Ewha college embroiled in land dispute with gov’t

Some land parcels at Ewha Womans University’s Seoul campus have not been registered and are being used by the university without official ownership, according to the Seodaemun District Office. A lawsuit is pending over the matter.

The lands without ownership are in three regions of the campus - at the Ewha Campus Complex, the Science Building and the artistic front door, designed by acclaimed architect Dominique Perrault. The total size of the three regions is 1,216 square meters (one-third acre) and they are worth more than 10 billion won ($9.2 million) at current market value.

According to the office, the Japanese government surveyed Korea’s land from the 1910s to 1920s during the colonial period and did not register the area because it was classified as a “stream” or “road.” After the Korean War, the government did not record the lands on the nation’s property accounts.

The office believes the area would have been a road or stream in the early 1910s.

In 1973, when the university was trying to expand its campus, it purchased a large amount of land including the three regions without ownership. Whether the university knew at the time about the absence of ownership has not been determined.

In November 2009, when the Seodaemun District Office began digitizing paper property records, they found that some university land had gone unregistered for nearly a century.

Under Korean law, land without ownership belongs to the state. The office demanded that the university pay 400 million won in fines for using national property without a contract with the government.

The university paid the fines but filed a lawsuit against the government with the Seoul Western District Court, laying claim to the land, saying it has occupied the land for at least 20 years and has squatter’s rights.

이화여대의 상징인 정문 통행로, 세계적인 건축가 도미니크 페로가 디자인한 이화캠퍼스복합단지(ECC) 등이 지난 100여 년간 토지대장에 등록되지 않은 채 주소 없이 존재해 왔다는 사실이 새롭게 밝혀졌다.

　논란이 되고 있는 땅은 현재 이화여대 정문과 ECC, 종합과학관이 있는 곳. 이들 세 부지의 총 면적은 1216㎡(370평). 공시지가가 26억원으로 주변 시세를 감안하면 100억원 이상으로 추산되는 알짜배기 땅이다. 서대문구청은 2009년 11월 이화여대가 있는 대현동 일대 도면과 지적도를 한국토지정보시스템(KLIS)에 입력하는 전산작업을 하다 이들 부지가 지적도에 없다는 사실을 발견했다. 일제 강점기인 1910~20년 토지조사 때 누락된 뒤 70~80년대 토지 재등록에서도 빠졌던 것이다. 구청 측은 현장답사와 측량을 마친 뒤 ‘대현동 11-8, 9, 10번지’로 주소를 정하고 전산작업을 마쳤다.

　국가는 “소유자가 없는 땅은 국가 소유”라는 국유재산법을 근거로 올해 1월 이화여대에 무단 사용에 따른 변상금 4억원을 부과했다. 이화여대는 지난 1월 변상금을 일단 납부한 뒤 서울서부지법에 “소유권을 학교법인 이화학당으로 옮겨 달라”는 소송을 냈다.

　이화여대 측은 “1930년대에 학교 부지를 매입할 때 일괄적으로 사들인 땅”이라며 “80년 이상 사용한 만큼 부동산 취득 시효(20년 이상 점유하면 소유권을 얻는 것)가 완성됐다”고 주장한다.

이에 국가를 대리한 서대문구청 측은 “하천이나 도로 등 행정재산은 취득시효 적용 대상이 아니다”고 맞서고 있다.
