Six months later, strike at Hanjin finally ends

Hanjin Heavy Industry & Construction, which has suffered worker unrest for 190 days over large-scale layoffs, finally negotiated a settlement with its labor union.

According to Hanjin, a shipyard based in Busan, members of its union finished their six-month strike and will return to the work place.

The union said in a press release yesterday that the management agreed to continue to bargain on layoffs of workers.

Meanwhile, the Busan District Court ordered a compulsory eviction from a company facility of about 70 union members who did not agree with the union’s decision.

The union said it had agreed on four main issues: dismissing all the accusations and petitions related to the strike, minimizing claims for compensation for damages caused during the strike, severance for laid-off workers, and that the union is responsible for removing Kim Jin-sook, a labor activist from the Korean Confederation of Trade Unions, who has been staging a sit-in protest on a crane inside the factory.

Chae Gil-yong, the union head, said that the union will stop the strike and go back to work in order to prevent further economic losses that have reached 16 billion won ($14.7 million) since last December. The union also demanded that the company should stop asking for police involvement in the strike.

Hanjin welcomed the union’s decision. The company said it will consider rehiring 170 laid-off workers and will minimize the company’s claims for damages from the labor union.

The settlement was finally made when both the union and management realized the cost of the labor action was becoming too great for both sides.

The union faced pressure when the Busan District Court ordered hawkish union members to be evicted from the company facility.

The strike had evolved into a political issue. Politicians, celebrities and members of civic groups have visited the strike to support the workers.

Management claims that the company sustained total losses of 16 billion won due to the strike.

Last year, the company laid off about 400 shipyard workers after it suffered a net loss of 51.7 billion won.

대규모 정리해고 문제로 190일 동안 총파업과 직장폐쇄 등으로 갈등을 빚어온 한진중공업 노사가 27일 협상을 타결했다.

이재용 한진중 조선부문 대표이사와 채길용 금속노조 부산양산지부 한진중 지회장은 이날 낮 12시50분쯤 부산 영도구 봉래동 영도조선소 내 식당에서 ‘노사협의이행합의서’에 서명했다.

노사 양측은 ▶정리해고자 중 희망자에 한해 희망퇴직 적용 ▶노사 간 형사 고소·고발·진정 모두 취소 ▶징계 등 인사조치는 조합원에 한해 면제 노력 ▶노조에 대한 민사상 손해배상 청구(가압류 포함) 최소화 ▶크레인 농성 중인 김진숙 민주노총 지도위원 퇴거는 노조가 책임진다 등에 합의했다.

극적 타결에는 노사가 압박을 받은 게 배경이 됐다. 경찰이 12일 열렸던 ‘희망버스 문화제’ 참가자 92명에 대해 출석요구 등 사법처리 절차에 들어간 것이 노조에는 부담으로 작용했다. 또 사측이 정리해고 대상자(170명), 파업 주동자, 무단출입자를 대상으로 거액의 손배소를 낸 것도 부담이었다. 공권력 투입설도 영향을 미쳤다.

반면 사측은 총파업과 직장폐쇄로 최악의 경영상태를 맞았다. 3년째 수주 물량도 없고 선박 4척의 인도가 지연되면서 100억원의 지체보상금도 물어야 할 형편이었다. 사측은 그동안 500억원의 피해를 본 것으로 추산했다. 무엇보다 ‘크레인 농성’과 ‘희망버스’로 사태가 전국 이슈화되면서 29일 조남호 회장이 국회 환노위 청문회에 서게 된 것도 압박이었다.

협상은 타결됐지만 불씨는 남아 있다. 강성 노조원 100여 명이 “정리해고 철회 없는 협상 결과를 받아들일 수 없다”며 반발하고 있기 때문이다. 이들은 타결 직후 생활관과 김진숙(50·여) 민주노총 부산지역본부 지도위원이 ‘고공 농성’ 중인 85호 타워크레인 밑에서 사수투쟁을 벌였다.

이들은 이날 오후 2시부터 부산지법의 ‘강제퇴거집행’에 따라 300여 명의 용역인력에 의해 대부분 회사 밖으로 쫓겨났다. 김 지도위원은 안전상의 이유로 집행 대상에서 제외됐다.
