Police involvement is not the only answer

Students called him “The Law.” I still vividly remember him after nearly 40 years. It was the purest form of fear to be called to his office, where a beating awaited those who broke the rules. But The Law would not let his students graduate with a negative mark on their transcript. Students who drank rice wine over lunch and others caught smoking in the rest rooms were not transferred to the disciplinary committee. Instead, he took care of them with his cane. For more serious violations leading to suspension he gave harsher punishments. When testosterone-driven boys got into fights with students from other schools, he went to the police station and brought them home. They would surely be beaten, but students surrendered to his authority. Teachers like The Law are disappearing, and the police have taken up the task.

The government is to announce a comprehensive plan for school violence on Feb. 6, and the National Police Agency is to play an important role. The school violence task force, which is currently installed only at the NPA, is to be expanded to 16 metropolitan and provincial governments around the country. Seventeen support centers, including two in Gyeonggi, will open on March 2, and they will share the phone number 117. In January, 616 cases of school violence were filed with the police, an average of 20 a day and a dramatic increase from 0.8 per day last year.

Youth violence is getting more and more serious, and the offenders and victims are getting younger and younger. Thanks to the students’ human rights ordinance, moderate physical discipline has been banned, so many cases cannot be resolved at school. Of course, the police will not conclude every case with criminal punishment. The school violence cases will be divided into those subject to punishment and those for correctional intervention. But is it really necessary to involve the police?

What The Law did to my peers was only possible during an authoritarian regime, and we cannot and should not go back to those days. But before the police are called, there needs to be another authority or a buffering mechanism to replace the role of The Law. The police should be the last prescription for the worst case. Meanwhile, the threshold to the courts has become so low that people file lawsuits or complaints for even the most trivial cases. It is hardly a good place to live when it is so easy to engage the police, the prosecution and the court.

학생들은 그 선생님을 ‘법자(法者)’라고 불렀다. 40년 가까운 세월이 흐른 지금도 별명이 생생하다. 학생주임이셨기 때문이다. 휘하에 지도부 학생들을 거느리고 있었다. 아침마다 교문에 진을 치고 학생들의 교복·머리 상태를 점검했다. 법자가 도사리고 계신 지도부실에 불려가는 것은 공포 그 자체였다. ‘빠따’가 대기하고 있었기 때문이다.
그러나 법자에게는 원칙과 금도가 있었다. 점심시간에 학교 담을 넘어 막걸리를 마시고 들어온 학생, 화장실에서 담배 피우다 걸린 학생들을 징계위에 회부하지 않고 빠따로 해결했다. 유·무기 정학에 해당하는 교칙 위반도 ‘더 많은 빠따’로 처리했다. 생활기록부에 빨간 줄을 그어 내보낼 수 없다는 소신을 갖고 있었다. 테스토스테론이 넘쳐나는 학생들이 다른 학교 아이들과 패싸움 벌이다 경찰서에 잡혀가면 어떻게 해서든 빼내왔다. 대신 매서운 빠따가 기다리고 있었지만 학생들은 기꺼이 승복했다. 요즘도 고교 동창들을 만나면 법자 이야기가 빠지지 않는다.
정부가 6일 학교폭력 종합대책을 발표할 예정이다. 경찰청도 중요한 몫을 맡을 것으로 보인다. 경찰청 여성청소년과 김숙진 경정에게 전화해 살짝 커닝을 했다. 지금 경찰청에만 설치돼 있는 학교폭력 대책팀을 전국 16개 광역시·도로 확대한다고 한다. 땅이 넓은 경기도는 두 곳을 두어 모두 17개 통합지원센터가 3월 2일 개소식을 갖고, 신고 전화번호도 ‘117’로 통일하기로 했다. 경찰에 접수된 학교폭력 신고는 올해 1월에만 616건. 하루 평균 20건이다. 작년엔 하루 평균 0.8건이었으니 엄청나게 늘었다. 전국의 학교에서 법자는 사라지고 경찰이 들어오게 된 것이다.
청소년 폭력은 날로 강도가 세지고 연소화하는 추세다. 인권조례 덕분에 ‘사랑의 매’조차 추방됐으니 더 이상 학교 자체 해결을 기대할 수 없게 됐다. 물론 경찰도 형사 처벌을 능사로 삼지는 않는다. 학교폭력을 처벌대상과 선도대상으로 나눠 처리할 방침이다. 그래도 씁쓸함이 남는다. 학생도 경찰, 선생님도 경찰, 학부모도 경찰을 찾는 세태가 과연 교육적인가 라는 의문이 든다.
권위주의 시대에나 통했던 법자 시절로 돌아갈 수는 없고, 돌아가서도 안 될 것이다. 그렇더라도 경찰을 부르기 전에 법자 역할을 대신할 다른 권위나 완충장치가 있었다면 하는 아쉬움이 크다. 경찰은 최악의 경우 등장하는 마지막 처방이어야 한다는 생각에서다. 경찰서 문턱이 너무 낮으면 결국에는 국민 모두가 손해 보게 되지 않을까. 하긴, 나쁜 의미에서 문턱 낮아진 곳이 어디 경찰뿐인가. 툭하면 고소·고발을 일삼으면서 수 틀리면 조롱까지 해대는 법원도 문턱이 엄청 낮아진 셈이다. 경찰·검찰·법원이 너무 만만하고 친근(?)해진 세상은 결코 살기 좋은 세상이 아니다.
