Gov’t attempts to aid subcontractors

Companies that hire subcontractors will now be encouraged to share a portion of their profits with them under guidelines proposed yesterday by the Ministry of Employment and Labor.

The move comes as politicians across the spectrum try to promise that they will improve the lives of nonsalaried employees in Korea, considered a big vote bank ahead of next year’s general and presidential elections.

It’s the first time the ministry has proposed guidelines to improve working conditions for temporary or nonsalaried workers. The guideline will not be mandatory, however.

Subcontractors do work for a limited period and are considered contract or temporary workers.

The guidelines focus on four points: stabilizing the employment of subcontracted laborers, improving their working conditions, fostering labor and management cooperation and expanding welfare benefits for subcontractors.

Under the guidelines, contractors should sign with subcontractors a contract that specifies laborers’ wages, working hours and days off. The guidelines urge companies to pay subcontractors more than the country’s minimum wage.

The most controversial point in the guidelines states that principal companies should consider subcontractors’ contribution to projects and share the profits from the project accordingly.

The guidelines also ask companies to give contractors a month warning before the job is ended.

Principal companies should also respect subcontractors’ labor unions and listen to opinions from representatives of subcontractors through regular meetings.

Principal companies are encouraged to stabilize the hiring of subcontracted laborers by either making long-term contracts or by giving guarantees of contract renewal.

In terms of expanding welfare benefits for subcontractors, the guidelines ask principal companies to allow subcontracted laborers to make use of their company’s welfare facilities and offer training programs for subcontractors.

The Ministry of Employment and Labor said it will distribute the guidelines and voluntary checklists to companies. A group of 20 to 30 experts will be employed to help explain the guidelines.

The ministry said it will also open reporting centers in local employment and labor offices so subcontractors can report companies that don’t abide by the guidelines.

Analysts said the guidelines will have limited effectiveness until they have legal force.

“These guidelines are a system that will protect subcontracted laborers, improve their working conditions and strengthen companies’ competitiveness,” said an official from the Ministry of Employment and Labor. “We will actively promote the guidelines.”

현대자동차가 큰 수익을 낼 경우 하청업체 소속으로 현대차 공장에서 일하는 근로자들도 보상받을 수 있는 길이 열렸다. 또 현대차와 하청업체 간 도급계약이 종료되면 하루아침에 실직자가 됐던 하청업체 근로자들이 앞으로는 적어도 한 달 전에 해직 통보를 받고 이직을 준비할 수 있게 된다.

정부는 18일 이 같은 내용의 사내하도급 근로자 보호를 위한 가이드라인을 발표했다. 이채필 고용노동부 장관은 “가이드라인 중 노력사항은 법적인 강제성이 없지만 사회적 합의와 동의를 구해서 만든 만큼 기업들도 잘 지켜나갈 것”이라고 말했다.

　이날 노동부가 발표한 ‘사내하도급 근로자의 근로조건 보호 가이드라인’은 고용안정, 근로조건 개선, 노사협력, 복리후생 등 4개 부문에서 원·하청 업체 사업주가 조치해야 할 내용으로 구성돼 있다. 노동부 조재정 노동정책실장은 “가이드라인은 비정규직 중 유일하게 사회 안전망이 갖춰져 있지 않은 사내하도급 근로자를 보호하기 위한 것”이라고 말했다.

　가이드라인 중 준수사항은 근로기준법 등에 명시돼 있어 법적 강제성이 있지만 노력사항은 법적 강제성이 없다. 조 실장은 “가이드라인 자체로는 법적인 구속력이 없다”며 “하지만 사회보험 가입, 최저임금 지급 같은 법적 의무를 이행하지 않으면 형사 처벌 대상이 된다”고 설명했다.

가이드라인은 먼저 원청업체와 하청업체 사업주가 도급계약을 장기간으로 하거나 갱신을 보장해 사내하도급 근로자들의 고용 안정성을 높일 수 있도록 했다. 또 원청업체 사업주와 근로자가 허용하면 사내하도급 근로자 대표가 원청업체의 노사협의회나 간담회에 참여해 의견을 낼 수 있게 했다. 가이드라인에는 원청업체 사업주는 도급계약을 갱신할 때 수익을 많이 냈으면 사내하도급 근로자에게도 적절히 수익을 나눠주도록 권고하는 내용도 포함돼 있다.

　이번 가이드라인은 대통령 산하의 경제사회발전노사정위원회 소속 공익위원들이 마련한 안을 토대로 노사 의견을 취합해 노동부가 확정한 것이다. 하지만 한국노총은 “법적인 구속력이 없어 안 지켜도 그만” 이라고 반발했다. 반면 한국경영자총협회는 “원청업체에 사내 협력업체 근로자의 고용관계 전반까지 과도한 부담을 지웠다”고 반박했다.

◆사내하도급 근로자=원청업체에서 업무를 도급받은 하청업체가 고용한 근로자로 원청업체 사업장에서 원청업체 근로자와 함께 근무하면서 차별을 받고 고용불안에 시달려 문제가 제기돼 왔다. 전국 300인 이상 사업장에만 33만여 명이 있는 것으로 추정된다.
