Comply with the probe sincerely (국문)

While weeping for “committing a sin that deserves death,” Choi Soon-sil, the longtime friend of President Park Geun-hye under arrest for wielding unfettered power over the president and state affairs, is said to have been uncooperative with the prosecution’s investigation. Her lawyer said her plea for forgiveness and her legal accountability are two different things. As a citizen of Korea, Choi, of course, has the right to legal a defense. In a law-abiding country, state investigation and indictment should be strictly based on the evidence and laws.

But someone who has wrecked havoc on the country by freely using the elected power of the president over the last four years must not think she could hide herself behind the right of defense. She must take responsibility for pushing her longtime friend to the brink of resignation or impeachment and ruining the national dignity and economy. She, however, refuses to answer and denies the hard evidence and testimonies against her. Even the investigators are stunned by her audacity.

Despite her pledge to cooperate fully with the investigation, she refused to comply with overnight investigations citing her fragile health and illnesses. She may still be deluding herself that the president can save her. Such lack of reality has made her victim to internet slandering, lambasting at her choices of luxury wardrobe during her first public appearance and the supper she had at the questioning room. She is bringing down the president with her. Her lawyers should look at her case in broader and national context instead of self-interest.

The prosecution should press harder to gain solid evidence and testimonies on the ways Choi amassed wealth and wielded influence. Only its reliable investigation and competency in building up the case could restore order in the outraged society. It must remember that the public uproar will not end until they are convinced.

검찰에 소환되면서 "죽을 죄를 졌다"고 말했던 최순실씨가 정작 조사과정에선 부인과 모르쇠로 일관하고 있다고 한다. 최씨 변호인은 "그가 국민들에게 용서를 구하는 말을 한 것과 법리적 책임은 다른 의미"라고 설명했다. 대한민국 국민인 최씨에게도 엄연히 법률적 방어권을 인정해야 한다는 것이다. 형식상 맞는 말이다. 법치국가에서 수사와 기소는 분명한 증거와 법률에 의해 이뤄져야 한다.
하지만 지난 4년간 박근혜 대통령의 위세를 등에 업고 호가호위를 하며 나라를 결딴냈던 것을 조금이라도 생각한다면 방어권 보장만 내세워선 곤란하다. 자신으로 인해 박 대통령에 대한 국민들의 하야 요구가 잇따르고 국가 경제가 파탄난 것에 대한 처절한 반성과 책임을 지려는 자세가 선행돼야 할 것이다. 그런데도 최씨는 불법행위를 입증할 수 있는 각종 증거와 관련자들의 진술에 대해서도 변명과 회피,부인으로 빠져나가고 있다는 것이다. "도대체 얼마나 낯이 두꺼우면 이럴 수 있을까"라는 장탄식이 수사관계자들 입에서조차 나오고 있다.
그는 소환 첫날 "성실히 검찰 조사에 임하겠다"는 다짐과는 달리 밤샘조사를 거부하고,심장병과 공황장애 등을 칭병(稱病)하며 교묘하게 수사를 지연시켰다는 것이다. 아직도 박 대통령을 통해 영향력을 행사할 수 있다는 헛된 믿음을 갖고 있는 것일까. 이러니 인터넷 등에는 그가 신었던 명품 양발과 신발,심지어 저녁 메뉴였던 곰탕까지 의미 부여를 하며 박 대통령과 최씨를 싸잡아 비난하는 의견이 나오고 있는 것 아닌가. 최씨 변호인단은 개인적 이익에만 함몰될 것이 아니라 대승적 견지에서 사건을 바라보는 방안을 검토해줬으면 한다.
검찰도 거짓과 술수로 엄청난 재산을 모은 최씨와 그 주변 인물들이 꼼짝할 수 없을 정도의 증거와 진술을 확보하는데 수사력을 집중해야 할 것이다. 검찰 청사에 포크레인이 난입하고,오물이 뿌려지는 불법 행동을 동정하는 여론이 일어서야 되겠는가. 지금 이 시간에도 대학과 시민사회 단체 등에선 시국성명이 잇따르고 있다는 점을 명심해야 한다.
