권력과 돈 앞에서 법의 잣대 뒤틀리면 진보•보수가 무슨 소용
올 초 미국에서 출간돼 진보와 보수 지식인들 사이에 격렬한 논쟁을 촉발한 책이 『커밍 어파트(Coming Apart•분열)』다. 미 기업연구소(AEI) 연구원인 찰스 머레이가 미 백인 사회의 단절과 분열 현상에 대해 쓴 책이다. 그에 따르면 미국 백인의 소득 수준 상위 20%(상류층)와 하위 30%(하류층)는 전혀 다른 세상에 살고 있다. 사는 곳이 다르고, 삶의 방식이 다르다.상류층은 버지니아의 매클린이나 캘리포니아의 팰로앨토, 코네티컷의 뉴 캐난 같은 ‘수퍼 우편번호(Zip Code)’를 가진 동네에 섬처럼 흩어져 끼리끼리 모여 사는 반면 하류층은 대도시 빈민가에 사실상 격리돼 있다. 두 계층의 지리적•문화적 격차는 극복할 수 있는 한계를 이미 넘어섰다고 머레이는 지적한다. 예컨대 상류층에 속하는 백인 여성 중 미혼모 비율은 5% 미만인 데 비해 하류층 백인 여성은 40%가 미혼모라는 것이다. 결혼에 대한 가치관의 차이가 그만큼 크다는 것이다.
머레이는 “근면, 정직, 결혼, 종교 등 네 가지가 미 합중국 건국의 토대가 된 핵심 가치였다”면서 상류층에서 유지되고 있는 이 가치들이 하류층에서는 실종된 것이 두 계층이 물과 기름처럼 섞이지 못하는 이유라고 설명한다. 따라서 상류층은 자기들만의 삶에 몰두하는 소극적이고 이기적인 태도에서 벗어나 미국의 핵심 가치를 다른 계층에 적극적으로 전파해야 한다는 것이다. 미국이 위기에서 벗어나려면 미국적 가치의 근본으로 돌아가야 한다는 주장이다. 문제의 근원을 개인에게서 찾는 전형적인 보수주의 논리다. 진보 진영의 반박이 거셀 수밖에 없다.
보수주의가 개인의 자유의지에 대한 신념에 기초하고 있다면 진보주의는 사회구조의 변혁에 대한 신념에 기초하고 있다. 문제가 생기면 보수는 사회보다 개인 탓을 하지만 진보는 개인보다 사회 탓을 한다. 보수는 자유와 경쟁을 중시하지만 진보는 연대와 공생을 강조한다. 그 결과 보수는 개인적, 종교적, 문화적 색채를 띠는 데 비해 진보는 사회적, 세속적, 정치적 색채를 띤다.
좌든 우든 어느 한쪽으로 쏠리면 배는 전복될 수밖에 없다. 사회가 항진(航進)을 계속하려면 진보와 보수의 균형이 필요하다. 민주주의 국가에서 진보와 보수 진영이 시계추처럼 번갈아 집권하는 것은 그래서 당연하고, 바람직하다. 하지만 그보다 더 중요한 것은 법 앞의 평등이다.
권력과 돈에 의해 법의 잣대가 뒤틀리고 왜곡된다면 어느 쪽이 집권을 하든 그 사회는 탈이 나게 돼 있다. 민간인 불법사찰의 파장이 청와대 핵심까지 번지고, 삼성의 힘 앞에서는 법조차 무력해지는 현실도 법의 잣대가 이중적이기 때문이다. 권력과 금력이 법 위에 군림하는 사회에서 보수를 외치고, 진보를 외친들 그게 무슨 소용인가.
