Unusual appointments have been made for the police leadership. The precedent of appointing the next police chief among superintendent generals first and making other appointments after was broken. Under the Police Officials Act, the police commissioner should be appointed among the superintendent generals, who are just one rank below. On May 24, the Yoon Suk-yeol administration promoted five senior officers to the post of superintendent generals 14 days after the launch of his government. There would be no reason to promote them first if one of them is not going to be the next police chief.

This kind of unconventional promotion happened before, in the prosecution, five years ago. During the Moon Jae-in administration, Yoon Suk-yeol, then a prosecutor at the Daejeon High Prosecutors’ Office, was unexpectedly promoted to head the Seoul Central District Prosecutors’ Office. Anyone could see that Moon wanted to appoint Yoon to the mighty post for political reasons.

Prosecutor Yoon was originally considered the first prosecutor general in the Moon Jae-in administration. But it would have been a burden for the administration to directly appoint a prosecutor as chief prosecutor by skipping all the ranks. But two years later, Yoon was appointed as the second prosecutor general in the Moon administration. It is also the first case in which a senior prosecutor becomes prosecutor general without serving as head of a high prosecutor’s office. Since the revision of the Prosecution Act in 1988 to introduce the tenure system, all prosecutor generals have been appointed among heads of high prosecutors’ offices. Therefore, everyone assumes Yoon would know the implication of the irregular police promotion better than anyone.

The question is which of the five superintendent generals will be appointed as the next police chief. Here, the repertoire of the past administrations — appointments based on school, regional and work backgrounds — will likely be repeated. According to a person familiar with the appointment practice of the presidential office, the candidates who are included in the final pool by the nomination committee have similar qualifications and skills. So, what catches the committee’s attention is their academic, regional and work relationship with the president, as it can give a strong belief that the candidate is on “our side.” Such relationship-based appointments lead to controversy over and over.

Whether the next police commissioner is appointed among those five or not, it is still uncomfortable. If one is really appointed as police chief, the president is trying to tame the police leadership. If not, he is pressuring the police organization. Let’s see whether Yoon’s precedent in the prosecution will be repeated in the police.

경찰 인사에 이변이 일어났다. 치안정감 중에서 차기 경찰청장(치안총감)을 내정한 뒤 후속 인사를 해온 전례가 깨졌다. 경찰청장은 경찰공무원법에 따라 바로 아래 계급인 치안정감에서 임명해야 한다. 윤석열 정부는 지난 24일 치안감 5명을 치안정감으로 승진시키는 인사를 발표했다. 정부 출범 14일 만이다. 5명 중에서 경찰청장을 임명할 게 아니라면 승진 인사부터 할 이유가 없다는 게 내부 관측이다.

검찰에서는 이미 5년 전에 일어났던 이변이다. 윤석열 대통령이 서울 중앙지검장을 거쳐 검찰총장에 지명되기까지 예고된 파격의 연속이었다. 문재인 전 대통령 역시 정부 출범 9일 만에 당시 윤석열 대전고검 검사를 서울중앙지검장에 승진 임명하는 검찰 인사를 발표했다. 고검장급인 서울중앙지검장을 검사장급으로 격하시키면서까지다. 누가 봐도 윤 검사를 서울중앙지검장으로 임명하고 싶어하는 속내가 읽혔다.

윤 검사는 원래 문재인 정부의 초대 검찰총장으로도 검토됐다고 한다. 그러나 기수와 직급을 뛰어넘어 평검사를 바로 검찰총장으로 앉히는 건 문재인 정부에도 부담이었을 것이다. 그래도 2년 뒤 문재인 정부의 두 번째 검찰총장으로 윤 지검장이 지명된다. 역시 고검장을 거치지 않고 검사장급에서 바로 검찰총장이 된 첫 사례다. 1988년 검찰청법을 개정해 총장 임기제가 도입된 이후로는 모두 고검장을 거쳐 검찰총장이 됐다. 윤 대통령이 누구보다 이번 경찰 인사의 의미를 잘 알고 있을 것이라고 추측하는 이유다.

그래서 중요한 건 5명 중에 누구를 경찰청장으로 임명하느냐는 거다. 이제부터는 역대 정부의 뻔한 레퍼토리가 반복될 것으로 보인다. 바로 누구의 학연·지연·근무연이 더 세느냐는 거다. 문재인 정부 청와대에서 근무했던 인사에 따르면 인사추천위원회를 열어 최종 후보군에 오르는 인물들은 객관적인 실력이 엇비슷하다고 한다. 그래서 더 눈에 들어오는 게 인사권자와의 학연·지연·근무연이다. ‘우리 편’이라는 확신을 심어줄 수 있어서다. 어느 정부에서나 코드 인사 논란이 반복됐던 이유다.

5명 중에 차기 경찰청장이 나와도, 나오지 않아도 불편하다. 실제로 임명한다면 길들이기식 인사 같고, 아니라면 압박하는 인사 같아서다. 경찰에서도 윤 대통령의 선례를 따른 파격이 연출될지 주목된다.
