Parents of Teen Driver Who Killed Girl in High-Speed Crash Are Sentenced

NEW YORK - A New York couple who bought their 16-year-old son a BMW were sentenced Monday to three years of probation and 26 weeks of parenting classes after the teenager drove the car at speeds of more than 100 mph, slammed into a truck and killed his passenger, a 14-year-old girl.

The teenager, whose name has not been released because of his age, was arraigned last December on at least a dozen charges, including second-degree manslaughter and reckless endangerment of a child. He faces up to 15 years in prison if convicted.

He had a junior driver’s license, which prohibited him from driving unsupervised under any circumstances in New York City, when in May 2023 he crashed his red 2005 BMW 325i into the back of a parked UPS truck in the Springfield Gardens neighborhood of Queens, prosecutors said.

The teenage driver survived the crash with minor injuries, but his passenger, Fortune Williams, a freshman at a Springfield Gardens high school, was thrown from the car and pronounced dead at the scene, prosecutors said.

Prosecutors decided to charge the teenager’s father, Sean Smith, 40, and mother, Deo Ramnarine, 43, with endangering the welfare of a child when they learned that the parents had given him the car and allowed him to drive it to school, even after school administrators had warned them that he was too young to drive legally.

The parents were charged with endangering the welfare of their own son, in a case that prosecutors described as “groundbreaking” and “the first of its kind in New York.”

“With this conviction, we have shown that the culpability in a fatal crash can go beyond the driver,” Melinda Katz, the Queens district attorney, said in a statement. “Parents who provide vehicles to their children and let them drive illegally can be held responsible in the case of tragedies such as this one.”

Smith, who pleaded guilty in June, apologized during his sentencing hearing in Queens criminal court Monday.

In court was Fortune’s mother, Keisha Francis, who said she believed Smith’s remorse was sincere.

“I accept his apology,” she said. But Francis said she would have preferred that both parents spend a year in jail, the maximum penalty for the charge.

“Their recklessness, it cost my daughter’s life,” Francis said. “They need to be held accountable.”

열 여섯 살 아들에게 BMW 차량을 사준 부부가 월요일(7월 22일) 집행유예 3년에 26주 부모교육을 이수하라는 판결이 내려졌다. 10대인 이들이 아들이 차량을 시속 100마일(160.9 km)로 과속 운전하다 트럭과 충돌해 동승자였던 14세 소녀가 목숨을 잃었기 때문이다.

미성년자로 이름이 공개되지 않은 이 청소년은 앞서 지난 12월 10여 가지 이상의 혐의로 기소됐다. 그의 혐의 중에는 2급 살인(미필적 고의에 의한 살인)과 난폭 운전으로 어린이를 위험에 처하게 한 혐의 등이 포함됐다. 그는 기소될 경우 징역 15년의 형에 처해질 수 있다.

그는 청소년 운전면허를 소지하고 있었다. 뉴욕에선 이 면허를 소지한 청소년이 어떤 경우에도 성인의 감독 없이 단독으로 차를 몰 수 없다. 검찰은 그럼에도 불구하고 그가 2023년 5월 뉴욕 퀸즈 스프링필드 가든에서 자신의 2005년형 BMW325i로 주차돼 있던 UPS 트럭의 뒤를 충돌했다고 밝혔다.

청소년 운전자는 몇 가지 경상을 입고 살아남았지만, 함께 차를 타고 있었던 스프링필드 가든 고등학교의 신입생 포춘 윌리엄스는 차량 밖으로 튕겨져 나가 현장에서 사망 선고를 받았다고 검찰 측은 밝혔다.

검찰은 청소년의 아버지인 숀 스미스(40)와 어머니 디오 램너린(43)에 죄를 묻기로 결정했다. 이들이 아들에게 차를 주고 학교에 운전해 가도록 허락하면서 한 어린이를 위험에 처하게 만들었다. 앞서 학교 행정처가 부모에게 그가 정식으로 운전하기엔 너무 어리다고 경고했음에도 일어난 일이다.

부모는 자신의 아들을 위험에 처하게 했다는 혐의에 대해서도 유죄 선고를 받았다. 검찰 측은 이에 대해 ”사상초유의 사건으로 뉴욕에선 처음 발생한 일“이라고 설명했다.

퀸즈 지방 검찰청의 멀린다 카츠 검사는 성명을 통해 ”이번 유죄 판결로 사망자를 낸 자동차 사고에 대한 책임을 운전자 외의 사람으로 확대할 수 있다는 점을 보여주었다“고 말했다. 그는 또 ”자녀에게 차량을 제공하고 불법 운전을 허용해 이번처럼 비극으로 이어진 경우 부모가 책임을 져야 할 수 있다”고 덧붙였다.

지난 6월 유죄를 인정한 스미스는 월요일 퀸즈 형사법정에서 열린 선고 진행 중 사과했다. 이날 재판을 지켜본 포춘의 어머니 케이샤 프랜시스는 스미스가 죄책감을 갖고 있다는 점을 믿는다고 말했다. 프랜시스는 이에 따라 “그의 사과를 받아들였다”고 했다. 그러나 부모 둘 다 이 범죄 최고 형량인 징역 1년의 실형을 받길 원했다고 했다. “부모의 무모함 때문에 내 딸이 목숨을 잃었다”며 “그들은 책임을 져야 한다”고 밝혔다.
