Keeping the local legal market

Local law firms are tense ahead of the liberalization of the local legal market starting in July next year./ 국내 로펌들은 내년 7월부터 국내 법률시장 자유화를 앞두고 긴장하고 있다/ European law firms can open businesses in Korea jointly with their Korean counterparts from 2016, and ones from the United States can enter in 2017./ 유럽연합 로펌이 2016년에, 미국 로펌이 2017년에 한국에서 합작 법인을 설립할 수 있게 된 것이다/ Under joint-ventures, foreign lawyers are free to handle local cases./ 합작 법인이 설립되면 외국 변호사들도 국내 사건을 수임할 수 있다/ About 26 foreign firms are already in Korea to prepare to open businesses./ 약 26개의 외국 로펌들이 이미 한국의 법률시장 개방을 준비하고 있다/
According to the national statistics office, the local legal market was estimated at 3.6 trillion won ($3 billion) as of 2013./ 통계청에 따르면 국내 법률시장은 2013년 기준으로 3조 6천억 원 규모라 한다/ Baker & McKenzie, ranked as the largest in the United States, alone reports annual revenue of 2.8 trillion won./ 미국 최대 로펌회사인 베이커 앤드 매킨지 한 기업만의 연간 매출액이 2조 8천억 원이다/ To foreign companies, the local market is neither big nor attractive./ 외국 기업에게는 국내 시장이 그다지 크다거나 매력적이지는 않다/ But they can also easily dominate the market./ 하지만 외국 기업들은 또한 쉽게 국내 시장을 잠식할 수도 있다/
An oversupply of lawyers has led to reduced fees and poor service in the local market./ 국내 법률 시장은 변호사 숫자가 포화상태에 이르면서 덤핑 수임에 따른 부실 변론을 초래하고 있다/ Licensed lawyers total over 20,000, up sharply from 800 in 1994./ 1994년 800명에 불과했던 변호사 수가 2만 명으로 급격히 증가했다/ The surge in the population has led to fee competition./ 이러한 변호사 수의 급증은 수임료 경쟁을 초래했다/ About 3,400 have shut down business, recording the all-time high closure rate of 17.1 percent./ 약 3,400명의 변호사가 휴업을 했는데 이는 17. 1퍼센트로 사상 최고로 높은 휴업률이다/ Lawyers’ monthly caseloads have been reduced to an average of 1.9 last year, compared with 2.8 cases in 2011./ 월간 변호사 사건 수임건수도 2011년에 2.8건에서 지난해에는 평균 1.9건으로 줄어들었다/ Service charges by a lawyer running his or her own business have been reduced to 1 million won from 5 million won./ 개인 사무실을 운영하는 변호사의 경우 수임료가 500만원에서 100만원으로 줄어들었다/
Smaller law firms are also managed poorly./ 소규모 로펌들 또한 경영난을 겪고 있다/ About 60 have shut down over the last two years./ 지난 2년 동안 60개의 로펌이 문을 닫았다/ About 30 closed last year and another 30 as of August this year./ 지난 해 30개의 로펌이 문을 닫았고 올 해 8월말까지 30개의 로펌이 문을 닫았다/ The firms employing less than 10 lawyers had to close their businesses because they could not sustain annual expenses of 400 million won to 500 million won./ 이러한 10명 미만의 변호사를 고용하고 있는 로펌들은 연간 4억에서 5억 정도 드는 사무실 유지비용을 감당할 수가 없어서 폐업한 것이다/ The mergers and acquisitions market has already been taken over by foreign companies./ 인수합병 시장도 이미 외국 로펌에 의해 잠식되고 있다/ Of the 20 companies that consulted on local merger and acquisition deals as of September this year, 14 were foreign ones./ 올해 9월까지 이뤄진 인수합병을 자문한 20개 회사 중에 14개가 외국 로펌이었다/ More than half of the 945 deals estimated at $85.8 billion went to foreign companies./ 945건에 858억 달러로 추정되는 금액의 절반 이상이 외국 로펌의 몫이었던 셈이다/
Local law practitioners can no longer rely on nationalistic favor./ 국내 법률 전문가들도 더 이상은 애국심에 의존해서는 안 된다/ At the current rate, the entire legal market could fall to foreign firms./ 현재 추세대로면, 전체 법률시장을 외국 로펌에 내주게 될 것이다/ Local law firms must seek out ways to improve service./ 국내 로펌들도 서비스를 향상시킬 수 있는 방법을 모색해야 한다/ They must set their fees more fairly and transparently to earn trust from local consumers./ 또한 국내 소비자로부터 신뢰를 얻을 수 있도록 공정하고 투명하게 수임료를 정해야 할 것이다/ They must break the old revolving-door tradition and try to compete through better legal practice and service./ 그리고 국내 로펌들은 낡은 전관예우의 관행을 깨고 더 나는 법률 관행과 서비스를 통해 경쟁을 해야 한다/ Law schools also must train aspiring lawyers to be more competitive amid the changes of the time and environment./ 로스쿨도 시대와 환경변화를 감안하여 더 경쟁력을 갖춘 더 훌륭한 변호사를 양성해야 할 것이다/
