‘Zero-tolerance’ for breach of trust

The case of Carl Zwerner is a hot topic among rich Americans. Zwerner failed to report his Swiss bank account to the U.S. Treasury Department and now must pay $2.24 million in civil penalties. The total is an accumulation of unpaid penalties between 2004 and 2006, amounting to 50 percent of the value of the account each year. Zwerner is being fined 1.5 times the amount he had in the account. While many have been penalized for failing to file taxes properly, Zwerner’s case has led to the heaviest penalty given the size of his account. What’s more surprising is that he is being charged with failure to report the account. After the foreign account became an issue, Zwerner paid the related taxes, but it did not affect the court’s decision. Some argue that the penalty is too heavy for his charges. But the IRS and the U.S. Department of Justice are firm on their stance.

The FBARs, known as the Report of Foreign Bank and Financial Accounts, is a tax regulation that requires all American taxpayers to report their foreign accounts holding more than $10,000 to the Department of Treasury. After the global financial crisis, the United States began a war against tax dodgers. Though it actively pursued tax-evading wealthy Americans, the IRS did not catch many offenders. Since 2009, only about 70 taxpayers have been found guilty. But the policy proved effective: 43,000 foreign account holders voluntarily reported their failures to file FBARs and paid $6 billion in back taxes and penalties.

The message of Zwerner’s case is that once you are caught, there’s no escape. The IRS operations are not obvious in daily lives. Average taxpayers don’t get to meet IRS officials in person because they file their taxes and pay dues every year. It is quite different from Korea, where the executive reshuffle of the National Tax Service becomes news for big companies and changes at low-level tax offices become important information. But mentioning the IRS makes Americans nervous. While the tax officials usually don’t bother taxpayers, once you are caught for failure to file taxes faithfully, they will track you for years until they find you. Many tax dodgers end up losing all they have due to heavy penalties.

Zwerner’s case not only illustrates the mechanism of American tax administration but also reminds us how a society built on trust works. The government respects citizens and minimizes intervention. But once the confidence is broken and the system is abused, authorities apply a “zero-tolerance” policy to the offenders. The price for undermining the system of trust is severe. In Korea, the government uses slogans to build a trusting society. We know that trust is the prerequisite for an advanced country. But slogans don’t build trust. It is about time we create an appropriate system of trust.

요즘 미국 부자들 사이에선 플로리다의 칼 즈워너 케이스가 화제다. 즈워너는 스위스 은행에 맡겨둔 예금을 미국 국세청(IRS)에 ‘신고’하지 않았다가 무려 224만 달러(약 23억원)의 벌금을 맞았다. 2004년부터 2006년까지 매년 예금액의 50%를 벌금으로 맞은 것인데, 합하면 즈워너가 갖고 있던 예금의 1.5배다. 탈세가 적발돼 수백억원을 벌금으로 낸 사례도 여럿 있지만, 벌금 비율로만 따지면 역대 최고다. 즈워너의 죄명은 ‘신고 누락’이다. 해외 비밀 계좌가 문제된 뒤 즈워너는 관련 세금을 모두 납부했지만 정상 참작을 받지 못했다. 지은 죄에 비해 처벌이 너무 가혹하지 않느냐는 논란이 있지만, IRS와 미국 법무부는 요지부동이다.
 즈워너가 걸린 해외금융계좌신고(FBAR)는 1만 달러 이상의 해외 금융계좌에 대해 재무부에 신고하게 한 제도다. 글로벌 금융 위기로 세수가 줄어들자 미국은 탈세와의 전쟁에 나섰다. 부유층의 역외 탈세도 표적 중 하나였다. 그런데 IRS가 실제로 잡은 숫자는 많지 않다. 2009년 이후 FBAR 미신고로 유죄 판결을 받은 납세자는 겨우 70여 명이다. 그런데도 효과는 만점이었다. 4만3000여 명이 FBAR을 누락했다고 자진신고 했고, 벌금과 세금을 합쳐 60억 달러(약 6조원)를 냈다. 더 큰 소득은 해외 탈세 메커니즘을 밝혀낸 것이다. 자수한 납세자들은 어떤 해외 은행이 어떻게 탈세를 도와줬는지를 털어놨다. 최근 크레디트 스위스 은행이 미국 납세자의 탈세를 도왔다는 이유로 26억 달러의 벌금을 맞고도 꼼짝 못한 것은 이런 과정이 있었기 때문이다.
 즈워너 사례가 던지는 메시지는 속된 말로 ‘걸리면 국물도 없다’다. FBAR뿐만이 아니다. IRS는 일상에서 좀처럼 보이지 않는다. 납세자들은 IRS 직원들을 개인적으로 알 필요가 없다. 신고하고 세금 내면 그뿐이다. 국세청 간부의 보직변경이 대기업의 주요 뉴스가 되고, 관할 세무서 실무자 교체가 소상공인들의 일급 정보가 되는 한국과는 사뭇 다르다. 그런데도 미국인들은 IRS 이름만 나오면 긴장한다. 평소에는 세무조사다 뭐다 해서 성가시게 굴지 않지만, 한 번 찍으면 몇 년이 걸리든 집요하게 물고 늘어져 끝장을 보기 때문이다. 세금 떼먹었다가 아예 전 재산을 날리는 경우도 적지 않다.


 미국 조세행정의 단면을 보여주는 즈워너 케이스는 신뢰 기반 사회가 어떻게 작동하는지를 생각하게 한다. 정부는 시민들의 양심을 존중하고 간섭을 최소화한다. 시민들은 신뢰라는 울타리 안에서 자유를 만끽한다. 그러나 그 신뢰를 깨뜨리고 악용하는 이들에겐 ‘무관용’ 원칙이 철저하게 적용된다. 신뢰 시스템을 훼손한 것이 드러났을 때 치러야 하는 대가는 통념을 뛰어넘는다. 신뢰 훼손 동기를 무력화시키겠다는 접근이다. 한국 사회엔 신뢰 사회를 만들자는 정치 슬로건이 많다. 누구나 신뢰가 선진국의 필수 요건이라는 것을 안다. 그러나 신뢰 사회는 슬로건만으로 이뤄지지 않는다. 그에 합당한 신뢰 시스템을 짤 때가 됐다.
