The judiciary has recently made decisions on driving under the influence cases involving entertainment industry insiders. Such cases were particularly frequent last year. Actor Kim Sae-ron was sentenced to a fine of 20 million won ($15,000) in the first trial on April 5. On the following day, the prosecution sought two years in prison for Shin Hye-sung, 44, a member of the boy band Shinhwa.

Under the current law, penalties and punishments are based on the blood alcohol level. Punishments vary depending on the level — 0.03 percent, 0.08 percent, and 0.2 percent — from license suspension or revocation to fines or prison sentences. The blood alcohol level of Kim — the actor who caused an accident in Cheongdam-dong, Seoul, last year — was 0.227 percent, which makes her subject to the highest level of punishment.

While there is an individual difference, how drunk was she at the time? Yoon Joong-jin, a former head of the National Forensic Service, categorized “the degree of clarity according to the blood alcohol level” into five stages: weak, mild, moderate, high and severe.

Here, 0.25 to 0.35 percent (high) refers to the condition in which it is “difficult to walk due to an evident lack of mobility, completely obscure in speech, decreased physical reflex function, sensory paralysis, and confusion of consciousness, and sometimes leading to coma.”

In short, the actor drove in a state in which she had difficulty walking, and if she had drunk more, she could suffer a “severe coma” with decreasing body temperature, slower breathing, and loss of reflex and consciousness, according to Yoon.

Drunken drivers insist on driving when they can hardly move at will because of “frontal lobe paralysis.” A neuropsychiatrist told me on a phone call, “Drinking paralyzes the frontal lobe of the brain like dementia,” and “the most common phenomenon in this state is loss of self-control over social taboos.”

This is why not only drunk driving but also sexual harassment and violence easily occur under the influence of alcohol. Shin Hye-sung is a repeat offender with a record of DUI since 2007. As he refused to be tested, he was indicted on charges of violating the Road Traffic Act and operating a vehicle illegally.

Fortunately, social awareness of DUI has increased over the past decade. In the early days of my career as a reporter, reporters covering the police had a saying, “If you are caught, don’t blow into the tester and call.” If you do that now, you can get into bigger trouble.
The movie “Another Round” (2020) sets a hypothesis that humans are relaxed and happy when maintaining a blood alcohol level of 0.05 percent. But the movie ends in tragedy. I will start by not forgetting the virtue of drinking less and in moderation.

지난해 유독 잦았던 연예계 음주운전 사건에 최근 사법부가 하나둘 판단을 내리고 있다. 배우 김새론이 지난 5일 1심에서 벌금 2000만원 형을 선고받았고, 6일에는 검찰이 그룹 신화 멤버 신혜성(본명 정필교·44)에게 징역 2년형을 구형했다. 현행법상 음주운전 처벌 기준은 혈중알코올농도다. 0.03%, 0.08%, 0.2% 세 수치를 기준점으로 행정처분(면허 정지·취소) 및 처벌(벌금 또는 징역형) 수위를 가중한다. 지난해 5월 서울 청담동에서 만취 사고를 낸 배우 김씨의 경우 최고형에 해당하는 0.227%였다.

개인차가 있지만 그 정도면 대체 얼마나 취한 걸까. 국립과학수사연구소장을 지낸 윤중진 박사는 약도·경도·중등도·고도·중증 등 5단계로 나눠 ‘혈중알코올농도에 따른 명정도’를 규정했다. 0.25~0.35%(고도)는 ‘운동실조가 뚜렷해 보행이 곤란하고, 말은 완전히 불명료하며 신체 반사기능 저하, 감각 마비, 의식 혼탁 등이 나타나며 때론 혼수상태’에 이르는 정도다. 한마디로 걷기 힘든 상태에서 운전한 건데, 여기서 더 마시면 ‘체온이 떨어지고 호흡이 느려지며 신체 반사와 의식이 소실되는’ 중증 혼수상태가 온다.

몸도 못 가누는데 굳이 운전대를 잡는 건 ‘전두엽 마비’ 때문이다. 신경정신과 전문의는 통화에서 “음주는 치매처럼 뇌의 전두엽을 마비시킨다”며 “이때 나타나는 가장 흔한 현상이 사회적 금기에 대한 자기제어 상실”이라고 했다. 음주운전뿐 아니라 평소 ‘해선 안 된다’고 여기는 성추행·폭력 등이 주취 상태에서 쉽게 일어나는 것도 이 때문이다. 가수 신씨는 2007년 음주운전 처벌 전과가 있는데도 재범했고 현장 측정을 거부한 끝에 도로교통법 위반(음주측정거부) 및 자동차 불법사용 혐의로 기소됐다.

다행스러운 건 음주운전에 대한 사회적 경각심이 최근 10년간 높아졌다는 점이다. 기자 초년병 때 “절대 (측정기를) 불지 말고 전화하라”는 민원 공식이 경찰기자 사이에 떠돌았는데, 요즘은 “그랬다간 더 큰일”이라는 게 기정사실이다. “인간은 혈중알코올농도 0.05%를 유지할 때 느긋하고 행복해진다”는 가설을 다룬 영화 ‘어나더 라운드’는 결국 비극이었다. 나부터 덜 마시고, 적당히 마시는 미덕을 잊지 말아야겠다.
