A matter of greed, or lazy politics? (KOR)

“If duty-free shops close two Sundays a month, will foreigners or those who take overseas trips visit traditional markets?” said an industry insider about Democratic Party (DP) lawmaker Lee Dong-ju’s proposal that contains the strongest regulations among the nine revisions on the Distribution Industry Development Act submitted to the National Assembly.

DP Chairman Lee Nak-yon chose Mangwon Market in western Seoul as the first site visit after his election earlier this month to help the revision on the Distribution Act pass the legislature promptly. Rep. Lee Dong-ju accompanied him on the visit.

I thought the bill was revised based on a certain legal effect. But to my surprise, a source from Lee’s office said that the symbolic meaning should be acknowledged. The source said it would be good for workers at duty-free shops, department stores and shopping malls to take a day off altogether. He emphasized that the overworking issue in the distribution industry and the right to rest were important. He did not answer my question about what actual benefits the revision would bring to small businesses or consumers.

If the labor rights of the distribution industry employees is the real concern, the revision is wrong from the start. It should not be pursued by revising the Distribution Act. The purpose of the law is stipulated in Article One. “The purpose of this Act is to ensure the efficient promotion and balanced development of the distribution industry and establish sound trade practices in commercial transactions, thereby protecting consumers and contributing to the development of the national economy.” Lately, duty-free shop employees are taking leave because of the Covid-19 pandemic. Large offline stores are mostly struggling. The crisis was not caused by overworking but by a lack of work.

Why do politicians ignore the reality? A clue can be found from the proposer’s blog. He compares large supermarkets to a greedy man. He wrote that the wife of the greedy man owns a department store, the first child a convenient store, the second child a home shopping channel, the third child a duty-free shop, the fourth child a shopping mall and the fifth child an online shopping mall.

But rather than greedy actors, the crisis of small businesses is actually caused by a complex combination of soaring leases, labor costs, Covid-19 and the overall economic slump.

If you want to solve a problem politically, you should endure the boring process of analyzing the problem’s causes. Framing issues as a confrontation between good and evil is lazy politics, not searching for effective solutions.

“면세점이 한 달에 두 번 일요일 쉬면 외국인이나 해외 나가는 사람이 전통시장으로 갈까요.”

21대 국회에서 발의된 9건의 유통산업발전법 개정안 중 가장 강한 규제를 담은 더불어민주당 이동주 의원(비례대표) 안에 대한 업계 관계자의 반응이다. 이 안의 핵심은 거의 모든 대형 오프라인 점포와 함께 시내 면세점까지 월 2회 의무적으로 쉬라는 것이다. 한 면세업계 관계자는 “설마 받아들여질까 싶겠지만 요즘 여당 분위기에 어영부영 통과될 수 있다고 본다”고 말했다. 이낙연 더불어민주당 대표가 당선 뒤 첫 현장으로 택한 서울 마포 망원시장에서 “유통산업발전법을 서둘러 처리하겠다”고 한 것을 보면 괜한 걱정은 아닌 것 같다. 이날 현장 방문에는 이동주 의원도 동행했다.

그래도 어떤 법적 실효성이 있다고 판단했으니 나온 안일 것이라 생각해 그 진심이 궁금했다. 당혹스럽게도 이 의원실 관계자는 “상징적인 의미를 봐 달라”고 말했다. “면세점이나 백화점, 복합쇼핑몰 근로자 모두가 쉴 때 함께 쉬는 게 좋다”고도 했다. 그는 유통 산업의 과 노동 문제, 공동 휴식권 보장이 중요하다고 강조했다. 법 목적에 대한 이해 정도는 실망스러웠다. 소상공인이나 소비자에게 어떤 실익이 있는지 답하지 못했다. 대형 복합쇼핑몰 입주 상인 피해에 대해서도 말을 흐렸다.

유통산업 종사자의 노동권이 진심으로 걱정된다면 이 개정안은 번지수부터 틀렸다. 이는 유산법을 바꿔 도모할 일이 아니다. 유산법의 목적은 제1조에 분명히 나와 있다. ‘유통산업의 효율적인 진흥과 균형 있는 발전을 꾀하고, 건전한 상거래 질서를 세움으로써 소비자를 보호하고 국민경제의 발전에 이바지’를 하기 위한 법이다. 더군다나 면세점 직원은 요즘 돌아가며 휴직하고 있다. 대형 오프라인 점포는 대부분 고전 중이다. 과(過)노동이 문제가 아니라 일감이 없어 위기다.

정치인은 왜 이런 현실은 무시할까. 이동주 의원 블로그엔 이에 대한 단서가 있다. 그는 대형마트를 놀부에 비유한다. 그러면서 “놀부 부인은 백화점을 하고, 첫째는 편의점, 둘째는 홈쇼핑, 셋째는 면세점, 넷째는 복합쇼핑몰, 다섯째는 온라인몰을 한다”고 적었다. 소상공인의 고난은 모두 욕심쟁이 대기업 탓이다. 하지만 소상공인의 위기는 치솟는 임대료와 인건비, 신종 코로나바이러스 감염증, 경기 침체 등이 복합적으로 작용한 결과다. 놀부를 없애도 해결되지 않는다.

정치로 문제를 해결하려면 꿰뚫어 분석하고 이해관계를 조율하는 지루한 과정을 견뎌야 한다. 이게 어려우니 손쉽게 선과 악의 대립구도를 만들어 선동에 나선다. 실질적 해법을 위해 영혼을 담지 않는 게으른 정치의 특징이다.
