양손 들어주기
법원이 4일 이른바 ‘빨래터’ 공방을 마무리했다. 먼저 “(위작) 의혹을 제기할 만한 상당한 이유가 있었다”며 피고인 미술전문지의 명예훼손 혐의를 벗겨줬다. 진품일 가능성을 시사해 원고인 미술품 경매업체에도 힘을 실어줬다. 절묘한 ‘양손 들어주기’다. 미국에는 역사적인 ‘양손 들어주기’ 판결이 있다. 존 마셜(1755~1835) 미국 연방대법원장의 ‘마버리 대 매디슨’ 사건이다.

ⓑ “holding up both hands.” → acknowledging both sides. 신문에 있는 “양손 들어주기”를 그대로 옮긴 번역임. 제목에서 “양손 들어주기”라는 호기심을 불러 일으키는 모호한 표현을 썼으므로 본문에서는 그대로 쓰기보다는 그 의미가 무엇인지 확실하게 해주는 것이 바람직. 문맥상 법원이 피고인과 원고인, 두 쪽의 의견을 모두 들어줬으므로 acknowledging both sides라고 수정.
ⓒ is → was 과거에 미국에서 있었던 판결에 대해서 말하는 것이므로 현재형 대신 과거형으로 바꿈.
ⓓ Marbury vs. Madison → Marbury v. Madison 판결 사례(case)에 대해서 쓸 때는 똑같은 versus이더라도 v. 만 쓰는 것이 원칙.
3월 2일 판사 지명, 3일 자정까지 상원 동의-임명장 작성-대통령 서명-국무장관 날인이 숨가쁘게 진행됐다. 그러나 미처 임명장을 다 교부하지 못한 채 날이 밝았다. 토머스 제퍼슨 대통령의 임기가 시작된 것이다. 제퍼슨 대통령은 매디슨 국무장관에게 아직 임명장을 못 받은 판사들에 대한 임명을 철회하도록 했다.

ⓐ a signature → signatures 대통령과 국무장관의 서명이 필요하므로 복수인 signitures로 수정.
ⓑ Secretary → the Secretary 보통 비서라는 뜻이지만 ‘장관’이란 의미로 쓰일 때는 관사 the를 함께 써줌. 그리고 꼭 Secretary가 아니더라도 정관사 the는 고유 명사 이외에도 모든 명사의 단수형과 복수형에 쓰여 그 명사를 한정함.
ⓒ until → just before until은 자정을 포함하지만, 문맥상 자정 바로 이전까지 서명을 받아야 하는 것이므로 just before이 더 알맞은 표현.
ⓓ that appointment be withdrawn → to withdraw the appointments ask나 recommend와 같은 단어 후에 that절이 오면 ‘주어+should+동사원형’ 이 되고, “~해야 한다” 라는 의미를 가짐으로 문법적으로 문제가 없음. 하지만 해석하면 문맥상 appointments가 누구로부터 철회되어야 한다는 말이 나오지 않음. 그러므로 that절을 to부정사로 시작하는 문장으로 바꾸어 Jefferson대통령이 James Madison에게 appointments를 철회하라고 요청했다는 문장을 만들어 주면 됨.
