폰카 함부로 찍지 마라 훗날 당신 발목 잡는 족쇄가 될지니

1876년 그레이엄 벨이 전화를 발명했다. 곧 장거리 대화가 가능해졌다. 세상은 환호했다. 그러나 좋은 것만 있는 기술이 어디 있으랴. 몇 년 지나지 않아 도청기술이 발명됐다.

　1894년 이스트맨코닥이 휴대용 카메라를 내놓았다. 이름은 ‘스냅카메라’. 사진 한 장 찍히려면 오랫동안 포즈를 취해야 하던 시절이다. 값은 좀 비쌌던가. 반면 스냅카메라는 싸고 편했다. 코닥은 ‘세상을 바꾼 기업’이 됐다. 역시 나쁜 것도 따라왔다. 파파라치의 등장이다. 세상은 두 가지 기술, 전화와 카메라의 등장으로 중요한 한 가지를 잃게 됐다. 바로 ‘사생활’이다. 당시 시사 평론가 갓킨(Godkin)은 “이런 새로운 발명품들로 개인의 사생활이 없어질 것”이라고 내다봤다.

사생활을 누릴 권리(The Right to Privacy)’가 등장한 것도 이때다. 보스턴의 유명 변호사 새뮤얼워런과 젊은 검사 루이스브랜다이스가 1890년 ‘하버드 로 리뷰(Harvard Law Review)’에 논문 한 편을 실었다. 그들은 논문에 “즉석 사진과 언론이 개인 생활, 가정 생활이라는 성스러운 영역을 침범했다”며 “수많은 기계장치는 벽장 속에서 속삭이는 얘기도 지붕 꼭대기에서 까발려지게 할 것”이라고 적었다. 이후 법률 논쟁이 뜨겁게 불붙었다. 마침내 사생활 침해는 불법행위로 규정됐다. 이 논문은 역사상 가장 유명한 법률 논문 중 하나가 됐다.(다니엘솔로브 『평판의 미래』)
법무차관을 낙마시킨 성 접대 논란이 뜨겁다. 과정도 석연찮고 진위도 분명치 않다. 청와대 검증시스템에 대한 비난이 쏟아지고 권력 투쟁설까지 나오는 등 인화성도 크다. 이런 큰 논란뿐 아니다. 수면 밑엔 또 다른 논란거리가 숨어 있다. 폰카다. 이런 사달이 어떻게 가능했나. 폰카로 찍은 동영상 때문이다. 폰카는 전화+스냅카메라+알파다. 프라이버시 파괴력도 그만큼 크다.

　예는 셀 수 없이 많다. 음식을 앞에 두고 폰카부터 꺼내는 장면, 이젠 일상이 됐다. ‘먹어야 사는’ 인간의 생존 본능마저 넘어섰다는 얘기다. 폰카는 해결사 노릇도 한다. 차량 접촉 사고 때, 필수품이 된 지 오래다. 숱한 무명을 유명인으로 만들기도 했다. 개똥녀•국물녀•쩍벌남… 그렇게 유명세를 치른 이름들이다. 이쯤 되면 “나는 네가 한 일을 죄다 알고, 까발릴 수 있다” 수준이다.

이런 폰카의 감시에서 벗어나는 법, 물론 있다. 옛말을 따르면 된다. 공자는 ‘군자는 혼자 있어도 조심한다(君子, 必愼其獨也)’고 했다. 나쁜 생각을 아예 않는 사무사(思無邪)의 경지도 말했다. 그런데 이런 경지가 어디 아무나 되나. 우리 같은 장삼이사는 어쩌란 말인가.이참에폰카 금지법이라도 만들어야 하나. 동의 없는 ‘찰칵’은 불법행위라며.
