검객 논쟁

검객의 으뜸 자질은 칼솜씨다. 일본에서 전설적인 검객으로 추앙받는 미야모토 무사시(1584~1645)는 비움의 경지를 최고의 검법으로 쳤다. 검법을 익히되 얽매이지 않고, 상대를 알되 미워하지 않고 마음을 비울 때 손에 든 칼은 천하무적이 된다고 했다. 중국의 장자는 포정이란 백정의 소 잡는 이야기, 즉 포정해우(<5E96>丁解牛)를 통해 칼 놀림을 예술로 끌어올렸다. ‘소 잡는 모습이 마치 춤을 추는 듯 우아하고, 들리는 소리는 아름다운 음악과 같다’고 극찬했다. ‘소를 눈으로 보지 않고 정신으로 대하며, 소 몸 속의 결을 따라 그 빈틈으로 칼날을 놀리는 자연스러움’이 칼 다루는 법이자 도(道)의 원리라고 설파했다.

요즘 검사 사회에서 ‘검객 논쟁’이 한창이다. 한화·태광그룹 수사를 지휘했던 남기춘 서울서부지검장의 사퇴로 촉발됐다. 그에겐 검객이라는 별칭이 따라다녔다. 눈치를 보지 않고 저돌적으로 파헤치는 수사방식이 검객을 연상시켰다고 한다. 이를 두고 사물을 이분법적으로 가른 뒤 칼을 마구 휘두르는 전근대적 기법이라는 비판이 나온다. 칼잡이의 운명이라는 반론이 맞선다. 분명 검객 검사 시대는 가고 있다. 다만 비움의 칼솜씨와 대의(大義)를 생명처럼 여기는 검객의 정신마저 사라질까 걱정된다.

Supporters argue that it is ⓑa fate of a swordsman. Clearly, the age of prosecutors as ⓒswordsman is ebbing ⓓaway. However, they must not lose spirit of a swordsman who values the swordsmanship of emptiness and grand causes.
