온정주의, 이제는 끝내야
“2001년 회식 자리에서 학생들을 성추행한 교수가 고작 정직 3개월 처분을 받고 여전히 학교에서 수업하고 있습니다. 학생들이 학교 측에 문제를 제기했지만 어떤 사과나 반성도, 재발 방지책도 들을 수 없었습니다. 이게 말이 됩니까. ”
13일 오후 서울 광화문광장. ‘미투 운동 지지 및 대학 내 교수 성폭력 문제 해결 촉구’ 기자회견에 참석한 서강대 총학생회 소속 강범석씨가 목소리를 높였다. 이날 행사는 22개 대학 총학생회로 구성된 '전국대학학생회네트워크 준비위원회'가 개최했다.
이 자리에 참석한 학생들이 가장 우려한 문제는 “가해 교수에 대한 온정주의식 처벌과 그것을 용인하는 분위기”였다. 학교 내 온정주의는 어제오늘 일이 아니다. 교육부에 따르면 최근 4년간 국립대에서 성범죄로 징계를 받은 교수 35명 중 24명(68.6%)은 여전히 재직 중이다.
지난해 2월에는 여학생에게 “남자랑 자봤냐”는 등 수차례 성희롱 발언을 한 광주의 한 사립대 교수가 겨울 방학 기간을 포함해 정직 3개월 징계 처분을 받은 사실이 뒤늦게 알려지면서 시민들의 분노를 샀다. ‘솜방망이 처벌’이란 거센 비판을 받았다.

상황이 이렇다 보니 학생들은 학교를 믿질 못한다. 조현각 미시건주립대 교수(사회복지학)가 2016년 서울 소재 6개 대학 학부·대학원생을 대상으로 ‘대학교 성희롱·성폭력 실태조사’를 했다. 이중 '성폭력 피해 때문에 대학 내 프로그램·기관·사람과 접촉한 적이 있는가’라는 질문에 전체 응답 학생 1944명 중 92%가 ‘없다’고 답했다. 도움을 청하지 않은 이유에 대해 학생 42%는 ‘(문제가) 해결될 것이라고 생각하지 않아서’라고 했다.
지난달 서울의 유명 사립대에 출강했던 겸임교수의 성희롱 발언 의혹을 취재하며 만난 학생들도 비슷한 얘기를 했다. 한 피해 여학생은 “지난해 초 가해 교수의 수업을 학생들이 ‘보이콧’했다. 하지만 학과 조교가 ‘왜 듣지 않느냐’고 전화로 묻기만 했지 달라진 건 없었다”며 “지나가다 그 교수를 만나면 핀잔만 들어야 했다”고 털어놨다.
대학만이 아니다. 기업이나 군, 검찰 등 각 분야에서 온정주의 처벌이 이어지고 있다. 이런 인식 때문에 피해자들은 더 깊은 상처를 받고 가해자들은 "내가 한 행동이 별 게 아니다"라는 잘못된 인식에 빠지게 되는 것이다. 미투 운동이 사회 전반으로 퍼지고 있는 지금이야말로 온정주의 처벌의 고리를 단호하게 끊어내야 할 절호의 기회다.
