Protect women from stalkers (KOR)

The murder of a female subway worker at Sindang Station in Seoul by her stalker and former colleague has stoked a dispute in political circles over hate crimes against women. When Kim Hyun-sook, minister of Gender Equality and Family, came to the mourning site for the victim, she was asked by reporters if she saw the crime as hate violence toward women. She answered she did not.The ministry explained that further discussions are needed to see if the killing was a gender-based hate crime. The ministry also promised to toughen laws against stalkers.But the minister's comment drew strong protest from women's rights organizations and the Democratic Party (DP). They demanded the minister resign. They also called for a withdrawal of the plan by the conservative Yoon Suk-yeol administration to eventually shutter the ministry. Even if the dispute is aimed at seeking a solution to violence against women, it is not desirable to politicize a murder case.The murder in Gangnam Station in May 2016 targeted a random woman. The investigation so far cannot put the Sindang Station murder in the same light. The murderer stalked the victim specifically and allegedly planned the killing methodically. "Instead of trying to categorize the crime, ways to find solutions to prevent such crimes are more imperative," said Lee Soo-jung, a professor of criminal psychology.The National Assembly Gender Equality and Family Committee was briefed on the case from the Justice Ministry, Supreme Prosecutors' Office, National Police Agency, the Gender Equality Ministry, Seoul City government, and Seoul Metro. They were pounded for not taking preventive actions. If police and other institutions had paid closer attention, the crime could have been prevented.But the legislature is also to blame for its inaction. As many as 14 bills to revise the stalking law of April 2021 are still pending at the legislature. One proposes to remove the provision that mandates a victim's approval to punish their stalker. The Sindang murder could have been avoided if the revision had been made.Gender conflict has become a political hot potato. Rival parties have been fanning the conflict as an ideological contest. What is urgent now is a practical solution to protect women from violence. At the same time, the practice of regarding stalking cases simply as a love affair must change. Politicians must share wisdom to come up with realistic solutions to defend women from predators instead of wrangling over gender issues.

서울 신당역 여성 역무원 스토킹 살인 사건을 두고 정치권을 중심으로 여성혐오 범죄 논쟁이 일고 있다. 지난 16일 사건 현장을 찾은 김현숙 여성가족부 장관이 '이번 사건을 여성혐오 범죄로 보느냐'는 취재진 질문에 "저는 그렇게 보지 않는다"고 답한 게 계기가 됐다. 이후 여가부는 여성혐오 범죄인지에 대해서는 추가 논의가 필요하고, 우선 스토킹 사건에 대한 엄격한 법 집행을 추진하겠다고 했다. 하지만 야당 일부와 여성단체들이 장관 사퇴를 요구하고 나섰다. 윤석열 정부의 여가부 폐지 방침을 철회하라는 주장도 나왔다. 여성혐오를 바탕으로 한 여성폭력에 대한 구조적 해결을 위해서라고는 하지만, 스토킹 살인을 정쟁의 이슈로 삼는 것 아니냐는 우려가 나온다.

여성혐오 범죄에 대한 경각심을 일깨웠던 2016년 5월 서울 강남역 살인 사건의 경우 불특정 여성을 대상으로 한 범죄였다. 현재까지 수사된 내용만으로는 신당역 사건이 이와 비슷한 성격을 가졌는지 판단하긴 이르다. 하지만 피해자를 특정해 지속적으로 괴롭혀 온 스토킹 범죄이자 계획범죄라는 사실은 명확해졌다. 이 때문에 "(이번 범죄를) 어떻게 분류하느냐보다는 대안을 찾는 게 지금 당장 필요한 일"(이수정 경기대 범죄심리학과 교수)이라는 의견에 주목해야 한다.

어제 국회 여성가족위원회 소속 여야 의원들은 법무부, 대검찰청, 경찰청, 여성가족부, 서울시, 서울교통공사 등 신당역 사건 관련 기관들로부터 현안 보고를 받았다. 예방적 대처를 제대로 한 곳이 없었다는 이유로 이들 기관을 질타했다. 경찰 등 관련 기관이 세심하게 주의를 기울였더라면 사전에 범행을 막을 수도 있었다는 점에서 이런 비판을 받는 건 마땅하다.

그러나 국회 역시 제 역할을 하지 못한 데 대해 반성해야 한다. 지난해 4월 스토킹 처벌법 제정 후 현재까지 국회에 계류 중인 개정안은 14건에 달한다. 피해자의 의사가 있어야만 처벌토록 하는 '반의사불벌죄' 규정을 삭제하는 개정안 역시 그중 하나다. 이 개정안만 신속히 처리됐더라면 신당역 살인을 막을 수도 있었다. 대법원도 가해자에 대한 구속영장 기각이 문제 되자 어제서야 "구속영장을 기각하더라도 전자발찌 착용 등을 조건으로 하는 조건부 석방 제도가 필요하다"는 입장을 내놨다.

최근 들면서 여혐 논란은 뜨거운 정치 이슈가 됐다. 이대남-이대녀 갈등까지 더해져 진영 대결 양상으로 증폭되고 있다. 그러나 중요한 것은 여성을 대상으로 한 흉악한 범죄가 더 이상 발붙이지 못하도록 실질적인 대책을 마련하는 것이다. "좋아하는데 안 받아주니 폭력적인 대응을 남자 직원이 한 것 같다"(이상훈 민주당 서울시의원)는 시대착오적 인식도 바로잡아야 한다. 정치권은 이 시간에도 어디선가 발생할지 모르는 여성 대상 범죄를 막기 위한 실질적 대책 마련에 머리를 맞대야 한다. 여혐 논란으로 시간을 허비할 때가 아니다.
