A last mission (KOR)

 President Moon Jae-in’s approval on Wednesday of a two-month suspension of Prosecutor General Yoon Seok-youl as recommended by a disciplinary committee has made a few things clear. First of all, Moon revealed himself to be the orchestrator of Justice Minister Choo Mi-ae’s purge of the top prosecutor. The president took an ambiguous stance during the yearlong standoff between the two. But after Yoon was ousted, albeit for only two months, Moon expressed “special thanks” to Choo for “faithfully carrying out a mission entrusted by the call of the times,” while heartily endorsing the disciplinary committee’s decision to punish Yoon.

In reaction, Yoon filed a complaint with an administrative court to stop his suspension from duty. The move heralds an unprecedented confrontation between the top prosecutor and the president. The ruling Democratic Party (DP) has come up with the idea of letting both Choo and Yoon go, but Yoon reportedly does not want to resign voluntarily.

Conspiracy theories about the government’s apparent attempt to neutralize the prosecution through Yoon’s purge are in full bloom. Many predictions have come true. Pundits had forecast that the disciplinary committee would suspend Yoon instead of firing him after a court put the brakes on the justice minister’s unusual order to suspend the top prosecutor. A glimmer of hope erupted after Moon underscored the importance of “procedural legitimacy.” But the disciplinary meeting only ended as scripted from the very beginning, as a suspension that is the equivalent of a dismissal.

What attracts our attention is the second half of the scenario. While Yoon is away, the government could drag its feet on the Wolseong-1 reactor data manipulation scandal and the Lime and Optimus fund scams involving the DP and hand them over to the Corruption Investigation Office for High-ranking Officials (CIO), which will be launched early next year, to cover up all dirt clinging stubbornly to the powers that be. Some pundits even expect Yoon to be the first target for investigation by the special law enforcement agency.

To prevent such a meticulously choreographed cover-up, the prosecution must get to the bottom of all suspicions swirling around our powers that be, including the nuclear reactor data fabrication scandal and the fund scandal.

The only entity the prosecution can rely on is the people. Prosecutors must dig up all cases involving corruption and abuse of power by the government to prove its real raison d’être. Much is at stake.


검찰, 흔들림없이 권력비리 수사 계속해야

문재인 대통령이 16일 윤석열 검찰총장에 대한 ‘정직 2개월’을 재가하면서 몇 가지 사실이 분명해졌다. 윤 총장과 추미애 법무부 장관이 대립하는 과정에서 애매한 태도를 보였던 문 대통령이 ‘윤 총장 찍어내기’의 지휘자임이 드러났다. 문 대통령은 윤 총장 징계에 대해 "임명권자로서 무겁게 받아들인다. 국민에게 매우 송구하다"고 한 반면, 추 장관을 두고는 “시대가 부여한 임무를 충실히 완수해 준 것에 대해 특별히 감사하다”고 했다.

이에 맞서 윤 총장이 즉각 징계처분 집행정지 소송에 나서면서 문 대통령과의 대립이 불가피해졌다. 여권에선 사의를 표명한 추 장관과 함께 윤 총장을 동반 사퇴시키는 구상이 나오지만, 윤 총장은 순순히 물러날 의사가 없다고 한다.

음모론처럼 흘러나온 검찰 무력화 시나리오가 단계마다 적중한 점도 심상치 않다. 이번 윤 총장 징계위를 앞두고 정직이 나오리란 예상이 일찌감치 흘러나왔다. 추 장관이 지난달 24일 사상 처음으로 내린 검찰총장 직무집행정지 명령이 법원에 의해 제동이 걸리자 사법부 관문을 통과하기 힘든 ‘해임’ 대신 ‘정직’을 택한다는 내용이었다. 문 대통령이 "절차적 정당성과 공정성이 중요하다"고 말해 합리적 진행에 대한 일말의 기대가 생기기도 했다. 비록 ‘반윤석열’ 일색이긴 해도 외부 인사인 정한중 한국외대 교수가 위원장 직무대행을 맡으면서 징계위 결정이 달라질지 주목됐지만, 회의 결과는 ‘형식은 정직, 효과는 해임’이라는 각본 그대로였다.

상황이 이렇게 전개되면서 시나리오 후반부를 주목하지 않을 수 없게 됐다. 윤 총장 부재를 틈타 월성 원전 경제성 평가 조작 사건과 라임·옵티머스 사건 같은 권력형 비리 수사를 질질 끌다가 내년 초 서둘러 고위공직자범죄수서처(공수처)를 출범시켜 해당 사건들을 넘긴다는 것이다. 이렇게 하면 현 정권 인사들의 비리 의혹은 모조리 덮을 수 있다는 얘기다. 두 달 뒤 복귀하는 윤 총장이 ‘공수처 수사 대상 1호’가 될 것이라는 예고도 들어 있다.

이런 전횡을 막으려면 검찰이 필사의 각오로 권력 비리 수사에 나서는 방법밖에 없다. 월성 원전 사건은 파일을 대거 삭제한 산업통상자원부 국장과 서기관이 구속돼 있다. 백운규 전 장관과 청와대의 관련성이 의혹의 핵심이다. 라임·옵티머스 사건은 이낙연 더불어민주당 대표의 핵심 측근이 극단적 선택을 했다. 윤 총장이 정직을 당하기 직전에 재가한 오거돈 전 부산시장에 대한 사전구속영장 역시 예사롭지 않다. 오 전 시장의 성추행 의혹은 4·15 총선 직후 터져나왔다. 사건이 총선 이전에 발생한 것으로 드러나면서 고의로 숨긴 게 아니냐는 의문이 제기됐다. 검찰은 살아 있는 권력의 비리를 캐는 책무를 입증할 마지막 기회라는 각오로 과감하고 신속하게 부정을 밝히기 바란다.
