Navigating a trip after sudden travel bans: As countries bar Koreans from entering, travelers are looking for ways to get refunds

Many people started to check into the matter after seeing groups of people being forced to return to Korea over the past week. On Feb. 22, the Israeli government returned about 130 Korean nationals on a Korean Air flight and asked the Korean travelers and residents already in the country to leave. Two days after, Jordan decided to do the same, which resulted in a number of people looking for tickets to fly back to Korea immediately.
Parts of Africa also followed suit. Island country Mauritius asked those who arrived from Korea to quarantine themselves for 14 days before traveling around its soil or be forced to leave immediately. Many of those who returned from Mauritius were newlyweds on their honeymoons, while many who went to Israel and Jordan were on religious trips. A 12-day package program to travel to both countries costs about 3 million won ($2,500).
The common answer from industry experts is that it would be difficult to be reimbursed for trips that people did not go on, as a cancelation due to coronavirus is something that a travel agency cannot fix.
“It doesn’t seem like a travel agency has to take on [financial] responsibility,” said a lawyer of law office Anda.
The lawyer said the situation is something that cannot be controlled or resisted by the power of any agency. There are also no terms stated for such a situation at many insurance companies, which means travelers with travel insurance cannot get their financial damage covered. Travel industry experts say the 17 couples denied entry into Mauritius also wouldn’t be able to get any compensation from the insurance company.
If your travels were cut mid-trip, you can get some of the costs refunded according to the terms listed in the contract. Yet, one manager from Duru Tour said it is difficult to project when the agency can get partial refunds from a hotel or a local agency, and how much would be refunded.
Even when a consumer cancels a trip before the departure date, it may be difficult to get 100 percent back, since the travel agency has already made payments to local hotels and airlines. Korean travel agencies say that they can give customers whatever they get from those entities.
The biggest fear at the moment is that you don’t know whether you can enter the country you are traveling to after your landing as the situation changes quickly. In the past week, many Korean nationals were restricted or forced to leave even when the Korean government had no idea that the country had placed a ban on accepting travelers from Korea. If more cases of sudden restrictions are placed on travelers, they may be able to ask the Korean government to compensate them, according to the lawyer at Anda, since the travelers did not decide to travel to a region not recommended by the government. However, the key is that the traveler has to prove the government’s fault.
If airlines cancel their own flights, there is no need to worry about asking for the money back as the fare will automatically be refunded.
If you booked hotels through online travel agencies like Expedia.com or Agoda, you may have to contact the hotels even after you call the online agency’s customer service. Then you will have to write an email or call to inquire about a refund. If you explain your situation, you will be surprised to learn that quite a number of hotels are open to hear you out and offer a full refund.

한국인이라는 이유로 비행기에서 내리지도 못하고 추방당한 이스라엘 사례는 충격적이다. 신종 코로나바이러스 감염증(코로나19) 확산 차단이 이유겠지만, 한국인 탑승객들은 아무 사전 정보 없이 일방적으로 쫓겨났다. ‘코리아 포비아(한국 기피증)’가 확산하면서 이스라엘 같은 ‘사상 초유의 사태’가 속출할 수 있다는 우려가 나온다. 여행금지국가를 방문한 것도, 천재지변이 생긴 것도 아닌데, 여행자들은 억울하고 분하기만 하다. 보상은 받을 수 있는 걸까.
22일 이스라엘 정부는 대한항공 KE957편을 타고 텔아비브 벤구리온공항에 도착한 한국인 130여 명을 그대로 한국으로 돌려보냈다. 곧이어 한국 여행객과 교민도 철수를 권고했다. 24일 이웃 나라 요르단도 같은 조처를 했다. 두 나라를 여행 중이던 한국인은 부랴부랴 대체 항공편으로 귀국길에 올랐다.
이스라엘과 요르단은 한국인 성지순례객의 필수 코스다. 지난해 이스라엘을 여행한 한국인 약 6만4000명 중 4만 명이 성지순례객이었다. 한국의 성지순례 전문여행사 50여 곳 대부분이 이스라엘과 요르단을 묶은 패키지상품을 운용한다. 이스라엘~요르단 12일 상품이 보통 300만원이다.
보상과 관련, 법무법인 ‘안다’의 조용주 대표변호사는 “여행사 책임은 없어 보인다”고 말했다. 여행사 잘못으로 여행을 망친 것이 아니어서다. 조 변호사는 “일종의 불가항력의 상황”으로 판단했다. 이 경우 채무자(여행사)의 귀책사유는 없다고 보는 게 일반적이라고 한다.
