The truth shall set you free (국문)

President Park Geun-hye has delayed the investigation schedule to next week after waging a war of tension with state prosecutors who had wished to question the president by Friday before they indict her controversial friend, Choi Soon-sil, on multiple charges, including state-meddling. Although delayed, the first-ever criminal investigation of an active president remains intact. What is important now is how sincere the president will be during the investigation into abuses of power and influence in state affairs by unauthorized figures.

Park’s lawyer, Yoo Yeong-ha, has said that the president will be ready for an investigation next week. He emphasized that the president was fully willing to cooperate with the probe. His explanation comes as the Park camp is suspected of trying to buy time to build a stronger defense.

The president stands at the heart of various allegations surrounding Choi. She is suspected to have been behind the leak of classified state materials, the creation of two nonprofit organizations, the Mi-R and K Sports foundations, and their fund-raising activities. She is also suspected of possibly bullying conglomerate heads and interfering in institutional appointments through her economic senior secretary. Donations are suspected to have been made while an imprisoned chaebol owner was hoping to get a special pardon from the president. The president must answer to all these allegations.

It will all come down to the will of the president, who will come under the test of history and the Constitution. She has an obligation to tell the truth to the people before she calculates her well-being. She must be specific as to what she has and has not done. She must not think she can wiggle out by apologizing for having befriended the wrong kind of people or because she had innocent intentions.

Choi and her senior secretary for policy coordination, An Chong-bum, will be indicted and referred to court on charges of abusing power and leaking classified information. How the prosecution mentions the role of the president in its arraignment could indicate the direction of its investigation concerning the president.

The prosecution must be bold enough to mention the suspected role of Park in its petition to the court, keeping in mind that people are closely watching its every move.

The legislature passed the law to form a separate team of independent counselors to investigate the matter. The president cannot hide the truth, as she faces judgment from state and independent prosecutors, as well as the people. Telling the truth will be her only salvation.

대통령 변호인 "내주엔 조사 이뤄질 것"
최순실씨 기소 전 조사 무산된 건 유감
"선의로 한 일" 논리로 피해갈 수 없어

박근혜 대통령 측이 검찰과 줄다리기를 거듭한 끝에 내주 조사를 받겠다는 의향을 밝혔다. 최순실씨를 기소하기 전에 박 대통령을 대면조사하려던 검찰의 계획에 차질이 빚어졌지만 헌정사상 초유의 현직 대통령 조사가 가시화한 것이다. 이제 박 대통령이 국정농단·헌정문란 의혹에 대해 진실을 밝힐지 주목되는 상황이다.
박 대통령 변호인인 유영하 변호사는 어제 “내주에는 대통령에 대한 조사가 이루어질 수 있도록 협조하겠다”는 입장을 언론에 전했다. 유 변호사는 또 “사건의 진상을 밝히기 위한 검찰 수사에 적극 협조하겠다는 대통령의 입장에 변함이 없다”고 강조했다. 박 대통령 측이 ‘내주 조사’ 의향을 밝힌 건 “언제까지 '변론 준비가 필요하다'는 방어막 뒤에 버티고 있을 것이냐”는 비판 여론이 거세진 데 따른 것으로 보인다. 그간 대통령이 검찰 조사를 회피하는 듯한 모습을 보인 것은 유감이다. 내주에는 반드시 검찰 조사를 받아야 할 것이다.
현재 박 대통령은 검찰의 설명대로 “최순실씨와 관련된 각종 의혹의 중심”에 있다. 우선 연설문 등 청와대 문건 유출과 미르·K스포츠 재단에 설립·모금을 지시했다는 등의 의혹을 받고 있다. 또 경제 수석 등을 통해 기업인 퇴진을 압박하고 포스코 등 공기업 인사에 개입한 정황이 드러났다. 재벌 회장 사면 논의가 있은 뒤 재단 출연금이 오갔다는 의혹까지 불거진 상태다. 이처럼 지난 4년간 이어진 국정농단-헌정문란의 전모를 밝히려면 대통령 자신이 검찰 조사에 적극적으로 임하지 않으면 안 된다.
무엇보다 중요한 것은 진실을 있는 그대로 말하겠다는 박 대통령의 각오다. 대통령은 역사와 헌법 앞에 서 있다. 박 대통령 자신의 진술이 최씨 등의 형사처벌과 국정 수행, 퇴임 이후 신변에 어떤 영향을 미칠지를 따지기보다 진실을 밝히는 게 국민에 대한 도리이자 의무다. 대통령은 검찰 조사에서 자신이 한 일과 하지 않는 일을 구체적으로 설명해야 한다. “주변인을 제대로 관리하지 못해” 생긴 일이라거나 “선의로 추진한 일”(지난 15일 유 변호사 언급)이란 논리로 피해갈 수 있는 상황이 아니다.
검찰은 조만간 최씨와 안종범 전 청와대 정책조정수석 등을 직권남용, 공무상 비밀누설 등 혐의로 기소할 계획이다. 주목되는 것은 검찰이 최씨 등의 공소장에 박 대통령 관련 내용을 어떻게 기재하느냐다. 현재까지 압수한 증거물과 관련자들의 진술로도 청와대 문건 유출과 재단 설립·모금 등에 박 대통령이 얼마나 연루돼 있는지가 판가름될 수 있을 것이다. 검찰은 ‘박 대통령과 공모하여’ 등의 표현을 넣을지를 놓고 고심 중이라고 한다. 국민 모두가 지켜보고 있는 만큼 일체의 정치적인 고려 없이 오직 사실과 법리에 따라 판단해야 할 것이다.
어제 ‘국정농단 의혹 규명 특검법’이 국회 본회의를 통과함에 따라 특검 수사가 곧 개시된다. 박 대통령도, 검찰도 특검 수사가 기다리고 있다는 사실을 잊지 말아야 한다. 자칫 진실을 은폐하거나 축소할 경우 국민적 저항에 직면할 수밖에 없다. 대통령이 사실을 숨김없이 밝히는 것만이 “이게 나라냐”는 시민들의 물음에 답하는 길이다.
