Blue House holds the key

The prosecution is afflicted with a critical leadership vacuum since the abrupt resignation of Prosecutor-General Chae Dong-wook after a controversy about his private life last month. After an internal schism over the prosecution’s investigation into the National Intelligence Service’s online smear campaign during last year’s presidential election, worries are growing about a potential paralysis of the prosecution. It is time to hurry the appointment of a new prosecution chief by considering what qualifications are demanded in the post and what kinds of efforts should be made to establish political independence for the prosecution.

The Ministry of Justice is scheduled to hold a meeting today to pick three candidates from the 12 individuals recommended by an internal screening committee. After the minister recommends one candidate to President Park Geun-hye, she will make a final decision, and the candidate will then go for confirmation at the National Assembly. The recommendation committee is supposed to check each candidate’s leadership ability, morality and reputation.

The appointment of a top prosecutor carries great importance this time given the alarming leadership crisis that led to the resignation of Han Sang-dae as prosecutor-general last November. Han’s successor, Chae, also had to resign over allegations that he had an out-of-wedlock son. He only held office for six months. In the legislature’s annual audit of the prosecution on Monday, the head of a special investigation team looking into the spy agency’s illegal political activities wrangled with his superior after he was dismissed from his job on grounds that he had not reported his arrests of NIS agents to the boss in advance.

To overcome the crisis, someone with strong leadership skills is needed. The new prosecutor-general must also have strong convictions about political neutrality and internal reform. The unceasing crises primarily result from the prosecution’s reluctance to reform itself. The new top prosecutor must protect his staff from any external pressures and cut back on their excessive prosecutorial powers, too.

Most important is President Park’s determination. As long as the shadow of political power is thrown over the prosecution and endless suspicions ensue, it can hardly be considered to be politically independent. The Blue House must be determined to not put pressure on its investigations and respect its conclusions even if they are unsatisfactory. Only then can the government achieve prosecution reform. We hope the appointment of a new prosecutor-general is a stepping stone.

채동욱 전 검찰총장 사퇴 이후 검찰을 이끌 리더십이 공백 상태다. 특히 국가정보원 사건 수사를 둘러싼 갈등이 표면화하면서 검찰 기능이 사실상 마비될 수 있다는 우려까지 나오고 있다. 이제 새 총장 임명을 서둘러야 한다는 점에는 이의가 있을 수 없다. 다만 새 총장이 갖춰야 할 조건과 함께 검찰이 바로 서기 위해 어떤 노력이 필요한지에 관해 고민이 필요한 때다.
법무부 검찰총장 후보추천위원회는 오늘 회의를 열고 총장 후보 인선을 논의할 예정이다. 추천위가 천거된 전·현직 검찰 간부 등 12명 가운데 3명 가량을 추려내 법무부장관에게 추천하면 장관이 이중 1명을 정해 대통령에게 제청하게 된다. 추천위는 검찰 조직을 안정시킬 수 있는 지휘 능력과 도덕성, 내·외부 신망 등을 기준으로 후보들을 검증할 것으로 예상된다. 추천위원들의 의견이 갈릴 경우에는 회의를 1, 2차례 더 열 가능성도 있다고 한다.
새 총장 인선이 주목되는 건 사태의 위중함 때문이다. 지난해 11월 한상대 전 총장 사퇴로 이어진 검란(檢亂) 이후 검찰은 리더십 위기가 계속돼왔다. 지난 4월 취임한 채동욱 전 총장이 국정원 댓글 사건 기소, 전두환 전 대통령 추징금 환수 등 성과를 거뒀으나 ‘혼외 아들’ 의혹이 돌출하면서 6개월 만에 물러났다. 이번엔 상부 보고 없이 국정원 직원들을 체포해 수사팀장에서 배제된 검사와 서울중앙지검장이 국정감사장에서 충돌하는 일까지 벌어졌다. 그 결과 수사가 정치적 공방의 늪 속에 빠져들고 있다.
현재의 상황을 타개하려면 조직을 안정시킬 수 있는 역량을 갖춘 인사가 검찰의 키를 잡아야 한다. 나아가 새 총장은 정치적 중립과 검찰 개혁에 대한 확고한 의지를 가진 인물이어야 한다. 검찰의 위기가 끊임없이 반복되는 이유는 검찰 조직이 과거의 구태에서 벗어나지 못한 데 있다. 정치적 고려에 수사가 왜곡되지 않도록 하고, 비대한 검찰권을 재조정하며, 시민 통제를 강화해야 한다. 새 총장이 이런 의지를 분명하게 천명하고 관철시키지 못한다면 검찰은 계속해서 정치적 논란과 검찰권 오·남용 시비에 부딪힐 수밖에 없다.
하지만 무엇보다 중요한 것은 권력의 의지다. 정치권력의 그림자가 검찰 주변을 어른거리고 수사 과정과 결과를 둘러싼 구구한 억측과 뒷말이 나오는 한 검찰이 정치적 중립을 확보하기는 어렵다. 중요한 정부 조직인 검찰을 되살리기 위해서는 수사에 입김을 넣지 않겠다는 청와대의 결연한 각오가 필요하다. 마음에 들지 않는 인사가 총장이 되고, 수사 결론이 내키지 않더라도 존중하고 인내할 수 있어야 한다. 그러할 때 진정한 검찰 개혁을 이룬 정부로 평가받을 수 있다. 여야 정치권도 변화 노력에 힘을 모을 때다.
검찰 조직의 일신이 검사들만의 힘으로는 불가능하다는 사실은 명확해졌다. 정부와 정치권의 자세도 달라져야 한다. 이번 총장 인선이 그 첫 단추를 끼우는 출발점이 되길 기대해본다.
