Clear suspicions about the ‘5-billion-won club’ (KOR)

The prosecution has summoned former special prosecutor Park Young-soo — who is suspected of taking 5 billion won ($3.9 million) in bribes from a developer in the controversial Daejang-dong redevelopment project in return for favors — for questioning and plans to request an arrest warrant for him depending on the results of the probe. After the names of six lawyers, including Park, under the same suspicion were exposed in the National Assembly in October 2021, the mystery has yet to be cleared. Only a former lawmaker was arrested and indicted, but he was found not guilty in the first trial. If the prosecution summons Park, he will be the second suspect to be investigated by prosecutors. A bill aimed at appointing a special prosecutor to investigate the case was passed in the legislature in March.

Suspicions over Park are many. The prosecution is known to have obtained the testimony from Kim Man-bae — a key member of the developer — that the former special prosecutor demanded 20 billion won from Kim in return for helping him to win the bid for the development when he was the board chair at Woori Bank in 2015. At the time, the bank issued a letter of intent to lend 150 billion won to the developer to help him win the bid.

Park also received 15 million won each month from Hwacheon Daeyu — the developer where Kim was the largest stakeholder — as counseling fees. His daughter also gained 800 million in profit from an apartment she received from the developer. After serving as a top prosecutor, Park helped impeach former president Park Geun-hye over corruption as special prosecutor. He denies all allegations against him.

The suspicions over Park were raised from the early stage of the development scandal. But the prosecution’s investigation was lackluster except for summoning the former prosecutor twice in 2021 and 2022. Then the prosecution started investigations in March after the legislation and judiciary committee passed a bill to appoint a special prosecutor to look into his suspicions. Prosecutors’ probe of other members of the “5-billion-won club” is also proceeding at a snail’s pace. The last time when the prosecution summoned former Supreme Court justice Kwon Soon-il — another member of the dubious club — was the end of 2021, not to mention its investigation of a former prosecutor general also suspected of receiving 5 billion won from the developer.

The Daejang-dong scandal cannot be resolved without clearing the suspicions about the six. The legislature put the bill on appointing a special prosecutor on the fast track in April. If the bill is passed in a plenary session of the Assembly in December, investigation authority will be transferred to a special prosecutor. We urge the prosecution to get to the bottom of the case before it’s too late.

'50억 클럽' 박영수 17개월만에 소환... '제 식구 감싸기' 없어야

의혹 제기 1년 8개월만에 구속영장 청구 검토
철저한 진실 규명만이 '봐주기 수사' 오명 벗어

대장동 50억 클럽 의혹을 수사해 온 검찰이 22일 박영수 전 특별검사를 비공개 소환하는 한편 구속영장 청구 방안을 검토하고 있다. 2021년 10월 대장동 업자들의 뒤를 봐주고 50억원을 주기로 했다는 법조계 인사 6명의 명단이 국회에서 공개되면서 '50억 클럽' 의혹이 제기됐지만 1년8개월이 지난 지금까지 실체는 규명되지 않았다. 6명 중 단 1명, 곽상도 전 의원이 구속기소된 게 전부인데 1심에서 무죄가 선고돼 국민의 공분을 키웠다. 박 전 특검이 두 번째 수사 대상자인 셈인데 이 또한 석 달 전 국회 법사위에 상정된 50억 클럽 특검 법안을 의식해 등 떠밀리듯 사법 처리에 들어간 인상이 짙다. 검찰의 수사 의지에 의문이 제기될 수밖에 없는 이유다.

대장동 사건에 얽힌 박 전 특검의 의혹은 한두 가지가 아니다. 검찰은 박 전 특검이 2015년 우리은행 이사회 의장 재직 당시 대장동 사업을 돕는 대가로 200억원 상당을 요구했다는 김만배씨의 진술을 확보했다고 한다. 당시 우리은행은 대장동 업자 측에 1500억원의 대출 의향서를 발급해 '자금 조달' 항목에서 만점 가까운 점수를 받게 해줬다. 누군가 힘을 쓰지 않았다면 어려운 일이다. 또 박 전 특검은 김만배씨가 대주주로 있던 화천대유에서 월 1500만원의 고문료를 받았고, 박 전 특검 계좌에서 5억원이 화천대유 측에 송금된 정황도 드러났다. 그의 딸도 대장동 아파트를 분양받아 8억원대의 차익을 거뒀다. 박 전 특검은 대검 중앙수사부장 등 검찰 고위직을 지냈고 '최순실 국정 농단 사건' 특검을 맡아 박근혜 전 대통령 탄핵을 끌어낸 인사다. 본인은 혐의를 부인하고 있지만, 누구보다 자기 관리에 엄정해야 할 사람이 이런 의혹들에 연루된 사실 자체가 충격적이다.

박 전 특검에 얽힌 의혹들은 대장동 사건 초기부터 꼬리를 물며 제기돼 왔다. 하지만 박 전 특검에 대한 검찰 수사는 2021년 11월과 지난해 1월 두 차례 소환을 끝으로 진척이 없었다. 그러다 법사위에서 특검 법안이 상정될 즈음인 지난 3월에야 강제수사에 나섰다. 다른 50억 클럽 관련자들 수사도 지지부진하긴 매일반이다. '재판 거래' 의혹을 받는 권순일 전 대법관 수사는 2021년 말 소환이 마지막이다. 대장동 초기 김만배 씨와 대책을 논의한 의혹을 받았던 전직 검찰총장도 이후 별다른 소식이 들려오진 않고 있다.

대장동 사건은 50억 클럽 의혹을 밝혀내지 않고는 정리될 수 없다. 국회는 지난 4월 50억 클럽 특검을 신속 처리 안건 (패스트트랙)으로 지정했다. 오는 12월 본회의에서 법안이 통과되면 수사의 주도권은 특검으로 넘어간다. 남은 6개월 동안 검찰이 의혹을 철저히 규명하지 않으면 '제 식구 감싸기'와 부실 수사 비판에서 벗어날 수 없다.
