New York Considers State Work Permits for Migrants as Influx Worsens

Frustrated by the federal response to the migrant crisis, Gov. Kathy Hochul said on Tuesday that New York state was considering ways to issue work permits to asylum-seekers in a bid to circumvent the long wait for permits at the federal level.

Such a drastic step would make New York the first state to openly test federal law, underscoring the depth of a crisis that has sent over 100,000 migrants to New York City over the past year.

The move, which would likely be challenged in court, could also escalate tensions between President Joe Biden and Democratic leaders in New York, who have increasingly criticized his handling of the situation.

“This would be unprecedented,” Hochul said at a news conference in her Manhattan office. “I believe the federal government believes that we need to have their authority to move forward with state work permits, but, as I’ve said, we have to let them work.”

Lawmakers in Albany have introduced bills that would create a state-level worker permit program for individuals who have filed federal paperwork claiming asylum. Hochul, a Democrat, has not endorsed any particular bill and stressed that her lawyers were still exploring multiple ideas. She said she would meet with the state’s legislative leaders on Tuesday, and did not rule out calling a special session in Albany to pass legislation.

Earlier Tuesday, White House officials pushed back against a state-level work permit system. In a call with reporters, senior administration officials said that work permits were “very clearly a federal authority,” adding that workarounds were “not something that we would encourage states to pursue.”

Instead, the officials said they were focused this month on helping the city and state accelerate the permit application process for migrants who were already eligible to work but had not yet filled out the necessary paperwork. The White House was unable to say how many migrants in the city are in that category, but said the number was substantial.

The officials spoke anonymously to discuss the Biden administration’s efforts to assist New York.

The debate around work permits comes at a critical moment for New York City. An estimated 59,000 migrants are still in city shelters. As space and resources dwindle, New York’s leaders are increasingly concerned services could buckle, with grave humanitarian and political implications.

미국 연방 정부의 이민자 정책에 실망한 뉴욕주 캐시 호컬 주지사는 12일(현지시간) 난민 신청을 한 이민자들에게 연방 정부와는 별도로 뉴욕주가 독자적인 취업 허가를 주는 방안을 검토하겠다고 밝혔다. 연방정부가 국경을 넘어 몰려든 이민자들을 대거 뉴욕주로 보냈지만, 정작 연방 차원의 취업 허가 발급은 하세월이라서다.

이는 연방 정부의 권한인 취업 허가에 주 정부가 공개적으로 도전하는 첫번째 사례다. 올 한 해에만 연방 정부는 국경을 넘은 이민자 10만여명을 뉴욕시로 보낸 상황이다.

주 정부가 이런 방안을 추진한다면 이는 법정으로 갈 공산이 크며, 이민자 러시를 둘러싼 조 바이든 미국 대통령과 뉴욕의 민주당 지도자들간의 갈등은 더욱 골이 깊어질 것으로 보인다. 뉴욕 민주당 지도자들은 연방 정부의 이민자 대처 방식에 대해 공개적으로 비판해왔다.

호컬 주지자는 자신의 맨해튼 주지사 사무실에서 연 기자회견에서 “주 정부의 이런 방안은 전례가 없긴 하다”면서 “몰려든 이민자들을 마냥 방치할 수는 없고, 주 정부라도 취업 허가를 내 주어 일을 할 수 있게 해야 한다”고 말했다.

뉴욕주의회는 연방 정부에 난민 신청 절차를 밟고 있는 이민자들의 경우, 주 정부 차원에서 취업 허가를 내줄수 있는 법안을 제출해놓은 상태다. 민주당 소속인 호컬 주지사는 그간 이 법을 포함해 어떤 법안에도 공개적인 지지를 표명한 적은 없었고, 주 정부 법률가들이 여러 가지 대안을 놓고 고민 중이라고 밝혔었다. 하지만 이번 기자회견에서 호컬은 주 의회 의원들과 이날 만날 예정이며, 주 의회에서 임시 회기를 열어 이런 법안을 통과시키는 방안을 배제하지 않고 있다고 밝혔다.

호컬의 기자회견 이전 백악관 관계자들은 기자들의 질문에 “취업 허가는 분명한 연방 정부의 권한”이며 “백악관은 이를 우회하는 방안을 주 정부에 권장하지 않는다”고 말했다. 대신 백악관 측은 일할 자격이 있는데도 아직 신청 서류를 연방 정부에 제출하지 않은 난민들에게 이를 조속히 제출토록 주 정부와 시 정부를 돕고 있다고 밝혔다. 백악관 측은 이 숫자가 얼마나 되냐는 질문엔 상당하다고만 말했다.

익명을 요구한 백악관 관계자들은 바이든 정부가 뉴욕시와 뉴욕주를 돕기 위해 노력을 기울이고 있다고 덧붙였다.

약 5만9000명이 넘는 이민자들이 현재 뉴욕시의 임시 쉼터에 머물고 있다. 이민자들을 위한 지원과 공간은 몰려드는 이민자 때문에 빠르게 줄고 있고, 뉴욕주와 시는 이들을 위한 서비스가 바닥을 드러내면 인도적ㆍ정치적 위기 상황이 올 거라고 우려하고 있다.
