Trainee doctors must return to their hospital (KOR)

The deadline for trainee doctors to return to their hospital is Thursday. Second Vice Minister of Health and Welfare Park Min-soo repeatedly begged doctors — on walkout for the government’s plan to increase the enrollment quota for medical schools by 2,000 from next year — to return to their hospital. The government promised that it will not give them any punishment if they return now.

But if the trainee doctors don’t return, the government plans to revoke their medical licenses for at least three months and take legal actions against them. If the doctors receive a license suspension of more than three months, they will have trouble obtaining a certificate for specialty doctors. The trainee doctors can be disadvantaged if they want to work overseas, not to mention provoking a chain reaction of protest from current medical students. If doctors are in short supply, it will threaten the health of patients.

The Ministry of Health and Welfare on Wednesday visited their homes and directly delivered an administrative order to return to their hospitals. The ministry took the action to maximize the effectiveness of its judicial process. At the same time, the police have launched investigations into five doctors — including the head of the emergency committee of the Korean Medical Association, a doctors’ interest group, and the head of its public relations committee — after the ministry’s accusations. Earlier, Vice Health Minister Park threatened to take punitive actions against all trainee doctors unless they return to their hospital.

Most of their seven demands — including “a complete nullification of the government’s plan for the quota increase” and “a withdrawal of the illicit administrative order” — are certainly detached from public sentiment. Reaffirming the original plan for the quota hike, President Yoon Suk Yeol warned them not to take a collective action by taking hostage our people’s health and life. “Such a threat can never justify their walkout,” the president said.

Given the huge gap between the government and doctor groups over their perception of the medical crisis, both sides must find solutions to resolve the crisis. To do that, trainee doctors must first return to their hospital. Nurses and other medical aides cannot replace doctors. Fortunately, some trainee doctors are returning to their hospital and the government also took a step back, as seen in its willingness to revise the draconian law aimed at holding doctors accountable for medical accidents.

The government must continue to make efforts to have dialogue with doctors to avoid a medical vacuum. The top priority should be protecting patients’ health, above all. We hope trainee doctors return to their hospital today to prevent a medical disaster.

오늘 복귀 시한…전공의는 조속히 환자 곁으로 돌아오길

정부 “미복귀 때 면허정지·사법처리 진행” 공언
응급 상황과 대화 외면하면 요구 관철도 어려워

정부가 의료 현장을 떠난 전공의들에게 통보한 복귀 시한이 오늘로 끝난다. 박민수 보건복지부 제2차관은 “지금도 늦지 않았으니 즉시 환자 곁으로 돌아와 달라”며 29일을 마지노선으로 제시해 왔다. 정부의 의대 2000명 증원 발표에 반발해 사직서를 제출한 인턴과 레지던트들은 오늘 안에 반드시 의료 현장으로 돌아와야 한다. 이달 안에 복귀하면 불이익을 주지 않겠다고 정부는 약속했다.

반면에 미복귀 전공의에 대해선 최소 3개월의 면허정지 처분과 수사·기소 등 사법절차를 진행하겠다는 게 정부의 확고한 방침이다. 3개월 이상의 면허정지 처분을 받으면 전문의 자격증 취득에 지장이 생겨 개인의 불이익뿐 아니라 국가적으로도 전문 의료 인력 확보에 차질이 불가피하다. 해외 취업에서 불이익을 당할 수 있고, 전공의는 물론 의대생들까지 연쇄적으로 혼란에 빠지게 된다. 무엇보다 의료진 수급에 문제가 발생하면서 환자들의 건강이 위협받는 상황에 몰릴 가능성이 크다.

복지부는 어제 전공의 자택을 찾아가 업무개시명령을 직접 전달했다. 우편이나 휴대전화로 통보해 온 기존 방식과 달리 사법 절차를 위해 송달 효력을 분명히 하려는 조치다. 경찰은 복지부가 고발한 대한의사협회 김택우 비상대책위원장과 주수호 언론홍보위원장 등 5명에 대한 수사에도 착수했다. 박 차관은 지난 16일 “10명이 사직 후 업무개시명령을 따르지 않았다면 10명 모두에게 처분이 내려질 것”이라면서 광범위한 제재를 예고한 상태다.

‘2000명 증원 계획 전면 백지화’나 ‘전공의 겁박하는 부당 명령 전면 철회’ 등 전공의들이 요구한 7개 항목엔 국민 정서와 거리가 있는 내용이 다수다. 윤석열 대통령은 지난 26일에도 2000명 증원 입장을 재차 강조하면서 “국민 건강과 생명을 볼모로 집단행동을 벌이고 국민 생명과 안전을 위협하는 것은 어떤 명분으로도 정당화가 어렵다”고 경고했다. 단기간 타협을 이루기엔 정부와 의사 단체의 입장 차가 큰 만큼 일단 도처에서 벌어지는 환자들의 위기 상황을 수습하면서 합의점을 찾아가는 게 옳다. 그러려면 전공의들이 수술실과 병동으로 돌아와야 한다. 비상 투입된 진료지원인력(PA) 간호사가 전공의가 해야 할 처치를 동영상으로 배우면서 의료사고 책임을 걱정할 지경이라니 말문이 막힌다. 일부 전공의는 현장에 복귀하고 있으며 정부에서도 의료사고 처벌을 완화하는 특례법 개정안을 공개하는 등 전공의 요구를 수용할 의향을 밝히고 있다.

정부는 집단행동에 굴복해선 안 된다는 원칙은 지키되 극단적 대립은 결국 환자 피해로 귀결된다는 사실을 염두에 두고 대화 노력을 지속해야 한다. 최우선 전제는 환자의 안전이다. 진료 현장 정상화가 유일한 방법이며 더 이상의 파국을 막는 길이라는 점을 전공의들이 성찰해 주길 바란다.
