A mockery of voters (KOR)

In a perplexing development, people under investigation or indicted by the prosecution are running for seats in the National Assembly in the upcoming parliamentary elections. Major figures who were accused of intervening in the 2018 Ulsan mayoral election have been nominated as the ruling Democratic Party’s candidates for the April 15 general elections. Such nominations not only enrage voters but also defy the rule of law. Examples are aplenty, including former Ulsan police chief Hwang Un-ha, running for a legislative seat in Daejeon city; former senior presidential secretary for political affairs Han Byung-do, running in Iksan, North Jeolla; and Lim Dong-ho, a former senior member of the ruling party, running in Ulsan.

They were indicted on charges of interfering in the Ulsan mayoral election to help Song Cheol-ho, a close friend of President Moon Jae-in, win by probing alleged corruption involving his challenger, then-Mayor Kim Gi-hyeon. If proven true, that constitutes a serious abuse of power.

Lim, the candidate in Ulsan, is suspected of having abandoned his bid for the Ulsan mayoral race two years ago in return for a high position offered by the Blue House. Han, the candidate in Iksan and a friend of Lim, is suspected of helping arrange the deal behind the scenes, suggesting the possibility of the presidential office getting involved in a dirty scheme.

The current law does not bar criminal suspects from running in elections because of the presumption of innocence. Given the details of their indictments, however, many people see a methodical intervention in an election by the Blue House. Considering the deepening public concern, these figures should have refrained from bidding for legislative seats. We wonder how they could ask any voters to support them.

Controversy also arose after Choi Kang-wook, a presidential secretary for civil service discipline, resigned Monday, probably to run for a proportional seat in the legislature. He was indicted for allegedly issuing a fake certificate for the son of former Justice Minister Cho Kuk to help him get into universities. Despite his repeated denials, it is simply not right for Choi to run.

We have never seen a rush by ruling party members to run even while they are on trial. Political analysts link it to the Moon administration’s need to put pressure on the prosecution by winning an election victory. But that’s a futile dream. The ruling party must withdraw their nominations before it is too late.

재판받는 여권 인사들의 총선 출마, 유권자 우롱이다
검찰 수사를 받고 있거나 기소된 인사들이 여당 간판을 달고 4·15 총선에 출마하는 기막힌 일이 현실로 벌어지고 있다. 특히 울산시장 선거 개입 의혹으로 기소된 핵심 피고인들이 줄줄이 민주당 경선을 통과했다. 유권자를 우롱하고 법치에 거스르는 공천이라는 비판이 거세다. 황운하(대전 중구) 전 울산 경찰청장과 한병도(전북 익산을) 전 청와대 정무수석, 임동호(울산 중구) 전 민주당 최고위원 등이 대표적이다.
이들은 문재인 대통령의 30년 지기인 송철호 울산시장 당선을 위해 야당 후보인 김기현 전 울산시장에 대한 표적 수사에 개입한 혐의로 불구속 기소됐다. 검찰은 특히 황 후보자가 청와대의 하명을 받아 김기현 후보자의 사무실을 압수수색하는 등 표적 수사를 지휘, 선거 판도에 영향을 미친 것으로 보고 있다. 사실이라면 공권력을 남용한 선거 공작이자 중대 범죄다. 임 후보자는 청와대로부터 고위직 자리를 제안받고 울산시장 출마를 포기했다는 의혹을, 친구 사이인 한 후보자는 이를 조율하는 데 관여한 것으로 검찰은 의심하고 있다. 공천을 대가로 한 추악한 조직적 뒷거래란 의심을 받는 이유다.
물론 현행법상 '피고인'의 총선 출마를 막는 규정은 없다. 법원의 최종 판결 전까진 무죄 추정의 원칙이 적용돼야 하는 것도 틀린 말은 아니다. 하지만 대다수 국민은 청와대가 조직적으로 개입한 선거부정 사건이란 의심을 거두지 않고 있다. 이런 의혹에 연루돼 수사와 재판의 대상이 되고, 국민들에게 엄청난 충격을 안겨준 것만으로도 우선 자숙하는 게 도리다. 법의 심판대에 서 있으면서 유권자에게 표를 달라고 손을 내미는 건 보통사람은 상상도 할 수 없는 몰염치한 행보다.
조국 사건으로 재판에 넘겨진 최강욱 전 청와대 공직기강비서관이 비례대표 사퇴 시한인 16일 사표를 낸 걸 놓고도 뒷말이 무성하다. 최 전 비서관은 변호사 시절 조국 전 법무장관의 아들에게 인턴확인서를 허위 발급해 준 혐의로 기소됐다. 하지만 50일 넘게 비서관 자리를 유지해 오다 갑자기 "날치기 기소"라고 검찰을 비난하며 사표를 냈다. 친여 성향 정당의 비례대표 출마설도 나돈다. 본인은 부인하고 있지만 만에 하나 출마를 염두에 두고 있다면 이 역시 도리와 이치에 맞지 않는 행태다.
재판 중인 여당 인사들의 무더기 총선 출마는 여지껏 헌정사에 없던 일이다. 자칫 검찰 수사를 조롱하고 공권력을 무력화하려는 시도로 비칠 수 있다. 벌써부터 정치권에선 조국 사태와 울산 사건 등을 거치면서 윤석열 검찰총장과 충돌한 여권이 총선 승리를 통해 수사·재판의 새판짜기를 시도할 것이란 관측이 무성하다. 있어서도 안 되고, 이룰 수도 없는 헛된 꿈이다. 재판 중인 후보자들의 공천은 지금이라도 철회해야 마땅하다. 그게 공정과 정의를 앞세워 온 여당이 취해야 할 자세다.
