Don’t use the veto, Mr. President

A thorny decision awaited President Lee Myung-bak when he returned from his overseas tour. By tomorrow, he must either approve or veto a bill to probe a suspicious deal involving his post-retirement residence. The National Assembly on Sept. 3 passed a bill to name a special prosecutor to conduct an investigation into the purchase of a plot of land in a posh southern Seoul neighborhood by the president’s son and the presidential security service to build a retirement home for Lee, a plan that was scrapped after it raised political and social controversy. The president must sign or veto the bill within 15 days after the legislation is introduced.

We advise against the president’s use of his veto power. The justice minister and some in the presidential office have been recommending Lee resist the motion. They claim the bill, which requires the president to choose one of two candidates to head the special investigation recommended by the main opposition Democratic United Party, raises questions of fairness. In short, they are saying they cannot trust someone appointed by the DUP, which first raised the question of the legality of the real estate project, to conduct a fair investigation. They recommend the president protest the unconstitutionality of the motion.

However, the purpose of the bill is to discover whether Lee, his son and the security office have abused their power or committed any other wrongdoings in purchasing the real estate.

In January 2008, Lee filed a suit with the Constitutional Court claiming the law delving into allegations of his involvement with a dubious company called BBK was unconstitutional because the law gave authority to the Supreme Court chief justice to name a special prosecutor to probe the case. The Constitutional Court upheld the legitimacy of the probe saying the legislature has the authority to decide on the need for a special prosecutor to contain the abuse of power. It ruled that the National Assembly has the power to name a special prosecutor whenever it deemed it necessary.

It is right for the president to respect the constitutional authority of the legislature, but the political sector cannot avoid criticism of pushing for an investigation into an outgoing president for self-serving purposes. The opposition wants to fan anti-Lee Myung-bak sentiment, while the ruling party goes along to keep its distance from an unpopular president before the December presidential election. If the president does not veto the bill, it is a proper course for the DUP to surrender its right to name the chief of the investigation to another credible institution like the Korean Bar Association.

초읽기에 들어간 내곡동 특검법 문제 정부·청와대 일각 위헌주장은 안 될 말 2008년 BBK특검법 합헌결정 중시해야    러시아 등 4개국 순방을 마치고 어제 귀국한 이명박 대통령의 책상 위엔 정치적으로 민감한 숙제가 제출돼 있다. 국회가 지난 3일 정부에 넘긴 ‘내곡동 사저부지 매입의혹 조사를 위한 특별검사법안’(내곡동 특검법안)에 거부권을 행사할 것인가를 결정해야 한다. 대통령은 정부로 이송된 법안에 대해 15일 안에 공포를 하든가 거부권을 행사해야 하기에 이 대통령은 18일까지 가부간 입장을 정해야 한다.
   결론부터 말하면 이 대통령은 내곡동 특검법안에 거부권을 행사하면 안 된다. 특검법안에 거부권을 행사해야 한다는 견해가 권재진 법무장관을 중심으로 정부와 청와대 일각에서 확산되고 있는 모양인데 이는 안 될 말이다.
   거부권 행사론의 논거는, 특정정당인 민주당이 특별검사 후보 2명을 추천해 이 중 1명을 대통령이 임명토록 한 법안이 특검의 공정성 논란을 부를 수 있고, 대통령의 임명권을 사실상 박탈함으로써 헌법의 권력분립 정신을 해친다는 것이다. ‘정치적 고발인’인 민주당에게 아예 조사권까지 맡긴 것은 공정하지 않다는 얘기다. 한마디로 위헌소지가 있으므로 대통령이 국회에 재의를 요구해야 한다는 것이다.
고발인이 조사권을 행사하는 게 부적절하다는 지적은 나름대로 일리가 있다. 그러나 내곡동 특검법안은 다른 일반법과 달리 이명박 대통령과 아들 시형씨, 청와대 경호처의 불법성 여부를 수사하라고 만들어진 법이다. 이 대통령과 청와대는 일종의 피고발인인 셈인데 피고발인이 거부권을 행사하는 것은 고발인이 조사권을 행사하는 것보다 더 부적절한 일이다.    이명박 대통령은 당선인 시절인 2008년 1월, 측근인 김백준 전 청와대총무기획관을 통해 “특검추천권을 대법원장에게 맡긴 게 위헌”이라며 ‘BBK사건 특검법’을 헌법재판소에 제소한 적이 있다. 당시 헌재는 합헌결정을 내리면서 “권력통제기능을 가진 특검제도의 취지와 기능에 비춰 특검제 도입 여부를 입법부가 독자적으로 결정하고, 특검 임명에 관한 권한을 헌법기관 간에 분산시키는 것이 권력분립원칙에 반한다고 할 수 없다”고 명시했다. 특검추천권을 누구에게 줄 것인가는 전적으로 입법권의 재량에 속한다는 점을 분명히 한 것이다.
   이 대통령은 법 정신과 법 감정, 헌재의 판례에 따라 거부권을 행사하지 않는 게 옳지만 그렇다고 해서 내곡동 특검법이 갖는 지나친 정치성이 면제되는 건 아니다. 대선정국에 반(反)이명박 정서를 활용해 보겠다는 민주당의 얄팍한 속셈과, 괜히 여기에 반발했다가 친(親)이명박으로 찍힐지 모른다는 새누리당의 비겁함이 합세해 이런 포퓰리즘 입법을 낳은 것이다. 이 대통령이 거부권을 행사하지 않으면 민주당은 스스로 특검추천권을 포기하고 대한변협 등에 의뢰하는 방법을 택해 국민의 신뢰를 얻기 바란다.
