골라 국민 대다수의 여론인 양 부각하는 건 어불성설이다. 자칫 청와대 스스로 '국민 청원=프레임 전쟁의 도구'라는 비판을 자인하는 꼴이다. 그런데도 인권침해 진정서를 내고 국가인권위가 실제 조사에 착수한다면 국민 불신과 비난은 걷잡을 수 없이 가속화될 것이다. 청와대가 지금이라도 즉각 철회해야 하는 이유다.
