Judiciary reforms pass, prosecutors go on warpath

The National Assembly yesterday approved a series of controversial revisions to the criminal procedure law, which has prompted prosecutors to resign en masse.

The bill, containing a significant last-minute change, was submitted to the National Assembly’s main voting session yesterday afternoon.

Of the 200 lawmakers who voted, 175 supported the changes, while 10 opposed and 15 abstained.

The revision of the criminal procedure law was intended to redistribute investigative powers between the police and prosecutors.

Before, all power to investigate crimes were held by prosecutors, who said the police were liable to commit human rights abuses if they could start or close investigations.

After months of negotiations, the National Assembly’s special committee on judicial reform last week approved a series of changes.

On Tuesday, the bill was reviewed by the National Assembly’s Legislation and Judiciary Committee, and a significant last minute change was made before it went to a full vote.

The final bill still gives prosecutors the power to supervise all investigations, but lawmakers inserted a new provision that said how they supervise will be decided by a presidential decree to be drawn up in the future.

Prosecutors assume that the president and his cabinet, when they draft the decree, will favor the police.

In a statement, the prosecution said it took months of negotiations to come up with reforms acceptable to both police and prosecutors, but the Legislation and Judiciary Committee undid all that work at the last moment with their final change.

Prosecutors criticized the lawmakers for basically siding with the police.

The prosecutors said that the specifics of how they supervise investigations should be decided by an ordinance written by the justice minister, not a decree drafted by the president.

In protest, nine senior prosecutors, including five from the Supreme Prosecutors’ Office, expressed their intention to resign on Wednesday.

A group of senior prosecutors of the Seoul Central District Prosecutors’ Office also held a meeting Wednesday evening to discuss their reactions. The office is the largest prosecutorial body in the nation.

Prosecutor General Kim Joon-gyu also issued a statement Wednesday night saying he couldn’t accept the lawmakers’ change to the bill, which had been agreed to and signed by ministers, prosecution leaders and police.

He said he will disclose Monday whether he will resign from his post or not. Kim has about 50 days left in his tenure.

The Blue House tried to calm the situation.

“The prosecution must show a mature attitude by thinking from the people’s point of view,” President Lee Myung-bak told Kim yesterday morning, according to Blue House spokesman Park Jeong-ha.

Kim and Lee met at the global summit of top prosecutors at COEX in southern Seoul.

In his speech at the event, Lee stressed the importance of reform in Korea’s prosecution to meet the public’s expectation of justice and fairness.

The president was told about the prosecutors’ resignations on Wednesday night and stressed that they must not be seen as taking action as a group, according to Blue House officials.

“The prosecution is one of the top, elite organizations,” Park said. “We expect them to positively accept the changes and adapt maturely, keeping their reputation as an elite group.”

Justice Minister Lee Kwi-nam, who was scheduled to accompany the president to the event, instead held an emergency meeting with the leadership of the Supreme Prosecutors’ Office.

The minister dissuaded the prosecutors from leaving en masse.

The bill passed by the National Assembly also grants police partial rights to initiate criminal probes under the broad supervision of prosecutors.

The police yesterday welcomed the passage of the bill, and vowed to respect the prosecution when the presidential decree goes into effect.

The police also promised to improve the transparency of investigations and protect human rights, while fighting internal corruption.

“수사권 대통령령이 타당” … 175대 10 압도적 가결

싱겁게 끝난 국회 ‘수사권 표결’

검찰과 경찰이 첨예하게 대립해온 형사소송법(형소법) 개정안이 국회 본회의에 상정된 30일.

국회 법제사법위원회(법사위)가 검경 수사권 조정안에 손을 대 경찰관에 대한 검사 지휘의 구체사항을 ‘법무부령’이 아닌 국무회의 심의가 필요한 ‘대통령령’으로 정하도록 바꾸자 청와대와 검찰, 경찰은 모두 여의도 국회를 주시했다.

