Fixing tax loopholes (KOR)

Tax levies must be accurate to every cent. The saying, “Nothing is certain but death and taxes,” is based on the grounds that taxes are just and transparent. Drivers dutifully pay their fines for speeding, because they know that it is their responsibility to do so. Such civilian duty to law and order stems from confidence in public administration. Taxation must be most fair.  
 
The news of flaws in state appraisals on homes last year therefore come as a shock. Taxpayers are outraged to learn about inaccurateness in taxation. The Board of Audit and Inspection (BAI) discovered that land prices were higher than the combined value of property and land in 228,475 homes across the country last year. How can land prices be higher than total home value?
 
The BAI inspection was triggered after a civilian group petitioned in February last year for an investigation on state appraisal as the registered value was often below the market prices. The BAI found a number of problems in the appraisal system. Even the divisions calculating home prices and land prices were different. Their guidelines to determine land and house prices also did not match due to different numbers of their samples. Moreover, the final appraisal did not reflect the purpose of the land use in evaluation, even as it is a determinant factor in appraising property value.  
 
The findings did not include apartments and multi-residential units, which means that appraisal errors could be even greater. State appraisal prices become the base for property taxes, insurance premiums and other social taxes. The valuation has often been questioned. Over 37,000 people have filed complaints against multi-residential home appraisal prices announced by the government in March.  
 
People put their lifelong savings into a home. How many can willingly comply with higher taxes if appraisals are made recklessly? Complaints about home value appraisals surged tenfold last year from a year ago, suggesting brewing public disgruntlement. If consistency and security is not ensured, tax resistance will increase.  
 
The government must do its best to restore confidence in taxation. The BAI pointed out that over 430,000 land lots have not been properly appraised. The government must fix the loopholes in appraisal and taxation.

실 투성이 공시가격이 무너뜨린 조세 신뢰 바로잡아야
 
세금은 단돈 1원도 정확해야 한다. 호환·마마보다 무서운 게 세금이라는 이유는 뭔가. 투명하고 정당하게 매기기 때문에 피할 수 없다는 뜻이다. 과속 위반으로 과태료가 나와도 대다수 시민은 군말 없이 납부한다. 공동체의 질서를 존중하기 때문이다. 이런 시민의식은 행정이 공정하다는 신뢰에서 나온다. 그 신뢰가 가장 두터워야 할 분야가 조세다.  
 
이런 점에서 지난해 개별주택 공시가격이 부실하게 산정됐다는 소식은 큰 충격을 주고 있다. 한 치의 오차도 없다고 믿었던 세금이 터무니없는 방식으로 계산된 사실이 드러났기 때문이다. 그제 나온 ‘부동산 가격 공시제도 운용 실태’ 감사원 보고서를 통해서다. 이에 따르면 땅값·집값을 합한 개별주택 공시가격보다 땅값만 산정한 가격이 더 높은 경우가 전국 22만8475가구에 달했다. 어떻게 땅값만 계산한 가격이 땅값과 집값을 합한 가격보다 더 비쌀 수 있는가.  
 
아무도 모르고 넘어갈 뻔했던 이 문제는 지난해 2월 시세보다 공시가격이 너무 낮다는 취지로 경제정의실천시민연합이 공익감사를 청구하면서 드러났다. 감사원이 들여다봤더니 문제투성이였다. 개별 주택가격과 개별 공시지가를 산정하는 부서와 방식이 달랐고, 토지와주택 가격을 결정하는 기초가 되는 표준부동산 가격 산정방식에도 표본 수가 달라 오차가 발생했다. 결정적 오류는 표준부동산 가격을 산정할 때 해당지역의 용도를 감안하지 않았다는 점이다. 토지의 용도가 부동산 가격을 좌우하는데 이것을 빼고 계산했으니 제대로 될 리가 있었겠나.  
 
여기서 그치지 않는다. 아파트·빌라 등 전국 공동주택 1400만 가구는 이번 감사에 포함하지도 않았다. 주먹구구로 계산한 공시가격이 얼마든지 더 있을 수 있다는 얘기다. 공시가격은 재산세뿐 아니라 건강보험료 등 60개 세금·부담금의 산정 근거로 쓰인다. 이러니 공시가격에 이의를 제기하는 국민이 늘어나고 불복이 뒤따를 수밖에 없다. 이미 올해 3월 발표된 공동주택 공시가격에 대해 3만7000여 건의 이의제기가 신청됐다.  
 
국민 대다수는 평생 모아 노후에 보낼 집 한 채를 마련한다. 그런데 세금이 급등하는 데다 주먹구구로 계산됐다면 조세제도를 신뢰하고 세금을 낼 사람이 얼마나 되겠나. 지난해 주택 공시가격에 대한 이의신청이 1년 전보다 10배나 늘었다는 것은 조세 불신의증가를 의미한다. 가뜩이나 부동산 세금이 급격히 오르고 있는 와중에 이런 소식을 접한 재산세 납부자들은 얼마나 놀랐겠나. 조세의 일관성과 안정성을 담보하지 못한다면 조세저항도 거세질 수밖에 없다.  
 
정부는 즉각 조세제도의 신뢰를 회복해야 한다. 다행히 감사원이 이번에 잘못된 부분을 잡아내면서 구멍이 뚫린 조세 신뢰를 회복할 계기가 만들어졌다. 감사원은 “전국 사유지 43만여 필지는 개별 공시지가 공시 자체가 이뤄지지 않고 있다”고 개선을 요구했다. 정부는 신속한 수정 조치로 조세의 형평성과 신뢰를 회복하라.
