Fiorello La Guardia (1882-1947) was a descendant of Italian immigrants. After graduating from New York University and serving in the military during World War I, he was discharged as a major and became a judge in New York.

During the Great Depression in the 1930s, an old man was arrested for theft. He had stolen bread from a grocery store after having eaten nothing for four days. The bread cost around $10. After questioning the old man, judge La Guardia fined him $10, which the man did not have.

La Guardia gave the verdict again. He said that the old man had to live such a hard life because the people in the cold-hearted city failed to take care of the poor. So he fined himself $10 and everyone in the court 5 cents.

A hat went around, and everyone paid the fine without complaining. They collected $57.5. Judge LaGuardia paid the $10 in fines from the collection and gave the rest to the old man. You can imagine the atmosphere at the court and what happened to the old man.

La Guardia was frequently coaxed and threatened by the mafia because he was an Italian descendent, but he steadfastly ruled criminal cases without compromise. As he became famous for his integrity and humanity, he was elected to the Congress and served seven terms, from 1919 to 1933. Then he served three four-year terms as the mayor of New York City.

Upon retirement from the mayoral position, he became the director general of the UN Relief and Rehabilitation Administration and passed away at the age of 65. In commemoration of his legacy, the city renamed the airport after La Guardia and erected his statue. The airport is mostly used for domestic flights today. Why am I not moved by Korean politics?

라과디아 판사의 심금 울린 판결

피오렐로 라과디아(1882~1947)는 이탈리아 이민의 후손이었다. 미국 뉴욕대학을 졸업하고 제1차 세계대전에 참전해 소령으로 제대한 뒤 뉴욕의 치안판사가 됐다. 1930년대 대공황 시절의 어느 겨울 한 노인이 절도죄로 잡혀왔다. 나흘을 굶고 식료품 가게에 들어가 빵을 훔친 죄 때문이었다. 빵값은 10달러 정도였다. 그 노인을 심문한 라과디아 판사는 그에게 10달러의 벌금을 선고했다. 그러나 그 노인에게는 그만한 돈이 없었다.

그러자 라과디아 판사가 다시 평결을 내렸다. “이 노인이 이렇게 어려운 삶을 살게 된 데에는 이 비정한 도시에 사는 우리가 가난한 사람을 돌보지 않은 죄가 있습니다. 그래서 저는 먼저 이 잘못에 대해 나 자신에게 벌금 10달러를 선고합니다. 그리고 이 법정에 온 모든 참석자도 함께 잘못을 저질렀으므로 각기 5센트의 벌금을 선고합니다.”

그러고는 모자를 돌리니 누구도 군말 없이 벌금을 냈다. 헤아려 보니 모인 돈이 57달러 50센트였다. 라과디아 판사는 모인 돈에서 10달러를 벌금으로 납부하고 나머지를 그 노인에게 줬다. 그다음의 법정 분위기나 노인의 후일담에 관해서는 독자들이 흐뭇하게 상상하도록 여백으로 남겨둔다.

라과디아 판사가 이탈리아 출신 동족이라는 이유로 마피아의 회유와 협박을 많이 받았으나 타협없이 요지부동으로 범죄를 다스렸다. 그러한 강직함과 인간미로 명성을 얻은 그는 의회에 진출해 1919년부터 1933년 사이에 7선 의원이 됐다. 그 뒤에는 1934년부터 뉴욕 시장을 4년씩 세번 역임했다.

시장에서 물러난 뒤 그는 유엔에서 구호국 사무총장으로 일하다가 65세의 연부역강한 나이에 타계했다. 1953년 뉴욕시는 그의 업적을 기려 뉴욕공항을 '라과디아 공항'으로 이름을 바꾸고 동상을 세웠다. 지금은 주로 국내선 공항으로 쓴다. 우리 정치에는 왜 그런 감동이 없을까.