그러나 오후에 열린 표결은 싱겁게 끝났다.

재석 의원 200명 중 찬성이 175표. 반대는 10표(기권 15표)뿐이었다.

표결을 앞두고 검사 출신인 한나라당 박민식 의원은 발언을 신청해 국회 법사위가 검찰의 수사 지휘에 대한 범위를 ‘법무부령’이 아닌 ‘대통령령’으로 바꾼 것을 비판했다. 그는 “실로 오랜만에 검경이 머리를 맞대 합의한 개정안의 잉크가 마르기도 전에 (국회 법사위가) 수정한 것은 합의정신을 소중히 해야 할 국회가 갈등을 다시 조장하는 것”이라며 “합의안은 자구 하나를 건드리는 순간 합의의 균형이 무너지고 당사자들이 승복하지 못할 것”이라고도 주장했다.

하지만 반대토론에서 검찰을 질타하는 목소리가 더 크게 나왔다.

국회 행정안전위원회 소속인 같은 당 이인기 의원은 “형소법 개정안은 수사 현실을 법제화하는 정도에 불과해 ‘검찰 개혁’이라고 말하기에도 민망하다”며 “수사는 국민의 기본권에 관한 사항인 만큼 (경찰에 대한) 검사의 지휘를 규정할 때는 국무회의를 거쳐야 하는 ‘대통령령’으로 정하는 것이 타당하다”고 반박했다. 이 의원은 “검찰이 ‘법무부령’을 고집하는 것은 수사 실무의 세부사항을 좌우하겠다는 의도”라고도 했다.

민주당 유선호 의원은 검찰 간부들의 집단 사의 표명에 대해 “참으로 가관”이라며 “국민에 대한 반란 아니냐”고 했다. 유 의원은 “기득권이 조금이라도 침해될까 봐 집단적으로 반발하는 검찰이 과연 공익의 대변자인가”라고 꼬집었다. 정범구 의원도 “선출되지도 않았으면서 국민의 통제조차 거부하는 무소불위의 권력을 국회가 허용해서는 안 된다”고 가세했다.

이명박 대통령도 검찰의 집단 움직임이 바람직하지 않다는 입장을 검찰에 전달했다고 한다.

이 대통령은 표결에 앞서 국민경제대책회의에서 “모든 이해를 달리하는 계층 간 마찰이 일어나 국민을 불안하게 만들고 있다. 힘을 가진 사람들이 싸운다고 볼 수도 있다”면서 사실상 검찰에 자제령을 내렸다. 이 대통령은 “서로 남의 탓만 하면 안 된다. 이런 점에서 누구 할 것 없이 모든 계층이 자성할 필요가 있다”고도 했다. 이 대통령이 서울 코엑스에서 열린 세계검찰총장총회에서 영접을 나온 김준규 검찰총장에게 ‘성숙한 자세’를 요구한 것도 같은 맥락이었다.

그런 만큼 청와대에서도 형소법 개정안 통과는 “당연하다”는 기류가 강했다. 청와대 관계자들은 “법무부령과 대통령령의 차이가 얼마나 크다고 검찰이 저런 반발을 하느냐”거나 “임기를 불과 두 달 남겨둔 검찰총장이 사퇴한다는 게 무슨 말이냐”는 식으로 비판의 목소리가 나왔다.

김황식 국무총리는 법안 통과 이후 검찰과 경찰에 더 이상의 대립을 자제해달라고 당부했다. 김 총리는 “검경이 당초의 합의정신으로 돌아가 불필요한 논란을 자제하는 자세를 가져야 할 것”이라고 말했다고 유성식 총리공보실장이 전했다. 또 “앞으로 진행될 대통령령 제정에 있어서도 수사 과정에서 인권 보호와 실체적 진실 발견이 함께 구현될 수 있도록 검경이 최선의 노력을 다해야 한다”고 덧붙였다. 청와대에선 “김 총리의 입장 표명이 곧 정부 입장”이라고 했다.