보험도 해당 요건이 없다. 모리셔스에 격리됐던 신혼부부 17쌍도 “보험을 통한 보상은 불가능할 것”이라는 게 여행업계의 공통된 의견이다(‘드림아일랜드’ 김정완 이사, ‘모두투어’ 원형진 차장). 평생의 여행을 망친 신혼부부에겐 억울하고 분한 일이지만, 어쩔 수 없다는 것이다.
여행 경비 일부는 돌려받을 수 있다. 여행을 중간에 중단한 경우 여행사는 약관에 따라 남은 여정의 경비를 돌려줘야 한다. 다만 여행사가 해당 호텔이나 현지 여행사로부터 환불받아야 하는데, 언제 얼마나 받을 수 있을지 장담할 수 없다(성지순례 전문여행사 ‘두루투어’의 배근홍 매니저).
대금을 지불하고 예약했지만, 출발 전 소비자가 그 여행상품을 취소할 경우에도 100% 환불 보장이 어렵다. 여행사가 이미 현지 호텔과 항공사에 대금을 줬기 때문이다. 돌려받아야 돌려줄 수 있다는 게 여행사 입장이다.
25일 이스라엘 정부가 내준 전세기로 돌아온 221명은 항공 요금을 걱정할 필요가 없다. 하지만 여행사가 원래 예약한 항공편이 아니라 다른 항공편으로 급히 돌아오는 경우는 다르다. 보통 여행사가 먼저 티켓을 산 뒤 여행자에게 청구한다. 여행자가 돌려받아야 할 남은 여정의 경비를 귀국 항공 요금에서 제하기도 한다.
귀국 항공 요금을 떠안은 여행사도 있다. 지난 24일 이스라엘에서 고객 32명을 급히 귀국시킨 ‘다비드 투어’의 이윤 대표는 “성지순례는 여느 패키지여행과 달리 단골 교회 고객이 많다”며 “손해를 감수하고 항공권을 제공했다”고 말했다.
현재 코리아 포비아의 가장 큰 문제는 한국 정부는 모르는 채 현지에 도착한 한국인이 격리되거나 추방당하고 있다는 점이다. 나중에 사태를 파악하고 해당 국가에 “엄중 경고”하는 게 외교부의 주요 조치다. 조용주 변호사에 따르면 이런 사태가 여러 나라로 확산한다면 한국 정부에도 책임을 물을 수 있다. 여행자 입장에선 불법행위, 즉 여행금지국가를 방문한 것이 아니어서다. 그러나 여행자가 한국 정부의 과실을 입증해야 한다.
태국·베트남·필리핀 등 항공편도 속속 줄고 있다. 항공편 감소는 코리아 포비아와 다른 사례다. 항공사가 텅 빈 비행기를 띄우며 손해를 보느니 쉬는 게 낫다고 판단한 결과다. 항공사 스스로 항공편을 취소했으니 항공요금은 당연히 전액 환불된다. 운항 중단을 발표한 항공사는 해당 날짜에 예약한 승객에게 전액 환불해주겠다고 밝혔다.
호텔 예약의 경우, 국내 여행사를 통해 예약했으면 여행사에 요청하면 된다. 아고다·익스피디아 같은 온라인 여행사(OTA)에서 예약한 경우가 문제다. 이들 OTA는 싼 가격을 제공하면서 ‘환불 불가’ 조건을 건다. OTA 콜센터에 환불을 요청하면 호텔과 상의하라고 떠넘긴다. 호텔에 e메일을 보내거나 전화를 하는 수밖에 없는데, 잘 설득하면 전액 환불해주는 호텔이 의외로 많다.
한국인 입국을 제한한 나라 중엔 키리바시·사모아 같은 남태평양의 작은 섬나라도 있다. 한국과 무슨 관계가 있을까 싶지만, 키리바시와 사모아는 한국 참치 원양어선의 전진기지다. 동원·사조 같은 기업과 관계가 긴밀하고, 한국인 선원도 자주 드나든다. 사모아의 경우 지난해 홍역에 4000명 이상이 감염돼 60명 가까이 사망했다. 태평양 관광기구 박재아 한국 대표는 “작은 섬나라는 면역력이 없어 감염병에 극도로 예민하다”고 사정을 알렸다.
카자흐스탄도 한국인 입국자를 대상으로 24일간 의학적 관찰을 한다고 발표했다. 처음 14일간 매일 의료인의 문진을 받고, 이후 열흘은 전화 등 원격 점검을 받아야 한다. 카자흐스탄 스키여행상품을 운용하는 ‘헬로스키’ 관계자는 “알려진 바와 달리 한국발 항공편은 기내에서 1회 체온 측정, 설문지 작성 및 체온 재측정 정도의 절차만 거치고 있다”고 전했다.
