Family Dollar Is Fined $41.7 Million Over Rodent-Infested Warehouse

The value-store chain Family Dollar was fined $41.7 million, the largest-ever financial criminal penalty in a food safety case, for distributing food, drugs, medical devices and cosmetics from a rat-infested warehouse, the Justice Department said.

On Tuesday, Family Dollar pleaded guilty in federal court in Little Rock, Arkansas, to one misdemeanor count of holding products in unsanitary conditions, causing them to become adulterated. The $41.675 million penalty is estimated to be the value of the products that were tainted when stored in unsanitary conditions, according to the plea agreement.

The distribution center in West Memphis, Arkansas, according to court documents, serviced 404 Family Dollar stores in six states: Alabama, Missouri, Mississippi, Louisiana, Arkansas and Tennessee.

Family Dollar is a subsidiary of Dollar Tree, a rapidly growing retail giant that operates more than 16,000 stores across the United States and Canada.

Family Dollar temporarily closed stores in 2022 because of the infestation. The stores were closed for a few weeks but have all reopened, said Kristin Tetreault, a spokesperson for Dollar Tree.

The rats had “established a presence” at the warehouse in July 2021, according to the plea agreement.

An employee filed a complaint with the Occupational Safety and Health Administration.

In 2022, inspectors from the Food and Drug Administration observed “live rodents, dead rodents in varying states of decay, rodent feces and urine, and evidence of gnawing, nesting, and rodent odors throughout the facility, in addition to dead birds and bird droppings,” according to the plea agreement in the case.

As many as 1,270 rodents were exterminated when the warehouse was fumigated in January 2022, federal officials said.

On Feb. 18, 2022, the company voluntarily recalled all drugs, medical devices, cosmetics and human and animal food products sold since Jan. 1, 2021, in the 404 stores that had been serviced by the infested warehouse, the Department of Justice said.

The plea agreement reached Tuesday requires Family Dollar and Dollar Tree to meet “robust” corporate compliance and reporting requirements for the next three years.

Dollar Tree said in a statement that it had “significantly enhanced” its compliance and safety programs by hiring experienced personnel, providing safety trainings and satisfying a third-party audit.

할인마트 체인을 운영하는 미국 유통업체 패밀리 달러가 식품ㆍ위생 사건 사상 최대 벌금인 4170만 달러(약 556억원)를 물어야 하는 처지에 놓였다. 먹거리ㆍ의약품ㆍ의료기기ㆍ화장품 등을 쥐가 창궐하는 창고에 보관했다가 유통했기 때문이라고 미 법무부는 27일(현지시간) 밝혔다.

이날 패밀리 달러는 아칸소주 리틀락 연방법원에서 판매할 상품을 비위생적인 환경에서 보관해 오염되게 했다고 인정했다. 공개된 유죄 인정 합의서에 따르면 죄를 인정하면서 물게 된 벌금 4170만 달러는 비위생적인 환경에 보관해 오염된 상품 가치를 모두 합한 액수다.

법원 문건에 따르면 문제가 된 이 회사의 아칸소주 웨스트 멤피스 유통센터는 앨라배마ㆍ미주리ㆍ 미시시피ㆍ루이지애나ㆍ아칸소ㆍ테네시 등 6개 주에 있는 패밀리 달러 404개 매장에 상품을 공급해왔다.

패밀리 달러는 최근 급성장하고 있는 미국 유통 거인 달러 트리의 자회사다. 달러 트리는 미국과 캐나다에 매장 1만6000여개를 갖고 있다.

지난 2022년 유통센터 오염 문제가 붉어지자 상당수의 패밀리 달러 매장은 문을 닫았다. 하지만 몇 주 만에 모든 매장들이 다시 문을 열었다고 달러 트리 대변인 커스틴은 밝혔다.

유통센터에 쥐가 자리잡기 시작한 것은 2021년 7월부터라고 유죄 인정 합의서는 밝히고 있다. 이 문제는 패밀리 달러의 한 직원이 미국 직장 안전ㆍ건강청에 진정을 넣으면서 알려졌다. 2022년미 식품의약국(FDA) 관계자들이 현장에 나와 상황을 점검한 결과 “대량의 살아있는 쥐와 여러 단계로 부패 중인 쥐의 사체, 쥐 배설물, 쥐가 갉아먹은 흔적, 쥐가 장기간 머문 흔적 등을 찾아냈고, 악취가 진동하고 있는 것”을 발견했다. 합의서는 또 죽은 새와 새똥도 다수 있었다고 명시했다.

연방정부 관계자들은 유통센터를 2022년 1월 소독하는 과정에서 1270마리의 쥐를 박멸했다고 밝혔다.

같은 해 2월18일, 패밀리 달러는 2021년 1월1일 이후 이 유통센터에 보관했다 판매한 모든 의약품, 의료기기, 화장품과 식품, 반려동물 사료를 자발적으로 리콜했다고 미 법무부는 밝혔다.

27일 미 법무부와 회사 양측이 합의한 안엔 회사가 식품위생ㆍ안전 관련 법 규정 준수를 엄격히 하고, 이를 연방정부에 3년간 보고하라는 내용도 포함됐다.

달러 트리는 공식 입장문에서 사태 발생 후 관련 전문가를 채용했고, 사내 교육을 신설했으며, 제3자 감사를 받기 시작하는 등 안전ㆍ위생 관련 회사의 프로그램을 대폭 강화했다고 밝혔다.
