Embattled Seoul school boss says he won’t quit

Resisting pressure to resign in the aftermath of a bribery scandal, Kwak No-hyun, the superintendent of the Seoul Metropolitan Office of Education, officially announced yesterday that he won’t leave his office and will continue to work as the chief of the city’s schools.

At a monthly meeting with officials of the Seoul Education Office, Kwak said, “I have already told the complete truth. I will continue to perform my duty as superintendent with a heavy sense of responsibility and sincerity.

“I know how much I hurt people’s feelings,” Kwak added. “Whatever the outcome is, I apologize to you for causing concerns about me.”

The education head hasn’t changed his position, insisting that he paid a former rival in the 2010 superintendent race 200 million won ($188,394) to help him with heavy debts. But the former rival, Park Myong-gee, has told prosecutors that Kwak agreed to pay the money in exchange for him bowing out of the race. Park is now in the custody of prosecutors.

The 57-year-old superintendent hadn’t directly commented on whether he would resign until yesterday.

A resignation by Kwak - and the timing of a resignation - has political and financial repercussions.

Although an education superintendent can’t belong to any political party, Kwak was supported by the opposition Democratic Party in the 2010 election, and his policies, such as free school lunches for all students, are DP policies too. If Kwak steps down before October, a by-election to fill his position will take place on Oct. 26, along with a by-election for the Seoul mayorship. The DP is worried about that scenario.

On a personal basis, Kwak has to weigh the financial implications of resigning now or later, especially if there’s a possibility he will be indicted for bribery or misuse of office.

According to the Public Official Election Act, if he steps down after he is convicted of a crime, he would be forced to return 3.52 billion won in 2010 campaign expenses reimbursed by the National Election Commission. (In the Korean system, the commission reimburses all campaign expenses for candidates who score 15 percent of the vote or more.) However, if Kwak resigns before he is indicted for a crime, he is not liable to pay back more than 30 million won. According to the National Tax Agency, Kwak’s reported assets are about 1.5 billion won.

“The Korean public expects higher standards of integrity from liberal politicians than they do from conservatives,” said Shin Yul, a political science professor at Myongji University, in a telephone interview yesterday. “In that sense, the longer Kwak drags this matter out, the worse the impact on the opposition parties. They would want to wrap up this matter as soon as possible ahead of the upcoming by-election in October.”

The ruling Grand National Party yesterday issued a statement criticizing Kwak’s decision to stay in his post.

곽노현 서울시교육감이 1일 사퇴 거부 의사를 직접 밝혔다. 그러자 촛불시위를 주도하고 지난해는 곽 교육감 공동선거본부장을 맡았던 박석운씨 등 진보진영 인사들도 기자회견을 자청해 곽 교육감의 결백을 주장했다. 민주당 일각에선 노무현 전 대통령의 자살 사건과 연관 지으며 사퇴 불가론을 내놨다. 10·26 서울시장 보궐선거와 내년 총선·대선을 앞두고 진보진영 일부가 ‘곽 교육감 구하기’ 동원령을 내린 모양새다.

곽 교육감은 이날 교육청 직원 250여 명이 참석한 월례조회에서 “막중한 책임감과 신중함을 갖고 교육감 직을 수행하겠다”고 말했다.

곽 교육감 측은 도덕성 비난 여론이 바뀌고 있다고 주장했다. 익명을 요구한 측근은 “(곽 교육감이) 노 전 대통령과 오버랩되면서 여의도 분위기도 바뀌고 있다. 거대한 물결이 이는 중”이라고 말했다. 전병헌 민주당 의원은 “노 전 대통령과 한명숙 전 총리 사건에서도 봤지만 파렴치범으로 매도했던 부분이 법정에서 무죄나 가벼운 범죄로 인정되는 경우가 있었다”며 곽 교육감의 사퇴 불가를 주장했다. 　

한나라당과 보수단체들은 진보진영이 서울시장 등 대형 선거를 ‘보혁(保革) 대결’로 몰아가려는 의도라고 비판한다. 곽 교육감이 낙마하면 ‘깨끗한 진보, 부패한 보수’라는 프레임이 깨져 정략적으로 그의 사퇴를 원치 않는다는 것이다. 서울시교육청 홈페이지에는 정치성 글이 급증하고 있다. “노 전 대통령을 자살로 내몰더니, 곽 교육감도 부엉이 바위로 가기를 바라는 것이냐”는 내용까지 실렸다. 숨을 죽이던 진보진영이 목소리를 내는 형국이다.

김상곤 경기도 교육감도 “법학자로서, 양심적인 교육자로서 곽 교육감을 신뢰하고 존경해 왔다. 곽 교육감이 어떤 결정을 내려도 그 판단을 존중하겠다”고 말했다.

곽 교육감의 버티기는 2억원의 대가성을 검찰이 입증하기 어려울 것이라는 판단과 진보교육 중도 포기 불가라는 내부 의견이 영향을 미친 것으로 보인다. 조신 시교육청 공보관은 “월례조회 발언도 무죄를 확신하고 교육정책을 계속 추진하겠다는 의지를 담은 것”이라고 말했다. 이날 곽 교육감 무죄를 주장한 선거캠프 핵심 관계자는 3명이다. 2008년 광우병국민대책위 집행위원장을 맡아 촛불시위를 주도한 박석운 공동선거대책본부장, 학생운동권 출신인 조승현 상임집행위원장(방송대 교수), 당시 협상대리인 김성오씨다. 이들은 “지난해 5월 18일 박명기 후보가 10억원을 요구했고, 박 후보 측 김모씨가 각서나 차용증을 써달라고 했으나 곽 교육감은 그냥 가버렸다”며 “추가 협상에서 박 후보가 7억원을 요구했으나 곽 교육감 측이 들어주지 않아 협상이 결렬됐다”고 주장했다. 박 본부장은 지난달 29일 곽 교육감을 만나 대책을 숙의했다.

김종일 뉴라이트전국연합 대표는 “돈을 줬고 돈을 받았다는 사실은 부정하지 못하면서 과정만 교묘하게 바꿔가며 본질을 흐리고 있다”며 “불리하면 말을 바꾸는 게 전형적인 진보진영의 수법”이라고 비판했다.

공정택 전 교육감이 기소 후 9개월간 집무한 것처럼 곽 교육감도 내년까지 집무하면서 무상급식 확대와 체벌 전면금지 등 기존 정책을 밀어붙일 가능성이 있다. 진보진영에서는 “선거비용 보전액 35억원을 물어내게 되면 돈을 모아주겠다. 확정 판결까지 가는 과정에서 내년에 정권이 바뀌면 상황이 달라질 수 있다”는 얘기도 나온다.

민주당에서는 사실상 곽 교육감의 사퇴를 요구한 손학규 대표가 곤혹스러워졌다. 당 관계자는 “사퇴하지 않으면 선거전략을 다시 짜야 할 것”이라고 말했다. 신율 명지대 교수는 “곽 교육감이 자리를 지키고 있으면 야권이 중도의 지지를 이끌어내기 어려울 것”이라고 말했다.

◆선거비용 보전액=공직 선거에서 후보자가 일정 비율 이상을 득표하면 선거비용을 보전해 주는 것. 곽노현 교육감은 지난해 선거 후 중앙선거관리위원회에서 약 35억2000만원을 보전받았다.
