Prosecutors must investigate (국문)

The excesses of Choi Soon-sil, a so-called friend of President Park Geun-hye, have become a major political and social hot potato. But it’s uncertain how much the prosecution can dig into the allegations, which is why we need an independent and politically neutral team to address the matter.

The Seoul Central District Prosecutors’ Office has reinforced the special force investigating Choi and the foundations she set up. Prosecutor General Kim Soo-nam ordered thorough investigations. The founding heads of the two questionable fund-raising organizations, Mi-R Foundation and K-Sports Foundation, as well as executives from the chaebol-lobby group Federation of Korean Industries have been summoned.

Prosecutors are questioning how the fund from conglomerates was raised and are tracing where the money ended up. They are also examining the computer files after the JTBC report showed that Choi received drafts of presidential speeches and edited them.

But from the developments so far, we suspect whether the prosecution is genuinely serious about the investigation. It sat on the charges and only embarked upon the probe after getting the president’s formal cue. It has summoned relevant people, but didn’t make any raid to seize evidence until Tuesday. Meanwhile, the files would have been destroyed and key figures have fled abroad. Upon the president’s comments about irregularities over the use of the donations, the investigation could end up charging the foundations for embezzlement instead of questioning their identities and the purpose of the fund-raising.

The scandal has snowballed after it was revealed Choi had access to many confidential presidential documents. She and others would have violated the confidentiality laws and code on presidential files and documents on state affairs. Regardless of the president’s public apology, why and how the documents were shared with Choi should be investigated, and those found to be responsible must be punished according to the law. But it is doubtful the prosecution, which gets its orders from the presidential office, will really come up with credible findings.

The prosecution probe could end up aggravating a political dispute. There had been special probes on family members and aides of presidents before. The people involved were either cleared of the charges or sent for trials. The scandals involving Choi should be investigated through a special probe. Members of the ruling party are also calling for a special or parliamentary investigation. The legislature should endorse a bill to create a special investigating body. The president and her aides should cooperate in order to minimize the confusion and damage.

박근혜 대통령의 측근으로 알려진 최순실씨 국정농단 의혹이 국가적 문제로 확대되고 있다. 그런데 최씨 의혹 수사에 착수한 검찰이 진상을 제대로 파헤칠 수 있을지 의구심은 걷히지 않고 있다. 국민들로선 답답하고, 절망스러운 일이다. 결국 독립적이고 중립적인 특검 수사를 통해 사실관계를 밝혀낼 수밖에 없는 상황이다.
서울중앙지검은 그제 미르·K스포츠 재단과 최씨 의혹 수사팀에 특수부 등 검사 3명을 추가해 모두 검사 7명으로 수사팀을 보강했다. 김수남 검찰총장은 “수사팀을 확대해 진상을 철저하게 규명하라”고 지시했다. 검찰은 정동구 K스포츠재단 초대 이사장과 김형수 미르재단 초대 이사장 등 재단 관계자들에 이어 어제는 재단 설립에 관여한 전경련 임원을 소환 조사했다. 검찰은 이들을 상대로 설립·모금 경위를 조사하는 한편 재단 자금의 흐름을 추적하고 있다. 최씨가 대통령 연설문을 사전에 전달받았다는 JTBC 보도와 관련해선 최씨 것으로 추정되는 태블릿 PC를 넘겨받아 분석 중이다.
그러나 지금까지의 수사 상황을 보면 검찰의 진상 규명 의지를 확인하기 힘든 게 사실이다. 지난 달 29일 최씨 의혹에 대한 고발이 접수된 뒤 미적거리만 하다가 지난 20일 박 대통령이 엄정한 수사를 지시한 후에야 본격 조사에 들어갔다. 관련자들을 잇달아 소환 조사하고 있지만 신속한 증거 확보를 위해 필수적인 압수수색엔 나서지 않고 있다. 그러는 사이 재단 및 최씨 관련 자료들이 폐기되고 있고, 최씨와 차은택 CF 감독 등 핵심 인물들은 해외로 빠져나갔다. “자금유용 등 불법행위”를 거론한 대통령 언급에 따라 검찰 수사가 모금 성격과 재단의 정체보다 재단 내 횡령에 국한될 것이란 우려가 제기되고 있다.
더욱이 대통령 연설문 등 청와대 내부 문건들이 최씨에게 사전에 유출된 것으로 드러나면서 최씨 의혹은 국정농단 문제로 커졌다. 대통령기록물관리법 위반이나 공무상 비밀누설 혐의로 처벌할 수 있는 사안이다. 대통령 사과와 관계없이 문건들이 어떤 과정을 거쳐 전달됐는지, 책임자가 누구인지 밝혀야 한다. 청와대로부터 자유롭지 못함을 거듭해서 보여줘온 검찰로선 어떤 수사 결과를 내놓든 신뢰를 얻기 어렵지 않겠는가. 검찰 수사가 논란을 종식시키지 못한 채 또 다시 정쟁으로 이어질 가능성이 크다.
그간 대통령 가족이나 측근들에 대한 특검 수사가 적지 않았다. 김대중 정부 때는 이용호 게이트 특검(2001년)이, 노무현 정부 때는 대통령 측근 비리 의혹 특검(2003년)이 있었다. 이명박 정부에선 내곡동 사저부지 매입 의혹 특검(2012년) 수사가 진행됐다. 그 수사 결과에 따라 관련자들이 무혐의 처분을 받거나 재판에 넘겨졌다. 이번 최씨 의혹을 둘러싼 논란도 특검을 통해서만 규명되고, 정리될 수 있다.
여권 내부에서도 “특검과 국정조사를 통해 철저한 진상규명을 해야 한다”는 목소리가 커지고 있다. 여야는 ‘최순실 특검법’을 처리해 진상이 신속하고 정확하게 밝혀질 수 있도록 해야 할 것이다. 대통령과 청와대도 검찰 수사에 미루지 말고 특검 수사에 적극 협조해야 한다. 그것이 국정 혼란을 최소화함으로써 경제 위기와 안보 불안에 대응할 수 있는 길이다.
