Dig at Meloni’s Height Could Cost Reporter in Italy 5,000 Euros

ROME — A judge in Milan has found an Italian journalist guilty of defaming Italy’s prime minister, Giorgia Meloni, and ordered her to pay damages of 5,000 euros, or about $5,500, as well as court costs, the defendant’s lawyer said.

In Wednesday’s ruling, the journalist, Giulia Cortese, was also given a suspended fine of 1,200 euros ($1,300) for two posts on Twitter, now known as X, in October 2021, when Meloni was a lawmaker. In one tweet, she described Meloni using “not nice words,” Cortese’s lawyer, David Olivetti, said. In another she took aim at Meloni’s height, suggesting Meloni was about 4 feet, tall.

Cortese said Thursday that the past three years had been “quite stressful.” Her social media accounts were targeted by supporters of the prime minister, “who sent me insults and threats.” It was “very unpleasant,” she said, adding, “Above all, it seems absurd to clog up Italian courts, which have to deal with far more serious things, with such nonsense.”

Italy defines defamation as “damage to the reputation of a person through communication with several persons.” It does not distinguish between public figures and ordinary people.

The case against Cortese is only the latest in a series of defamation lawsuits brought by Meloni against some of her outspoken critics. Luca Libra, a lawyer who has represented Meloni in several suits, said that, under Italian law, everyone has the right to criticize, as long as that criticism is not a personal offense.

Last year, a court in Rome ordered Roberto Saviano, author of the book “Gomorrah,” about organized crime in Naples, to pay 1,000 euros, or about $1,100, and court costs for his criticism of Meloni during a television program in 2020 in which he used a slur to refer to her for her hard-line stance on illegal immigration.

Another defamation lawsuit, against a man who used social media in 2019 to insult Meloni’s role as a mother, was settled last year.

Several organizations that monitor press freedom have voiced concerns about the lawsuits in Italy. Reporters Without Borders demoted Italy five places to 46th in its World Press Freedom Index this year, considerably lower than Germany (10) or France (21).

밀라노 법원이 이탈리아의 한 기자에게 조르자 멜로니 총리의 명예를 훼손해 피해를 입힌 혐의로 5000유로(약 5500달러, 약 755만원)의 벌금을 때렸다고 이 기자의 변호인이 밝혔다. 법원은 기자에게 소송 비용도 모두 부담해야 한다고 선고했다.

지난 수요일(7월 17일) 재판에서 지울리아 코르테세 기자는 2021년 10월 당시 트위터(지금은 X)에 멜로니를 비방하는 포스트 두개를 올린 혐의로 1200 유로(약 1300 달러)의 추가 벌금도 선고받았다. 이 당시엔 멜로니가 총리가 아닌 의원이었다. 그 중 한 건에선 코르테세가 멜로니에 관해 “그다지 좋지 않은 말”을 올렸다고 피고 측 데이비드 올리베티 변호사가 밝혔다. 또 다른 건에선 코르테세가 멜로니의 키가 4피트(약 1미터 22츠)밖에 되지 않는다며 공격했다고 변호인은 설명했다.

코르테세는 목요일 지난 3년간 매우 “스트레스를 받았다”고 말했다. 코르테세의 소셜 미디어는 멜로니 총리 지지자들로부터 집중 공격을 당했다고 한다. 이들은 “욕과 협박을 내게 보내왔고 이는 매우 불쾌했다”고 코르테세는 덧붙였다. 그는 이어 “무엇보다도 바쁜 이탈리아 법정이 훨씬 더 심각한 일 대신 이런 넌센스에 시간을 뺏긴다는 사실이 매우 터무니없다”고 말했다.

이탈리아는 명예훼손을 “여러 사람과의 커뮤니케이션을 통해 다른 사람의 명성에 해를 가하는 행위”로 정의한다. 공적 인물이나 일반인 중 누구를 대상으로 했는지를 구분하지 않는다.

코르테세에 대한 선고는 멜로니 총리를 공개적으로 비판하는 이들을 대상으로 한 잇따른 명예훼손 소송의 일환이다. 최근 일련의 소송에서 멜로니 총리를 대변하고 있는 루카 리브라 변호사는 이탈리아 법에 따르면 누구든 상대편을 비판할 수 있지만, 이 비판이 인신 공격이 되어선 안된다고 말했다.

지난해 로마 법원은 나폴리의 조직범죄를 다룬 ‘고모라’란 책의 저자인 로베르토 사비아노에게 1000 유로(약 1100 달러)를 선고했다. 그가 2020년 한 TV프로그램에 출연해 불법 이민자에게 강경한 정책을 취하는 멜로니 총리에 대해 욕을 했다는 혐의다.

2019년 소셜미디어에서 멜로니 총리가 엄마로서의 역할을 제대로 못한다고 공격했던 또다른 명예훼손 소송은 지난해 양쪽의 합의로 일단락됐다.

언론자유를 감시하는 여러 기관들은 이탈리아에서 벌어지고 있는 일련의 명예훼손 소송에 대해 우려를 표명해왔다. 국경없는 기자회는 올해 이탈리아의 언론 자유 지수 순위를 지난해보다 5계단 떨어뜨린 46위로 발표했다. 독일은 10위, 프랑스는 21위다.
