Interior Minister Lee Sang-min became the first sitting minister to be impeached by the National Assembly in the country's modern political history on Wednesday.

행정안전부 이상민 장관은 수요일 헌정 사상 처음으로 현직에 있으면서 탄핵된 국무위원이 됐다.

The impeachment motion, which holds Lee responsible for the government’s handling of a deadly crowd crush in Itaewon in October, was passed by the liberal Democratic Party (DP) with support from the minor liberal Justice Party and Basic Income Party.

더불어민주당은 정의당과 기본소득당의 지지를 얻어 지난 10월 있었던 이태원 참사에 대한 이 장관의 책임을 묻는 탄핵소추안을 국회에서 통과시켰다.

Out of 293 lawmakers present, 179 voted in favor of impeachment, while 109 voted against. The DP holds a 169-seat majority in the National Assembly.

참석 의원 293명 중 179명이 찬성했고, 109명이 반대했다. 더불어민주당은 국회에 과반인 169석을 갖고 있다.

Lee has denied responsibility for the Oct. 29 crowd crush in the Itaewon nightlife district of Seoul that ultimately claimed the lives of 159 people and injured at least 196, arguing that the disaster could not have been foreseen by the government and that he was unaware that large gatherings take place in the area during Halloween.

이 장관은 10월 29일 이태원에서 159명이 사망하고 196명의 부상자가 발생한 참사에 대해 책임을 부인해 왔다. 그는 이런 사태가 발생할 것을 정부가 예측하기 어려웠고 핼로윈데이에 많은 인파가 몰렸다는 사실을 인지 못했다고 주장했다.

Democratic Party leader Lee Jae-myung on Wednesday called Lee’s impeachment “the first step to correcting the irrationality and irresponsibility of President Yoon Suk Yeol’s administration.”

이재명 더불어민주당 대표는 수요일 이 장관의 탄핵은 윤석열 정부의 비상식 그리고 무책임을 바로잡는 첫걸음이라고 말했다.

With his impeachment, Lee is immediately suspended from his duties until a final decision in the case has been reached by the Constitutional Court. The court has 180 days to decide whether to remove Lee from his post or to reinstate him.

탄핵소추안이 통과됨으로써 헌법재판소의 최종 판결이 나기 전까지 이 장관의 직무는 정지됐다. 헌법재판소는 이 장관의 탄핵을 받아들일지, 아니면 복직시킬지 180일 이내에 결론을 내야 한다.

Two presidents have been impeached: Roh Moo-hyun in 2004 and Park Geun-hye in 2016. The Constitutional Court rejected Roh’s impeachment after 64 days, but upheld Park’s and removed her from office after 92 days.

지금까지 2004년 노무현 대통령 그리고 2016년 박근혜 대통령이 탄핵됐다. 헌재는 64일만에 노 전 대통령에 대한 탄핵을 기각한 반면 박 전 대통령의 경우 92일만에 탄핵을 인용해서 대통령직에서 파면했다.

However, the court took 267 days to reject an impeachment motion against Lim Seong-geun, a former Busan High Court judge who was accused and later acquitted of charges of abuse of power and obstruction of justice.

acquit: 무죄를 선고하다

하지만 임성근 전 부산고등법원 부장판사 탄핵안을 기각하는 데 267일이 걸렸다. 임 전 판사는 직권남용과 재판 개입 의혹을 받았지만 이후 무죄가 확정됐다.

The Constitutional Court may take longer than 180 days to reach a decision regarding the interior minister's impeachment motion, given that justices Lee Seon-ae and Lee Suk-tae are due to retire from the nine-member bench in March and April. A minimum of seven justices are required to participate in the court's decision-making process.

헌법재판소가 이 장관 탄핵을 결정하는 데 180일 이상 걸릴 것으로 예상되는 건 9명으로 구성된 헌법재판관 중 이선애 재판관과 이석태 재판관이 각각 3월과 4월에 은퇴하기 때문이다. 헌재가 결정을 내리기 위해서는 최소 7명의 헌법재판관이 출석해야 한다.
