Justice starts to prevail (KOR)

Chung Kyung-sim, wife of former Justice Minister Cho Kuk, was sentenced to four years in jail in the Seoul Central District Court on Wednesday. The judge accepted the prosecution’s arguments that Chung orchestrated the fabrication of her daughter’s qualifications for college admissions. The court also found Chung guilty of illegal activities with a private equity fund and ordered her to compensate losses caused to investors. After the court’s ruling, Chung was arrested. The court’s ruling could suggest the former justice minister will be found guilty in a separate trial later on. The court’s decision also means that Cho and his followers’ hysterical accusations against the prosecution do not hold up in court.

The court blamed the defendant for “not accepting her wrongdoings at all.” It also pointed out that Chung wrongly accused witnesses of “making arguments against her for their own political and individual motivations.” The ruling translates into a stern judgement that the professor nonchalantly committed immoral acts in defiance of common decency, not to mention the law. We hope Chung and her husband reflect on what they did. Nevertheless, the former justice minister is behaving as if he is a martyr who “must walk a thorny path from now on.”

The court said that Chung brought “unfair outcomes” to other college applicants by helping her daughter pass the first-level exam of the Seoul National University Medical School and thus depriving competitors of a chance to pass the test. The court also said that her daughter would have failed to get admitted to the Pusan National University Medical School if the school had known of the forging of an award she submitted.

After the explosive Cho Kuk scandal, we saw a strange transformation of injustice into justice, unfairness into fairness and lies into truth in our society. Cho and her allies ferociously attacked opponents for “trying to cook up a political conspiracy” against them. They even defined the prosecution’s attempt to indict them as “resistance against the liberal administration.”

Fortunately, the court has put an end to their reckless assertions of martrydom. Despite President Moon Jae-in’s invitation of Chief Justice Kim Myeong-su to a Blue House meeting on Tuesday, the bench delivered a ruling without feeling any pressure from the president.

We hope the ruling paves the way for putting our society back on track after years of lopsided ideological and political offensives from the liberal camp. We expect our judiciary to do the same with a bunch of similar cases involving abuse of power. The court must show that justice will prevail.

정경심 법정구속, 정의 회복 신호탄 돼야

정경심 동양대 교수가 징역 4년형을 받고 법정 구속됐다. 법원은 정씨와 조국 전 법무부 장관의 딸 조민씨의 진학용 ‘스펙’ 위조에 대한 검찰 주장을 모두 사실로 인정했다. 사모펀드와 관련된 비리도 상당 부분 유죄로 보고 부당이득 추징을 결정했다. 재판부는 조 전 장관과 정씨가 딸 조씨 인턴 경력 확인서 위조의 공범이라고 판단했다. 따로 재판받는 조 전 장관에게도 유죄판결이 내려질 가능성이 크다는 것을 뜻한다. 범죄 사실을 검찰의 조작으로 호도한 조 전 장관과 그를 추종하는 이들의 억지가 법정에서 통하지 않았다는 것을 의미하기도 한다.

재판부는 “피고인은 단 한 번도 자신의 잘못을 인정하지 않았다”고 지적했다. “입시 비리를 진술한 사람들이 정치적 목적, 개인적 목적을 위해 허위 주장을 했다고 함으로써 법정에서 증언한 사람들을 비난하는 계기를 제공했다”고 의견을 밝히기도 했다. 법뿐 아니라 도덕과 상식에서도 벗어난 행위를 했다는 준엄한 비판이다. 정씨와 조 전 장관은 지금이라도 자신들의 삶을 되돌아보기 바란다. 선고 직후 “더 가시밭길을 가야 할 모양”이라며 순교자 행세를 한 조 장관의 행태가 안타깝다.

재판부는 또 정씨의 스펙 조작 등과 관련해 “범행의 죄질이 좋지 않고 딸 조씨가 서울대 의전원(의학전문대학원)에 1차 합격하는 등 실질적 이득을 거둬 다른 응시자가 불합격하는 불공정한 결과를 야기했다”고 지적했다. 아울러 동양대 표창장 위조와 관련해서는 “(부산대 의전원) 예비 심사에서 (허위) 표창장 제출이 확인됐다면 부적격 탈락했을 것”이라고 했다. 조씨가 위조된 스펙을 제시해 입학한 고려대와 부산대 의전원은 법원 판단을 존중해 하루빨리 ‘불공정한 결과’를 바로잡기 바란다. 대학은 진리의 전당이다. 거짓으로 오염된 곳을 그대로 둬서는 안 된다.

지난해 여름에 시작한 이른바 ‘조국 사태’는 불의가 정의로, 불공정이 공정으로, 거짓이 진실로 둔갑하는 도덕적 혼돈을 초래했다. 조 전 장관 측은 진실을 말하는 사람들을 정치적 음모를 꾸미는 사람으로 몰았고, 검찰의 불법 행위 적발을 정권에 대한 저항으로 규정했다. 지금도 여전히 그 프레임이 작동 중이다. 법원이 그들의 무모한 시도에 경종을 울리며 제동을 걸어 다행스럽다. 그제 문재인 대통령이 김명수 대법원장을 청와대로 불러 ‘개혁 동참’을 주문했음에도 재판부가 정치적 판결을 하지 않았다는 점도 국민을 안도하게 한다.

이 판결이 우리 사회에서 옮음과 그름의 경계가 제자리로 돌아가는, 정의(正義) 회복의 신호탄이 되길 바란다. 권세를 가진 이가 법을 유린한 유사 사건에서도 사법부가 현명한 판단을 내려줄 것을 기대한다. 범죄가 정의가 되고, 불법을 저지른 이가 꽃다발을 받는 타락이 더는 용인되지 않아야 한다.
