Lee must step down (KOR)

Lee Mi-sun, a Constitutional Court justice nominee named by President Moon Jae-in, told a confirmation hearing that personal affairs had not influenced her court judgments, claiming that wealth issues were entirely handled by her husband. She explained that her husband, a lawyer, had chosen shares for investment and that she had only given her consent. Placing the blame on one’s spouse is turning out to be fashionable among senior government officials. Kim Eui-kyeom, the former presidential spokesman, blamed his wife entirely for the suspicious purchase of a building in a redevelopment district in Heukseok-dong, southern Seoul. Are their titles worth publicly damning their spouses?

Of the couple’s 4.2 billion won ($3.7 million), 83 percent has been invested in stocks. Of that share, 2.4 billion won has been placed in a company Moon oversaw in court. How she could have been unaware of the stocks is also questionable when her husband bought 1,300 shares in her name and 4,100 in his own. It is no wonder lawmakers questioning her sincerity said she would be better off as a stock investor, not a judge.

Her problem should go beyond the confirmation hearing. The question of insider information behind her 367 suspicious share purchases is an issue that requires investigation. Lee Yoo-jeong, who resigned from his nomination as a Constitutional Court justice last year, was questioned by the prosecution for a stock trade through insider information and later convicted. A person suspected of insider trading cannot sit on the bench of the nation’s highest court. Senior government officials are removed from office in the United States even for employing illegal immigrants for household chores. Regardless of the gravity of the offense, a judiciary office cannot be upheld if the person in it is questioned for morality and behavior that goes against public sentiment.

Lee should come forward and resign from the candidacy. She has raised too many questions to qualify for the office required of the highest morality to make judgment based on the Constitution and legal conscience. She could face a legislative or civilian suit if she moves onto the Constitutional Court. Judiciary integrity could come under challenge if a justice gets embroiled in political debate.
During the confirmation hearing, Lee vowed to build a society in which everyone has basic rights and constitutional order is respected. But her rhetoric does not sound convincing if she cannot fully explain her stocks.

대량 주식 보유 논란 이미선, 헌법재판관 후보자 자격 없다
이미선 헌법재판소 재판관 후보자는 어제 열린 국회 인사청문회에서 “재산문제는 전적으로 남편이 맡아 했고,(내가 담당했던)재판과는 관련이 없다”고 말했다. 매입할 주식의 종목과 수량 선정은 배우자가 했고,자신은 포괄적으로 동의만 했다는 것이 이 후보자의 설명이다. 모든 재산을 투자해 26억원의 흑석동 재개발지역 상가를 구입하고도 “아내가 나와 상의없이 일을 저질렀다”는 김의겸 전 청와대 대변인의 해명이 자꾸 연상된다. 자리 욕심에 자존감마저 상실한 건 아닌지 답답한 뿐이다. 김 전 대변인이 사퇴한 지 불과 10여일 만에 나온 이 후보자의 ‘배우자 탓’에 많은 국민들은 실망감을 감추지 못하고 있다.
42억여원의 재산 중 83%인 35억여원이 주식에 투자됐고,이 중 24억여원이 재판과 관련이 있는 것으로 의심 받고 있는 특정기업에 집중된 대목은 상식적으로 쉽게 납득하기 어렵다. 여기에다 이 후보자 남편이 후보자 명의로 1300여회,자신의 명의로 4100여회 등 모두 5500여회의 주식거래를 한 것을 볼 때 “나는 몰랐다”는 말은 좀체 설득력을 갖지 못한다. “재판은 뒷전이고, 판사는 부업인가” “차라리 워런 버핏처럼 주식 투자를 하며 사는게 낫지 않느냐”라는 야당의원들의 이날 조롱으로 끝날 문제가 아니다.
달리 생각하면 376 회의 주식 거래를 하는 과정에서 법관이나 변호사라는 직책을 통해 알게 된 기업 내부 정보를 이용한 게 아니냐는 의혹은 청문회가 아니라 수사의 대상이다. 지난해 낙마한 이유정 헌법재판관 후보자는 “주식 거래 과정에 불법이 없었다”는 본인의 주장과는 달리 ‘가짜 백수오 파문’이 일기 전 미공개 정보를 이용해 주식거래를 한 것으로 검찰 조사에서 드러나 기소까지 당했다. 내부 정보를 이용한 주식거래 가능성을 의심받는 상황에서 헌법재판관으로서의 직무를 제대로 수행할 수 있을까. 미국에선 불법 이민자를 도우미로 고용했다는 이유로 사법 관련 고위 공직 후보자들이 낙마하고 있다. 불법 행위 여부에 앞서 그 사회의 평균 정서,가치관과 도덕성에 어긋나는 것만으로도 사법 공직의 수행은 어려운 것으로 본다는 의미다.
이 후보자는 이제라도 국민들에게 솔직히 해명하고 스스로 후보자직에서 물러나기를 바란다. 헌법과 법률에 의해 양심에 따라 독립적으로 심판해야 하는 헌법재판관직을 수행하기에는 국민적 의구심이 너무 많기 때문이다. 그가 자리를 고집하면 정치권이나 시민단체가 주식거래를 문제삼아 고발을 할 가능성도 배제할 수 없다. 현직 헌재재판관을 둘러싼 법률적 다툼과 이에 따른 정치적 논쟁이 잇따를 경우 법치주의에 대한 가치관은 더욱 혼탁해질 것이 불을 보듯 뻔하다.
이 후보자는 청문회에서 “소수자,사회적 약자를 비롯해 우리사회 모든 구성원의 기본권을 보장하고 헌법질서가 존중되는 사회를 이뤄나가는데 혼신의 힘을 다하겠다”고 약속했다. 하지만 이 후보자 부부가 주식을 보유하게 된 과정에 대한 명쾌한 해명이나 규명이 없다면 그의 다짐은 한낱 구두선(口頭禪)에 불과할 것이다.
