Doctor who killed pregnant wife gets 20 years

The doctor accused of killing his eight-month-pregnant wife was found guilty and sentenced to 20 years in prison yesterday by the Seoul Central District Court.

The husband, surnamed Baek, reported to police on Jan. 15 that he had discovered his wife dead in a bathtub in their Seoul home.

But Baek was charged in March for murder after an autopsy concluded that his 29-year-old wife died of “manual strangulation” and found his DNA under her blood-stained fingernails. She also had bruises on her face and wrist.

“We found plenty of evidence to show that his wife died of strangulation,” the court said yesterday in its ruling. “We accepted all of the allegations claimed by prosecutors.”

The court added: “After her death, the suspect concentrated on defending himself, showing no sorrow for his dead wife and fetus.” Yet the court declined to give Baek a life sentence because it said it found no evidence that the murder had been premeditated.

During Baek’s trial, prosecutors said that he had strangled his wife after a quarrel in their bedroom before moving her body to the bathroom to make the death look like an accident.

However, Baek’s attorney said the wife had slipped in the bathtub and experienced neck constriction.

In explaining his DNA under his wife’s fingernails, Baek said that he had a skin disease and that his wife scratched his body for him. But the court said that it found that Baek had no allergies or skin diseases. The court added that Baek had scratches on his arm and face when he reported his wife’s death to police. Although Baek claimed that the scratches were from itching his skin, the court said they indicated that the couple had fought.

The court said the wounds on the wife’s body, in addition to his DNA under her fingernails, showed that she had either been beaten by Baek or had fought back before she died.

Baek’s wife, the court said, could have been killed in the bedroom because her urine was found on the couple’s bed and it could have been discharged as she lay dying.

Prosecutors said that Baek, a fourth-year resident at Severance Hospital in Seoul, enjoyed playing computer games and that the couple had a history of fighting over his hobby, of which his wife disapproved. On the night his wife was killed, Baek was found to have played computer games.

올해 1월 14일 대학병원 전공의 백모(31)씨가 만삭의 아내를 살해한 혐의로 수사를 받게 되자 세간의 이목이 집중됐다. 유명 대학 출신 의사가 범인으로 지목된 살인 사건인 데다 목격자나 확실한 물증이 없다는 점에서 1995년 치과의사 모녀 살해 사건을 연상시켰기 때문이다. 당시 범인으로 지목됐던 치과의사 이모씨는 대법원에서 무죄가 확정됐다.

　백씨는 사건 직후 자신이 아내를 죽인 게 아니라고 주장했다. 아내가 빈혈 등으로 실신한 뒤 목이 접힌 상태에서 욕조 안에 누워 있다 질식사했다는 것이다. 임신 중인 여성의 5%가 실신을 경험하고 28%가 실신에 근접한 경험을 한다는 연구 결과 등도 제시했다. 공방이 거세지면서 경찰이 백씨에 대해 청구했던 구속영장이 법원에서 기각됐다. 사고사일 가능성도 있다는 것이었다. 경찰은 증거를 추가 제출한 뒤 우여곡절 끝에 3주 후 영장을 발부받았다.

　재판 과정에서 백씨 측의 요청으로 마이클 폴라넨 캐나다 토론토대 법의학센터장이 법정에 나왔다. 백씨 측이 주장하는 ‘이상자세에 의한 질식사’ 가능성도 배제할 수 없다는 주장을 폈다. 하지만 재판부는 판결문에서 “폴라넨이 ‘목눌림 질식사’ 가능성을 완전히 부인한 것이 아니고, 법정에 나와 선명한 부검 사진을 본 뒤에는 ‘액사(목눌림에 의한 질식사) 가능성도 배제할 수 없다’고 견해를 바꾸는 등 부검 결과를 뒤집을 증언은 아니다”고 밝혔다. 검찰은 아내 목 부위 피부가 까진 흔적과 목 근육 내부 출혈을 백씨가 아내의 목을 졸라 숨지게 한 근거로 들었다. 반면 백씨는 “목에 눌렸다는 자국이 선명하지 않고, 근육 내부 출혈은 사후에 생기는 출혈”이라고 맞받았다. 이에 대해 재판부는 “웅덩이 등이 아니라 표면이 매끈한 욕조에서 이상자세 때문에 숨졌다면 목 피부 까짐 현상이 생기기 어렵고, 근육 내부 출혈은 생전에 외부의 힘에 의해 생긴 것”이라고 판단했다.

　사건 직후 백씨가 보인 ‘수상한 행적’도 재판부의 판단에 영향을 미쳤다. 백씨는 사건 당일 평소보다 2시간가량 일찍 도서관에 갔고, 낮에 걸려온 수십 통의 전화를 받지 않았다. 특히 아내가 숨진 뒤 경찰에 알리지 않고 여러 차례 집에 드나들었고, 아내의 빈소에서 37권의 판타지 소설을 읽은 데 대해 재판부는 “슬픔에 잠겨 할 수 있는 행동으로는 보이지 않는다”고 했다.

　양형(형량 결정) 기준에 따라 재판부는 백씨에게 무기징역을 선고할 수도 있었다. 하지만 백씨가 우발적으로 범행한 것으로 보이는 점 등을 들어 징역 20년을 선고했다.

　95년 치과의사 모녀 살해 사건으로 기소됐던 이모씨는 1심에서 사형이 선고됐으나 2심에서 무죄로 뒤집혔고, 대법원에서 확정됐다. 외국 법의학자를 증인으로 신청해 재판 결과에 영향을 미치려고 한 점도 유사하다. 하지만 95년 사건에 비해 이번 사건에서는 백씨 부인 시체에 남은 상처와 사건 당시 정황이 보다 명확해 백씨에게 유죄가 선고된 것으로 받아들여진다.
