Time has come to keep first spouses in check (KOR)

The prosecution on Wednesday decided not to indict the first lady on bribery charges even though she received a luxury handbag from a mysterious pastor after her husband was elected president in 2022. The prosecution based its decision on the absence of any clause on punishing a presidential spouse’s acceptance of expensive gifts from others — except for an article on broadly banning a spouse’s receipt of them. Despite such loopholes, political circles have been mostly indifferent to the issue.
Regardless of mounting suspicions on the first lady’s intervention in the ruling party’s nominations of candidates before the April 11 parliamentary elections, it is difficult to punish her because she is not a government official. In the past, most of the presidents’ spouses didn’t cross the line thanks to the internal checking system in the presidential office. As a result, there was little need to clearly define the first lady’s duties.
However, following former first lady Kim Jung-sook’s solo visit to India in 2018, the current first lady seems to have crossed a red line, as implied by her alleged involvement in the election process. That explains why the splinter opposition wants to specify the first lady’s obligations. We cannot afford any more confusion from our first ladies.
The United States made the First Ladies’ public role clear in Article 105 of the Federal Law. All official activities by them are conducted within the boundaries of the article. Nancy Reagan and Michelle Obama also followed the guideline when their husbands were incumbent presidents. France is no exception. In 2017, the country made a declaration to ensure transparent activities of spouses of its heads of state. The declaration confined their public role to visiting foreign countries with the presidents, communicating with the public and hosting events at the Élysée Palace.
The Reform Party plans to define our first lady’s public role by law, secure transparency in the budget needed for the role, and strengthen their legal responsibility. First ladies should must not wield power just because they are the president’s spouse. The National Assembly has no reason to refuse the party’s proposal.
'대통령 배우자법' 제정론이 나오는 이유 성찰해야
그동안은 상식과 관행, 내부 통제로 선 안 넘었지만
각종 스캔들과 국민 반감에 "법에 의한 통제" 제기
개혁신당이 어제 대통령 배우자의 법적 지위를 법률로 규정하는 '대통령 배우자법' 제정을 제안했다. 야당의 정략적 공세라고 볼 수도 있겠지만 지금 정국이 한 발짝도 앞으로 나아가지 못하고 있는 최대 이유가 김건희 여사를 둘러싼 여러 의혹 때문임은 부인하기 힘든 사실이다. 그러니 이제는 법으로라도 배우자의 행보를 보장할 건 보장하고, 제한할 건 제한하자는 취지일 게다. 어쩌다 이 지경이 됐는지 안타깝지만, 한편으론 진지하게 법 제정을 고민해 보자는 의견도 존재한다.
검찰은 어제 김 여사의 명품백 수수 사건과 관련, 무혐의 처분 결론을 내렸다. 청탁금지법(김영란법)상 공직자의 배우자는 금품수수 금지 규정(제8조 4항)만 있고, 정작 처벌이나 제재 규정은 없기 때문이다. 오히려 배우자가 금품을 받은 사실을 알고도 신고하지 않은 공직자만 처벌할 수 있다. 현행 법률에 이 같은 구멍이 있음을 알면서도, 어찌 된 이유에선지 정치권은 이를 고치려 하지 않는다.
김 여사 공천 개입 의혹도 줄기차게 거론되지만, 엄밀하게 보면 '사인' 신분이라 법적으로는 처벌하기 힘든 게 사실이다. 역대 대통령의 배우자라고 왜 그런 문제가 없었을까. 하지만 그동안은 상식과 관행, 그리고 대통령과 대통령실의 내부 통제 시스템에 의해 배우자의 활동이나 임무, 권한이 일정 선을 넘지 않았다. 당연히 그걸 명문화한 규정도 없었다. '대통령 등의 경호에 관한 법률'에서 경호 대상으로 배우자를 언급한 게 전부였다.
하지만 문재인 대통령 부인 김정숙 여사의 2018년 인도 단독 방문도 그렇거니와 최근 김건희 여사의 각종 국정개입 논란을 보면 일정 선을 넘어선 느낌이다. 개혁신당이 제안한 배우자법 제정에 관심이 쏠리는 까닭이다. 배우자들이 입방아에 오르내리고 그 문제로 나라 전체가 흔들리는 일이 더는 있어선 안 되기 때문이다.
미국은 연방법 제3편 105조에서 배우자의 공적 역할을 지원하는 법적 근거를 명확히 규정했다. 모든 공적 활동이 이 법적 테두리 안에서 이뤄진다. 레이건 전 대통령 부인 낸시 여사가 벌인 마약퇴치 운동, 오바마 전 대통령 부인 미셸 여사가 추진한 학교 급식 개선 운동도 이 조항에 따랐다. 프랑스도 2017년 '국가원수 배우자의 지위에 관한 투명성 헌장'을 발표, 배우자의 역할을 ^국제회의 동행 ^국민과의 소통 ^엘리제궁 행사 감독 등으로 정했다.
개혁신당은 향후 법 제정에서 배우자의 공적 역할을 정의하고, 투입 예산의 투명성 확보, 법적 책임 강화를 꼼꼼히 담겠다고 했다. 대통령의 배우자라는 이유만으로 공적 권한, 권력을 마구 행사하면 안 된다는 국민적 정서의 발로다. 대통령의 배우자 문제로 더 이상 국민들 인상을 찌푸리게 하는 일이 사라진다면 그리 못할 이유도 없겠다.
